Randolph Apple by of Spotswood against Vincent ι . Cefola and Michael Forari, of South River. According to the bill of complaint, the defendants had ί Mr. Appleby arcrsted on the charge of obtaining money under false pre te η ces frcm Michael Forari, the ar rest taking place on December 23, 1920. He was held for the grand jury, which body found no indict ment against him. Mr. Appleby alleges that the charges were false and made for the motives of malice and that there was no reasonable cause for the prosecution. The plaintiff also al leges that he is in the lumber, coal and wood business and that the prosecution has caused many per sons to cease trading with him. and has ruined his reputation. Peter !?<-tney is the attorney for the plain- 1 tiff and George Kemeny the attor ney for the defendant. ACTION FOR POSSESSION OF LAND AT SP0TSW00D J. Randolph Appleby of Spots- i I wood, has brought suit in the su preme court to recover $1,100 from Mike and Emile Forrai also of Spotswood for lands allege to be Appleby's and which they are occu pying and depriving: him the pos session thereof. In a counter claim, the defend ants, deny th£ facts as set forth by Appleby in his complaint and allege that they have paid the sum of $508.05 to Appleby on a contract dated June 29, 3 917, in which Ap pleby agreed to convey to defend ants property for the consideration of $1,1000 to be paid at the rate of $4 monthly. The defendants also j allege that when $550 was paid Appleby agreed to convey a war ranty deed and to accept a mortgage for the remaining amount. The defendants declare that through a flaw in the title, a deed could not *>e conveyed. They erect ed a building on the property in which to conduct a blacksmith shop.
