In view of all the facta, presented in this rec- j ord, we are satisfied 'the defendants, in oh taining the possession of these notes, were guilty of a fraud, and were not thereby discharged of- their liability, iriil are re sponsible for the amount of tlie' notes thus fraudulently obtained, ,with the interest, thereon. The principles of this case fall within the rule settled by this Court of executed contracts. The notes having been thus improperly obtained, the adm'rx, Helen .Surer, ,Ts entitled to maintain the .action. The children of Charles Surer, the distributees of the estate, are not proper parties, and are not entitled to recover. Upon the death of 'the intestate, and tbe administration of Helen Surer, tbe right to the persoual estate vested in her to sue for it, and, at the period of time fixed by law, distribute it to the next of kin. A nil in prosecutinc suits for the recovery of the assets, the dis tributees are not proper parties. Whether she had the right to loan the funds for more than twe-jgarpfjttjis: unpccspary for uaHq, determine in this case, llut if loaned for a longer time, tlie defendants could not avail themselves of Ibat defence. She might be responsible to the distributees for a demtfarit, if the fund was lost. Upon a settlement of the estate, these notes could have been paid over by her to the guar dians of the minors. Other questions have been discussed in argument which it is un necessary to determine, as the questions settled are decisi v'e of the case.J The judg ment of the Circuit Court will be reversed. and, the parties having wai ved all excep tions to the proceedings, and desiring this Court to render such judgment as is author ized by law and the tacts of the case, we are of the opinion, therefore, that Helen Suri;r, as the Administratrix of Charles Surer, is entitled to recover of the defend ants the amount of the notes with the in terest thereon. A circumstance occurred yesterday in this city, which, we presume, may be. regarded -as a foreshadowing of what is to be expect ed tinder the operations of the recent legis- lation of Congress. The facts, as related to us, .are substatially as loilows: - Capt. Wm. D. Smith, an old citizen and prominent member of the Mobile fire de partment, commanding a company in the 24th Alabama regiment, was lulled at tlie battleot Murfreesboro, more than fouryears ago, and buried on the field. His remains were disinterred by his friends and brought to Mobile, and yesterday were buried by his brother firemen. Tbe procession was ex clusively under the direction of the fire department, and there was no military dis play or memorial connected with it. The funeral procession took the usual route to tbe ceraetrary, which passes by the military camp on Government street. As tha cortege was passing, it was baited by an officer, whose name and rank we have not learned, but who is supposed to be the com mandant of the troops now stationed in-Mobile. Thisofficerinqiuredwhoseremains were being carried by. Chief Engineer Lyons, of the fire department, answered that thev were not those of " Mr. 8mith, a prominent lireman. l no otticer asked it Jie was only a fireman. Mr. Lyons answered "in the af firmative, when the officer directed tho pro cession to pass on. The chief engineer, however, immediately correcting himself, said to the officer that be did 'not wish to deceive him in any respect, and that the deceased bad been a Confederate soldier. Upon this tbe officer declared that thepro- ceasion must not pass. " Very well," said the chief engineer, in a respectful manner, " I will turn back and, take another street." According to our information, tbe officer still exhibited some hesitation about en forcing bis order, and asked when tbe de ceased had died. The answer, wxs that lie was killed in battle several years ago. The officer then very promptly and decidedly declared that, if that were the case, the body could not pass.
