Note Sent to Imperial German Government Firm Against Submarine War---Demands Safety | of American Ocean Travelers. Washington, May 14.—The text of the note from the United States to the German imperial government transmitted today to Ambassador Gerard at Berlin, and to be presented tomorrow morning to the German for eign office, reads as follows: “The secretary of state to- the American ambassador at Berlin: ‘“Department of state, Washington, May 13, 1915. “Please call on the minister of for e»ign affairs and after reading to him this communication leave with him & copy. Note. “In view of recent acts of the Ger man authorities in violation of Amer fcan rights on the high seas which culminated in the torpedoeing and sinking of the British steamship Lusitania on May 7, 1915, by which over 100 American citizens lost their lves, it is clearly wise and desirable that the government of the United States and the imperial German gov ernment should come to a clear un derstanding as to the grave situation which has resulted. Cites Three Attacks. “The sinking of the British passen ger steamship Falaba by a German submarine on March 28, through which Leon C. Thrasher, an Ameri can citizen was drowned; the attack on April 28 on the American vessel Cushing by a German aeroplane; the torpedoeing on May 1 of the Ameri can vessel Gulflight by -a German submarine, as the result of which two or more American citizens met their death, and finally the torpedoeing and sinking of the steamship Lusi tania, constitute a series of events which the government of the United States has observed with growing concern, distress and amazement. Contrary to War Rule. “Recalling the humane and en lightened attitude hitherto assumed by the imperial German government in matters of international right, and particularly with regard to the free dom of the seas; having learned to recognize the German views and the German influence in the field of in ternational obligation as always en gaged upon the side of justice and humanity, and having understood the instructions of the imperial German government to its naval commanders to be upon the same plane of hu mane action, prescribed by the naval codes of other nations. the govern ment of the United States was loath to believe it—it cannot now bring it self to believe—that these acfs, so absolutely contrary to the rules, the practice and the spirit of modern to address the imperial German gov ernment concerning them with the utmost frankness and in the earnest hope that it is not mistaken in ex pecting acv}ion on the part of the im perial German government which will correct the unfortunate impres sions which have been created and vindicate once more the position of that government with regard to the sacred freedom of the seas. “The government of the United States has been apprised that the im perial German government consider ed themselves to be obliged by the extraordinary circumstances of thre present war and the measures adopt ed by their adversaries in seeking to cut Germany off from all commerce, to adopt methods of retaliation which go much beyond the ordinary meth ods of warfare at sea, in the proclam ation of a war zone, from which they have warned neutral ships to keep away. Strikes at War Zone. “This’ government has already taken occasion to inform the imperial German government that it cannot admit the adoption of such measures or such a warning of danger to op erate as in any degree an abrevia tion of the rights of American ship masters or of American citizens bound on lawful errands as passen gers on merchant ships of belligerent nationalities; and that it must hold the imperial German government to a strict accountability for any in fringement of those rights, intention al or unintentional. “It does not understand the im perial German government to ques tion those rights. It assumes, on the contrary, that the imperial German government accepts, as of course, the rule that the lives of non-combatants, whether they be of neutral citizen ship or citizens of one of the nations at war cannot lawfully or rightfully Mental Overwork. , In mental overwork the brain cells, being in constant use, are apt to re main alive after work has been aban doned. Basis of Objection. “The government of the United States, therefore, desires to call the attention of the imperial German government, with the utmost earnest ‘ness, to the fact that the objection to }their present method of attack ‘;a-galnst the trade of their enemies ‘les in the practical impossibility of 1 employing submarines in the destruc ‘tion of commerce without disregard 'ing these rules of fairness, reason, ‘justice and humanity which all mod ern opinion regards as imperative. “It is practically impossible for the officers of a submarine to visit a mer chantman at sea and examine her pa pers and cargo. It is practically im possible for them to make a prize of ‘her; and, if they cannot put a prize crew on board of her, they cannot sink her without leaving her crew and ail on board of her to the mercy of the sea in her small boats. These facts, it is understood, the imperial German government frankly admit. Warning Not Given. ‘““We are informed that in the in stances of which we have spoken time enough for even that poor meas ure of safety was not given and in at least two of the cases cited not so much as a warning was received. Manifestly submarines cannot be us ed against merchantmen, as the last few weeks have shown, without an inevitable violation of many sacred principles of justice and humanity. ‘““American citizens act within their indisputable rights in taking their ships and in traveling wherever their legitimate business calls them upon the high seas, and exercise those rights in what should be the well jus tified confidence that their lives will not be endangered by acts done in clear violation of universally ac knowledged international obligations and certainly in the