In all cases under this act in which the punishment, on the first conviction is thirty days imprisonment, for the second and every subsequent conviction - thirty days' additional imprisonment " shall be imposed ..And penalties or , forfeitures, the recovery of which is not otherwise provided for in this act or that to which it is additional, may be re covered bv complaint or indictment in any court proper to try the same. - If, any mayor, alderman, selectman or as-' sessor, shall endorse his approval of the suit upon any writ issued pursuant to the provisions of this act or that to which it is additional, -in which his city, town or plantation is interested, the de fendant, if he prevail in such suit, shall recover no costs. All bonds and re cognizances given by the appellants shall be to the State of Maine, except . as otherwise provided in this and said act. All the provisions of the fifth), seventh, ninth, tenth, sixteenth and seven teeth sections of the act to which this is additional, shall apply to this act In all cases of appeal from the judg ment of a judge of a municipal or police court or justice ot the peace, the appellant, if convicted by the iuryi shall be sentenced to pay and suffer the same fines, penalties and imprisonment which might be awarded against him by such judge or' justice, with addi tional costs. All complaints to be made under this act or that to which it is ad ditional, may be made by three persons residents in the county, who are com petent to be witnesses in civil suits. The word plantation in this and said act shall apply to and include plantations organized tor election purposes, as well as other plantations. All that part of the sixth section of tne act to which this is additional, which directs a different sentence in the case of a conviction be fore a jury, from that provided upon conviction before a municipal or police court or justice of the peace for the same offence. And also so much of said sixth section as provides that in cases of an appeal the appellant shall, before such appeal be allowed, recognize in the sum of one hundred dollars, with, two good and sufficient sureties, to prosecute his appeal, and to pay all costs, fines and penalties that may be awarded against him, is hereby re pealed; and if any person shall claim an appeal as specified in said section, the judge or justice 6hall grant his ap peal, and order him to recognize in the sum of one hundred dollars, with suf ficient sureties, for his appearance, and for prosecuting his appeal; and he shall also give a bond as therein provided. Sections eleven, twelve, thirteen, four teen and fifteen of the act to which this is additional, are hereby repealed, saving all suits pending, and all rights acquired under the same; and all acts and parts of acts inconsistent with this act are hereby repealed. THE EPIDEMIC AT NEW ORLEANS The True Delta of the 9th says: ,. On Sunday and yesterday there was much excitement throughout the city in relation to the shameless cxp sure of large numbers of uninterred bodies in liftiny of the cemeteries, particularly in the Lafayette cemetery, in the Fourth District, where some sixty-odd coffins were, it is 6aid, on Sunday afternoon, scattered indiscriminately in and around the graveyard, and undergoing a rapid decomposition. The laborers employed to dig the graves struck for higher wa ges, and subsequently refused to work for any price. The negroes of the chain- gang were next pressed into servioe, and they, when night approached, ceased their labors. At this stage of the af fair, Mr. Kursheedt, one of the most in defatigable members of the Board of Health, assisted by a few others, suc ceeded, by holding out the inducement of liberal pay, and furnishing the ne groes with such eatables and drinkables as they thought proper to call for, in getting them to resume work. The excitement caused by the state of affairs at the Lafayette cemetery was much increased by the report that in Potter's Field the old system of dig ging graves was abandoned as obsolete, and a number of horses an! plows were set to work to furrow the field; that the coffins were placed in the furrows (edge ways, we suppose,) and partially cov ered with the plow, as a farmer would a ridge of sweet potatoes! There was, no doubt, much exaggeration in these reports. The Delta, in its evening edition of the same day, says: Ali B cried. We learned last even ing that a sufficient number of men had been employed during the day to get all the bodies 'in all the cemeteries under ground. For several days previous bod ies had been accumulating at so rapid a rate, thatvgraves could not be furnished for them at nightfall, and until the next morning they remain by dozens in the graveyards, unburied tainting the air for rods around with pestilential odors. On Sunday evening the number of the unburied was greater than ever, though the chain-gang had been employed du ring the day in the digging of graves. Five dollars per hour were offered, but even at mat rate men couia not be em ployed, for the swollen dead were burst ing their coffin lids, and the stench was sickening in the extreme. It ls.oore over, a common complaint that the graves are not dug anything like the re quired depth, and that the thin, earthen eoverinz is not sufficient to prevent the escape of foul gases from the decom-, posing dead. ; Among the deaths' announced in the n f ... . Orleans papers are Miss Appohna Ludlum, the guitarist, and. Mrs. Sarah E. Fisher, late , of Lexington, Ky. Some of the most eminent physicians a were of opinion that many cases were malignant fever. The Bulletin says: We wish we could, truthfully, utter) words of promise and cheer. But we feel that we cannot. The weather con tinues anything but favorable, and there must be a permanent change before we can indulge in hope. And, even then. some of the most experienced say that the disease is bound to run its course. It may become less malignant, of which there is well founded hopes, but no large abatement in cases need be ex pected for some weeks. We confidently iook lor, however, a sensible decrease in the number of deaths. We are assured that the, disease is becoming decidedly more manageable; besides the people are fbegmmng to understand it better, which is a great desideratum I NOTHING IS LOST.
