OBITUABY. Mrs. Elizabeth Filler, was born in Lou den county, Vs., April 7tk, 1797; she de parted this life Fab. ?2, 1880, making her age 82 years, 8 months and 22 days. The deceased was married to Mr. Henry Filler, December 23rd, 1818. In the spring of 1817 thsy came to Zaassville, Ohio; thence ia the fall of tbe same year to Somerset, which thenceforward bscams thsir settled boms. In the yeas 1835 Mrs. Filler was bereft of her husbsnd, leaving a family of mostly helpless children to her for cere and sup. port. To this trust she diligently and faith fully applied herself, and with tba bless ing of God succeeded well in guiding the household. She was s'n affectionate, tender mother, greatly endeared to her children. They were to her as those of the devoted Mother of historio fame, "Has Jswsla." II is pleasant tr know that this wealth of affection waa duly reciprocated by tbe children. Excellent social qualities with her business calling gave to her an exten ded circle of friends and acquaintances. Practicing upon the precept: "He that bath friends must show himself friendly.' She is embalmed in the memories and affectionate regard of this people. Her religions life was thorough and abiding. The house of hope being feuaded upon the Rock and not upon the ssnd. It withstood the storms and tempest of a long earthly pilgrimage. She relates that about tha age of fourteen in her parental home, under the miniatrs lions of the Gospel through Msthodis1 ministers she was deeply convinoed ef her loat condition as a sinner. - Under tbeae impressions shs commenced a life of prayer and watchfulness before God, but mads no open confession of Christ at the time. By the grace of God she hss sustained visible union with tha people from that period until (the time of ber transfsr from the church militant to the church triumph ant. Her attachment to all the ordinances of God were unwavering. She delighted to bear in bar long protracted Illness of the conversion of souls and tbe prospsrlty of God's cause. Being a great reader and careful observer, she had an intelligent comprehensive view of Christianity and sa credly cberishsd every indication of Its progress, fsrbaps we msy sum it all up by saying shs witnessed a good confession for llo these many years, psrhaps 60 or upwards before God and man. A BILL To authorize the construction of a Free turnpike in the county of Perry. Section. 1. Be it enacted by the General Assembly of the State of Ohio, That the Commissioners of Per ry county, Ohio, shall cause to be constructed a free turnpike road in said county, which shall extend from Thornport to the village of New Straitsville, and shall pass through the main street of the village of Thorn ville, Columbus street of the village of Somerset, Main street of the village of New Lexington, and through the village of Shawnee and New Straits ville; and so much of said free turn pike as lies within the corporate lim its of any of said villages shall be constructed by and at the expense of said villages respectively; and, outside the corporate limits of said villages, as above designated, said free turnpike shall be upon and follow public high ways commonly used between said vil lages, except that where expense may be saved by change, and the public convenience subserved, tne commis sioners may deviate from the public road at such point or points as, in their opinion, may be necessary or appropriate, and thereupon, to the ex tent of such change, the same shall be made part of the public highway. dec. Z. ihe said commissioners are entitled to receive and colleet sub. ecnptions of money, or of lands that may be used for part of the line of such 'free turnpike, which subscrip tion may be conditioned on tho loca tion of a specified line as part of the route, or a maionty of the owners ef real estate outside of said villages may in writing, petition said commissioners to locate a specified line as part ef said route and to be thereby taxed in a proportion of the cost of construc tion, to be fixed by said commission ers, in addition to other taxes, in which the commissioners, in addition to other taxes, in which case the leal estate not in any of said villages, and within one mile on each side of such specified line petitioned to be located, shall be specially taxed in their prop, er share for such proportion of cost thereof,, which taxes shall be levied, assessed, and collected as in other ca ses. Sec. 3. The said county commis sioners may, if they deem it best, is sue bonds for the construction of said free turnpike, but said bonds shall bear interest at no greater rate than six percent., payable semiannually, and shall not be sold at less than their par value, and tor the purpose of paying said bonds, or the cost of such construc tion by them incurred, the said.eom missioners shall levy and assess, annu ally, a tax on all property in said county not exceed two mills on the dollar, nor in any one year more than twenty per cent, on the cost aforesaid by them incurred. Seo: 4. The councils of said vil- ages are Hereby autnorizea to con struct so mnch of said free turnpike as may necessary, within the corporate limits of 6uch village, and leavy and assess taxes for the cost thereof on all the property of the village, as levied and assessed, and to be collected as in other cases of taxation in villages; and in case of failure of any of said villa ges to construct said part of sain turn pike, said commissioners shall cause it to be done, and certify the cost thereof to the county auditor, by whom it shall be changed to said corporation, and levied and assessed against the property in said village, and collected as in other cases; but this section shall not authorize the said commissioners to change the grade in any village. Sec, 5. As soon as practicable, af ter the passage of this act, the said commisssoners shall employ a compe tent engmeer.and a sumcent number ot assistants, who shall survey said route and such different lines as, in the opinion of the said commissioners may be appropriate tor parts ot said route may also be surveyed, and a detailed report thereof, with estimates, shall be made, in writing, and filed in the office of county auditor, and there re tained for public inspection. dec. b. ine grade ana construc tion of said turnpike shall be, as now providsd by law, for the construction ot said turnpike roads, except ma in the village of the immediate ap proaches thereto, tne erode may oe accommodated to meet the grade of tbe street therein. The construction shall be let by contract or contracts upon bids, in writing, after public notice in at least six different newspapers, of which four shall be in tne county tor at leas our consecutive weeks, and any con tractor shall give bond, with sufficient sureties, for the performance of his contract, and the commissioners may reject any or all bids, and no conti ac tor or employe shall be paid at any time, upon his labor or contract, be. yond the extent to which fulfilled. Sec. 8. It, upon tne letting of tne contracts, or before that it is found that the cost of such construction to be levied on the general tax duplicate of the county exceeds an aggregate of 14,000 per mile, then such construc tion shall not be undertaken, nor any contract for construction be entered into until the excess be provided for or secured otherwise than by levy of taics upon the general ta duplicate ot tne county. Sec. 9. JSo liabieities, upon con tract, shall be incurred or paid, nor any person employed by sa.d commis sioners, without nrst having a state ment, in writing, signed by the other party specifying the price and terms, which shall be forthwith hied and re' tained in the office of the county audi, tor, after receiving the endorsement and approval ot the said commission' ers. 8kc. 10.
