Because that I)art of Smith street lying between the east erly side of State street ami th· tracks of the Perth Amboy ami Rlizahethport Railroad Company, before t h * · time of the laying of the said wood pavement I had been paved with macadam pave- j ment, for which original improvement; my property was assessed and the as-1 sessment paid. 2. Because at tlie tfme of t h - laying of the new pavement for which this. assessment is attempted to ho made, ! the said macadam pavement was in j good order and condition, excepting in places where individuals had taken up the same to make sewer and other con·· ; neetlon*. and failed to replace the name in a proper manner, as in law they were bound tu do if thereunto required by the municipal authorities, or the Bald municipal authorities were in duty butund to (lo and charge the same to the property in front of which said street was left out of repair: and further, any other damage to said part of said street which could not readily have been re paired ftiy the said municipal authorities was caused by the laying of the public sewer therein or tile shifting and re placing of the tracks of the trolley rond, which further «lama**» the said municipal authorities were in fluty bound to compel the contractor and the street railway company respectively to repair. 3. Because it was the *luty of the municipal authorities of safd city after said part of said street had been paved with macadain pavement, lo keep the same in repair, and pay the cost and ex penses of the same out of the moneys raised by· general taxation tor the pur pose of caring for the public highways in said city, as was done on other parts of ealrt street.'' 4. Because, at the time of the laying of raid new pavement, for which this assessment It attempted to be made, the «aid macadam pavement with the usual repaire which could have beei. made by· the municipal authorities of the city of Perth Amboy, would have answered all purposes of ready access and approach to property on the lino of that part of said street where said new pavement was laid.
