The fact that tbe term of tbe Alaskan judge is limit? ed to four years aud that he does not hold office for life or during good liehavior, the Court says, prove? that it is not a court of the United State? as the term l- constitu? tionally used. The Court said the decision in the present ease gives the President complete power over territorial officers. Judgment is therefore given in favor of the United Sta!.-. Justice Fields and Justices Cray and Brown dissented in an opinion in which Justice Field? maintained that the mere will of the President was not sufficient to remove a judge of a court created by the I'mted Stute? and that the Constitution did not contemplate that a judge should be responsible to any man for hi? continu? ance in office. It seemed to him that some of bis brethren overlooked the character of the judicial branch of the Government when they made a distinction against the courts of Territories. These courts had similar powers and there was the same necessity that they should u*e their office fearlessly and without fear of offend? ing any President lest they should be re? moved. The case of Wingard, Justice of the Washington Territory court, was decided the same way. The Supreme Court to-day upheld the constitutionality of the original package law passed by Congress, and also held that it was not necessary for tho state of Kansas to re-enact its prohibitory law after the passage of the congressional act in order to shut out liquor in original packages.
