One of the most plausible arguments advanced by the advocates of polities! rate-making that if the interstate commerce commission cun determine that it rate is .njust or unreasonable, it is equally able to determine wp..f rate would he just and reasonable. Tnio does not at all follow. The interstate commerce commission may he perfectly competent to determine that a rate is unjust and unreasonable, xvliile it is unable to say what rate is ju-t and reasonable. The reasuu for this is that a hat makes a rate unjust or unreasonable, is its effect upon the commerce of the public, and that is sus ceptible of proof and relatively easy of oetermmatioii. But what makes a rate just and reasonable is quite another matter, and involves, besides the nega tive proposition that it shall not impede or impair the commerce of the people, the very important and vital artlrnntl'va proposition that it shall give the earner h ■ tub legal compensation, as well as tout no rule shall he imposed upon him that will impede or impair his commer cial prosperity. Ihe tacts are that nil rates are so cu .-idy interrelated to other rates that it would Hot he possible for the interstate commerce commission to lay its hands on a single rate . r set of rates without upsetting and disturbing hundreds if other rates, it j- as impossible to limit •ho ratemaking power, either ot the commission or the carrier to the pre soiibi'd area of a single rate or set of rates, as it would he to con fine the influence of a pebble thrown into the water to a less number ot circles than the physical force of its displacement would produce. I t would seem a much more logical so lution of the situation to con due tha commission to what it can do, rather than impose upon it something that it cannot do. If the law empowers tha commission to condemn a rate, and Rives it ample machinery with which to compel the carrier to speedily and ef fectively adjust the rate to a basis that is just and reasonable, the means will ha provided for doing something which it is possible to do, instead of the attempt being made to do something which In its own very nature cannot bo done.
