Sec. 2. And be it further enacted, That the president shall forthwith nominate and, "by and with the advice and consent of the Senate, appoint a provisional council, conMsiingof nine persons, who shall have the same qualifications as are herein pre riliPd ftir the ofiicc of Governor, and who, before being confirmed by the Senate, shall on oath make, sign, and file with said Sec retary the satueKitluw wprerihed.for the Governor. Such councillors shall continue to hold their of lice, utile sooner removed by ' the President, by ami with the advice and consent of the Senate, -Until a Legislature shall lie duly elected ami qualified under the provisions of this act. Such provisional council shall,' with the Governor have nil legislative ower in sueh' State. 1'iit in no event shall llie Governor or any councillor enter upon the duties of their respective office until after confirmation by the Sen ate. A majority of such council shall be a quorum, and tfie aame shall continue in. permanent session with tower, however, to order snch adjournments qs may be deemed proper, Imt no adjournment for more than thirty days at one time. Sec. . And be it further enacted, That the Gsvernor shall forthwith take kscs sion ami eltarge of all archive and other property belonging to the State, and it shall be his duty to e that all laws of the State and of the United States shall be duly exe cuted within snch State. Until all officer shall Iteoouie elective by the people, a herein provided, the Governor shall nomi nate and, by ami with the advice and con sent of the provisional council, shall ap point ami commission all the officers now provided for by the existing government of said State, or which may hereafter be cre ate! by law. Such officers shall hold their offices, unless sooner removed by the Governor with the advice and consent of the provisional council, until successors shall be elected and qualified as herein provided. And all councillors, legislators, and other members and officers of the pro visional government hereby established, and also all the members of the constitu tional convention hereafter provided frfr, shall be selected from such as ran truthful ly take the (with aforesaid, preserilied by the act or 2d July, A.D., 18(52, and, before entering upon the duties of such office, shall lake ami subscribe such oath, which oath shall be filed with, and preserved by the thief Jnstice of the Slate. Sec. 4. And lie it further enacted, That unlet otherwise hereafter provided by Con gress, the persons duly qualified as electors according to the provisions of this act in the State of iAMiisiana, shall, upon the find Tuesday of June, A. D., 1867, proceed to elect a Governor, Lieutenant Governor, Senate ami House of Rfcpnweiitalivw, and all the other efliees herein provided to be Appointed ; which Senateaiidliouseof Rep resentatives shall be composed of the same number of members anil be elected from i lie as me districts as is provided under the piAsetit government of such SJtnle; and the Governor, Lieutenant Governor. Senators and Representative, and all the officers of -iu'Ii provisional government shall respec tively hold their offices for one year and until 1 1 ft-ir successors aredulvuualificd, unices such oflieers are sooner removed or superseded in pursuance of the other pro visions of this act. Said constitution shall provide that no lebt, demand or liability" contraetedror in curred in the name of the State or other wise, in support of the recent rebellion. shall be assumed or -paid, and that no pen sion, compensation, gift, or gratuity shall be bestowed upon or paid by the State to any person, by reason of anything done or suffered in support ot the rebellion; And such constitution shall provide that the aforesaid provisions shall be irreversible and inoapable of abrogation by amendment thereof. Such constitution shall be sub mitted for approval by the convention, at such time as it may fix, to the electors of the State, qualified to vote under the pro visions of tlnsact. lhc election to be held under the rules prescribed as aforesaid, by the Secretary of War, and if approved by at majority of such electors, it may bo pre sented to Gongrees fer the admission of the State to representation in Congress there under, upon sucl. terms as may be by them prescribed. hec. v. It shall be the duty of such commander, whenever the civil au thorities in such Stale shall be unable to or shall from any cause neglect, refuse, or omit to see thai all the laws are speedily enforced for the punishment or prevention of crimes or offenses against the' rights of any person whomsoever, to at once arrest and hold such offenders until the civil au thorities shrill caue such offenses to bedulv prosecuted. And it shall,.-moreover, be the duly of such commander to render such support to the civil authorities in the pre servation lf -order, and in 'the enforcement of the laws and rules regulating elections and also all oilier laws, both of the United Slates and of the State, as ,sjiall iusure the full, speedy and impartial enforcement of all such laws and of equal jiibtice, and this without regard to race or color. See. 10. And la it further enacted, That the militia of the Slate' shall consist of all the citizens of the Slate qualified as cleeters under this act, who shall be as soon as prac ticable duly organized and equipped, and during the exittence of the provisional government hereby created, snch militia shall act under the direction of the afore said military commander within the State. Sec. 11. And be it further enacted, That all laws passed by the provisional council or by the Legislature herein provided for shall, xis speedily a pesslble after their enactment, be duly certllfol and tnuM mitted to the Secretary of the Senate of the United States fortheapprovcl of Congress, and should the same be disapproved by Congress, the fact shall be, at once, duly certified and transmitted to the Chief Justice of Louisiana, and the date of the receipt thereof shall he indorsed thereon, and the same shall he filed and preserved in the record of the Ssupremc Court.
