DECISION IS DEFERRED
Test Case of D. G. Grillbortzer Vs.
City Council Taken Under
J Advisement
f '
After hearing arguments yesterday
in the tax suit of David G.
GriJlbortzer against the city of Alex1
andria, Judge Henry W. Holt, oi
J Staunton, took the ease under ad|
visement and announced that he will
render a decision in about a fortnight.
The amount involved in Mr.
. Grillbortzer's suit is $202.-10, the
j amount of taxes which he claims, together
with Fairfax county, should
go into the coffers of that county,
but which this city maintains belongs
to it, owing Lo the fact that
Grillbotzer is a resident of that portion
of- Fairfax county annexed ovei
; a year ago to this city,
i The suit is in reality, therefore
ia test case of the rights of this city
1 to collect taxes from residents of
the annexed territory in Alexandria
, and Fairfax counties, and a decis.
ion by Judge Holt, will declare wheth
., er the total of .$8,500 in taxes from
other residents of these districts bei
longs to either of the two counties
! or to the city of Alexandria.
In the arguments yesterday this
city was represented by Attorney
J. K. M. Norton, former corporation
iudtrc. and by Corporation At
! j torney Samuel P. Fisher, Attorneys
, Thomas R. Keith and C. Vernon
} Ford represent Fairfax county in the
test case and Attorney Frank L. Ball
