ing today the enso of K. II. Harriman
and Otto II. Kuhn versus the Inter
state Commerce Commission, tho Su
preme Court held that the commission
is not entitled under tho Interstate
Commerce lawa to press questions re
lating to private transactions, even
though they Involve dealings in tho
lecurities of interested railroads, when
the investigation is begun on tho com
mission 'a initiative.
The opinion was nnnounccd by Jus
tice Holmes and dealt with tho refus
al of Harriman nnd Kuhn to mako re
plies to questions of tho commission in
tho conrfo of inquiry concerning tho
dealings of Hurrimnn ns president of
the I'nion Pacific, nnd stocks of othor
railroad companies, mnny of which
worn competing lines.
A dissenting opinion was concurred
in by Justices Harlan nnd McKennn,
and .lustlco Day declared that tho ef
fect of the opinion of tho majority
would bo materially to narrow tho
cope of tho Interstate Commcrco law.

the questions of tho commission so far
as unstained by tho circuit court of tho
northern district of Now York, wcro
entirely proper, nnd should have been
answered by Harriman nnd Kuhn.
