DECISION SUSTAINED Important Ruling in Workmen's, Compensation Award ? Richmond, Sept. 11.?In an opin ion handed down Tuesday by Judge Beverley T. Crump, of the Law and Equity Court of the city of Richmond the Industrial Commission of Vir ginia is sustained on every point in the first case appealed by defendant employers from the decision of the commission. The case in question was that of Phaup and Tinsley against Isaac "Eray, complained that he was injured at Seven Pines while sawing wood in the employ of Phaup and Tinsley. anJ claiming that the injury had j arisen out of and in the course of j such empIovment. The injury alleged was the loss of a part of the index finger and the laceration of the thuniib of his right hand. Phaup and Tinsley, the defendants claimed that they did not come with in the provisions of the workmen'? compensation act, and that they were merchants and not contractors. The defense was also made tha 1 Bray was employed by a third party at the time of his alleged injury which said third party was an inde pendent contractor, and that the al leged injury was intentionally self inflicted. After hearing all,the evidence sub nrited, the State Industrial Commis sion decidc 1 thai the claimant, Isaac Bray, was entitled to recover from the defendants. Phaup and Tinsley. compensation for the loss of the in dex finj*er of the right hand, and he was awarded the amount of S10 pir week for a period/ of thirty-five weeks. The case was appealed with in thirty days by Phaup and Tins ley. This being, as it^were. a test case under the operation of the work men's compensation ,act. the opinion of Judge Crump is regarded as being peculiarly significant to the -S.OOO employees of the State of Virginia.
