Thc murder occurred at the house of the woman, in Newport News, in that 'part nf the ciiy known as "Rocketts," on June ?.', ?S99. O'Boylc is a white man; the dead woman was colored. Thf! woman, according to the testimony. was in a del.cate condition. She drinking. O'Boylo visited her tr.at day and they had an altercation; he kr.ocKfd her down, kickfd her and from the ef? fects of those injuries she died. It was brought out in the ?vidence that the man and the woman lived together as man and wife. A number of exceptions to the rulings of the trial court were noted, the prin- | cipal one being that the indictment was insufficient to warrant the vcrClct of mur? der in the first degree. The -*vppellatt Court held that the ?nuictment was in the usual common law form, and that the question thought to be raised bad been decided in the Cluverius and other cases. There were many objections ns to ad? mitting certain evidence, but the Supreme Court sustains thc lower tribunal in all points. In concluding ihe opinion.
