Upon the Subject of "Railroading" a Franchise
Charges are made In yesterday's editions of "The Ttmes-Dlspatch" and "Journal" that an effort la
being made by this Company to "railroad" its franchise through the Council.
WHAT ARE THE FACTS?
This franchise has been before tho Council for eight months. U has been considered at length by.
a Subcommittee of the Committee on Streets, and a draft of an ordinance mad-> by the City Attorney, In
accoiuance with the Subcommittee's Instructions, presented to the full Committee.
The Committee on Streets again went into the matter, hearing argument of counsel and the state?
ment of an expert |n opposition.
That Committee then, by ? vote of 12 to Z, expressed Its satisfaction with the ordinance as drawn.
Mueh is made of the City Attorney's opinion that the ordinance would mean litigation, /
WHY NOT HE FAIR?
Th.- City Attorney's objection was chiefly to subsection 2 of section 8. This was removed by the
adoption by the Committee of a substitute therefor, prepared by the City Attorney, without, objection upon
the part of this Company.
That official's ?plnlon wns that a "blanket" franchise, such as the ono In question, is valid and that
its provisions can be enforced.
The "Journal'' says "Amendments and substitutes have been suggested by the City Attorney and
others. These are yet to be passed upon." ,
WHY NOT RE ACCURATE?
Not a single amendment has been suggested by any one that has not been carefully considered by
the Committee, and every one suggested by the City Mtorney naa ndopted.
It Is charged that this Company Is trying to secure the final passage of this ordinance bofore-Sep
tember 1st. This Is true.
It Is also charce.i that the Councilmen who signed the call for a special meeting are actuated
by a desire to "railroad" the matter through before going out of office. ThlB Is unjust and unwarranted.
These gentlemen signed the call, at our request, without regard to their attitude towards the fron
ehlse.
Eight of the twelve members of the Committee on Streets, who voted -for the franchise, wflTJJ?

If this franchise Is to be acted upon, it is necessary that there should be no further delsry.
The Constitution provides that, after this ordinance shall have been passed by each brsmeh oitthe
Council and signed by the Mayor, it shall lie advertised for four weeks. Then it comes back to ?'the
Common Council, Is referred to a committee, voted upon again by each branch of the CounolL and again
signed by tho Mayor. Unless all of this shall have been comploted by September let, the frar.-hlse will
he dead?a year's work ?wasted, and a now light begun before the new Council.

WHY SHOULD THEME BE FURTHER DEEAT? ~V ,
The franchise has been before the Committee on Streets for eight months. r 1
It has been amended at the suggestion of the City Attorney. 1
It iias been recommended by an overwhelming majority of the Commltteo.
It has been given publicity by "Service Talks," by experts and by newspaper editorials.
It Is printed, and a copy Is in the hands of every Councilman.
Twenty-two hundred business firms of the city and representatives of 1,000 working men-have.-as kad
for Its passage.

The "Journal'' says that this Company has wanted to sell out to Its rival and "that tho oldr Company,
refused to pay the price demanded." This Is unqualifiedly fnlae.
This denial has been made upon every occasion, nnd In the presonoe of officials of the Virginia Rail?
way and Power Company, In the hearing before the Committee on Streets. Furthermore, wo have stated
In the same presence that at least two offers were mad.- to buy by the pe-rtle? at the respective times In
control of the obi lines, and that each lime the, offer was refused, without any counter proposition being
made. AMI THESE STATEMENTS HAVE NEVER BEEN CHALLENGED. ,
IS IT HONEST. THEN, TO REPEAT SUCH BASE AND BASEERKS RUMORS?
Read the following section of the proposed ordmanco and see If anything bo needed to protect the
City's Interest. Subsection 2 was prepared by the City Attorney and nccepted by us without protest.
'I hen consider that the Virginia Railway and Power Company is under no obligation to sell electric eur
rerit to any one t :i a greater extent than 2.000 K. W. It can dictate Its own terms, and requires you, if you
wish light, to build Its line for It, if you happen to live a few feet away.
EXTRACT FROM PROPOSED FRANCHISE.
S. The privileges hereby granted are also given subject to the following conditions:
1. That the said .the grantee herein, will, within two months from the final
approval of this ordinance, file with the Committee on Streets an application for tho route that It desires
to cover with its distribution plant, which route tue Committee on Streets may alter, enlarge or diminish
as it shall see (it. The distribution system within such route shall be begun within three months, and com?
pleted within twelve months, after final nction by the Committee on Streets.
2. The grantee hereof expressly assumes the duty and burden of selling electrio current for any
purpose to even" Inhabitant of the City of Richmond applying for tho same, and in consideration ,of the
consent hereby given tc the use and occupancy of all of the streets and alleys of tho City of Richmond
for that purpose, and as a condition thereof, expressly contracts and agroos that the Council of the City;
of Richmond shall have power at any time, and from time to time, to prescribe routes covering any por?
tion of the territory of the said city, and extending through any of the said streets and alleys, and to
require the said grantee to construct tho necessary distribution system and erect the
necessary poles, wires, conduits and other fixtures. and to sell and deliver electrio
current to any person within said territory applying therefor. notwithstanding It may
be true that a compliance with such requirement may not be profitable and will result In a pecuniary loss
ta the said grantee. It being the intention of this provision to clothe the said Council with absolute power
to require the said grantee to sell and deliver electric, current In any and all sections of the City of
Richmond, and the construction of the distribution system necessary therefore, whenever and to whatf
ever extent the -said Council shall deem reasonable and necessary, and notwithstanding the territory so
ordered to be covered and the distribution system so required to be constructed may bn unremuneratlve
and result In pecuniary loss to the said grantee. The said grantee shall begin construotlon of any such dis?
tribution system within three (3) months and complete the same within six months from the date of
any such requirement, and shall sell and deliver electric current to any person applying therefor within
the territory so ordered to hP served by the said grantee at rates which shall not exceed a greater
sum than 1" cents per thousand watt hours, except that there may be a net minimum monthly charge
of one dollar. I
For any failure or refusal lo comply with the terms of this provision, or with any requirement made
thereunder, tile said grantee shall. Ipso facto, forle't nil rights and privileges to use and ocoupy any street
or alley within the said city, under the provisions of this ordinance, and said rights and privileges shall
thereupon cease and determine as if by limitation, without further action on the part of the City of Rich?
mond.
n. That the said . shall, within twelve (12) months from the final approval of
this ordinance, have Installed machinery for the generation of electric current for commercial light and
power purposes, exclusive of street railway requirements, of at least 5,000 K. W. rated capacity.