confidence that their own government will sustain them in the exercise of their rights. Criticizes Embassy Act. ‘“There was recently published in the newspapers of the United States, I regret to inform the imperial Ger man government, a formal warning, purporting to come from the imperial German embassy at Washington, ad dressed to the people of the United States and stating, in effect, that any citizen of the United States who ex ercised his right to travel upon the seas would do so at his peril if his journey should take him within the zone of waters within which the im perial German navy was using sub marines against the commerce of Great Britain and France, notwith standing the respectful but very ear nest protest of his government, the government of the United States. “I do not refer to this for the pur pose of calling the attention of the imperial German government at thi3l time to the surprising irregularity of a communication from the imperiall German embassy at Washington ad dressed to the people of the United States through the newspapers, but only for the purpose of pointing out that ro warning that an unlawful and inhuman act will be committed can possibly be accepted as an excuse or palliation for that act, or as an abatement of the responsibility for its commission. - - “Long acguainted as this govern ment has been with the character of the imperial German government and with the high principles of equity by which they have in the past been actu ated and guided, the government of the United States cannot believe that the commanders of the vessels which committed these acts of lawlessness did so except under a misapprehension of the orders issued by the imperial German naval authorities. It takes it for granted that, at least within the practical possibilities of every such case, the commanders even of sub marines were expected to do nothing that would involve the lives of non combatants or the safety of neutral ships, even at the cost of failing of their object of capture or destruction. Asks for Disavowal. “It confidently expects, therefore, that the imperial German government will disavow the acts of which the Man’s Peculiarity. ; Man, as has been remarked several times before, is a Peculiar Cuss. Wants Prompt Action. “The government and people of the United States look to the imperial Ger man government for just, prompt and enlightened action in this vital matter with the greater confidence because the United States and Germany are bound together not only by special ties of friendship but also by the explicit stipulations of the treaty of 1828 be tween the United States and the king dom of Prussia. “Expressions of regret and offers of reparation in case of the destruction of neutral ships sunk by mistake, while they may satisfy international obligations, if no loss of life resuilts, cannot justify or excuse a practice, the natural and necessary effect of which is to subject nations and neutral per sons to new and immeasurable risks. “The imperial German government will not expect the government of the United States to omit any word or any necessary to the performance of its sacred duty of maintaining the rights of the United States and its citizens and of safeguarding their free exercise and enjoyment. “BRYAN.” 101. 5. NOTE 500 N Message Now Being Studied by High Officials. ’ IS REGARDED AS FRIENDLY ' Believed Berlin Government Will Re ~ fuse to Abandon Submarine War fare Unless Britain Abandons Policy of Starving Teutons. Washington, May 18.-——Ambassador Gerard in his cablegram regarding the delivery of the American note to Berlin made no comment on whether it was well received, reporting merely that Von Jagow, the German foreign minis ter, had said the guestion would have to be submitted to a council of higher officials before an answer would be re turned. As the note had not been pub lished in Germany the ambassador was unable to report on the state of public opinion. By FREDERICK WERNER. International News Service Correspondent. Berlin (via Amsterdam), May 18.— President Wilson’s note is being care fully studied by the German govern ment. It is regarded as a friendly message and will be answered in a friendly spirit. - May Open Way to Peace. The general impression, however, is that Germany will refuse to abandon her submarine warfare unless Great Britain abandons the policy which aims at starving Germany’s civilian population. This may open the way to further negotiations with the Unit ed States as intermediary between Germany and England. ’ It is expected that the reply to the American note will be sent Wednesday or Thursday of this week. A prelimi nary draft prebably will be submitted to a council on Tuesday. To Bar Arbitration. Washington, May 18. Official Washington believes the German gov ernment will offer to submit the ques tions at issue between the countries to arbitration, but the impression is .growing stronger that such a proposal will not meet the approval of Presi dent Wilson and his advisers. The belief i general among officials and diplomats that Germany will not agree to cease her submarine warfare against noncombatants and will urge that a country “too proud to fight” should find a way to prevent the fur nishing of arms and ammunition to her enemies by means of passenger ships. The practice, Germany is ex pected to declare, is unmoral and should be stopped at once. U. 8. to Oppose Arbitration. The belief that a suggestion of ar bitration will be opposed by this gov ernment is based on the attitude taken by President Wilson in the discussion of the sinking by the German raider Prinz Eitel Friedrich of the Ameri can sailing ship Willlam P. Frye. Then it was stated that this ques tion was not one for prize courts, as suggested by Germany, but for diplo matic consideration. Miller Heads School Board. Manitowoc.—Frank A. It is illegal to have an army ‘of your own, but the law winks at private armies in one or two cases.
