In an action fLi* damages for an assault, tried yes ten! n, in our Circuit Court, the pa r ticuiars of wh en it is not necessary to recite, although the verdict was matter ol astonish ment to almost every man present, the Jury ; gave the plaintiff 3*25 dollars damages!— j And how did this Jury of twelve men arrive at this conclusion ? By a very simple process, j namely. — Mach juror placed in a hat a slip of paper on which was written the amount ot damages to which he thought the plaintitl en titled. The different sums on these slips were added together nnd divided bv twelve; the result, » 32-5, was the verdict of the jury. Some were ti>r $1000, and ol course others must have put into tins novel species ot iotte rv, tickets f*r n much smaller sum, to reduce ; the average to $.'P2.">. Now I would respect fully ask the gentlemen of the jury, on the one side or t tm other, how they could (as men . of sen<e.) rec >ucile this verdict with their | duty, “to well and truly try the issue joined between the parties and a true verdict ren der according to ihc evidence.” A new trial was demanded by the defend ant, and the Court expressed their willingness to grant it, unless the planlitl would accept the same amount or damages given him by! another jury against another defendant in a i ra^e somewhat similar growing out of the i fame transaction. The phinlifl by his conn- i sel agreed to this proposal, and the matter j was ultimately compromised by the payment i of $100 and costs. The defendant was entitled to a new trial ; or he was not; amt hy what authority the Court undertook, I will not say, to dictate, but to suggest a compromise between the parties is unknown to One unlearned in the Late.
