The board met in regular session pursuant to law with the following members present, Barnes, Brown, Davis, J.andblom and Chairman Newton. The minutes of the preceding meet ing were red and on motion the same were approved there being no correc tions. The motion prevailed, all voting aye upon the call of the roll. Percy praying for the abatement of all penalty and interest in excess of 7 per cent on drain tax for the year 1901 against S. W. Y\ of sec. 21-141-50 and after due consideration the same was granted upon motion. All mem bers voting aye upon call of the roll. The request of the N. P. R'y ,Ca that the board of Co. commissioners enter into contract and accept easement from said railway Co. for certain prop erty of the railway Co. now used as public roads, was referred to the states attorney for his opinion as to the rights of the board of commissioners in the matter and he reported that the board was ont the proper parties to enter into such contract, they not hav ing control or supervision of the high ways under the law. Upon motion the county auditor was instructed to return the contract to the railway com pany with the aclvice that they did not consider that they had sufficient juris diction in the matter. On motion duly seconded the board adjourned to meet at two o'clock P. M. All voting aye. AFTERNOON SESSION. Board met at two o'clock pursuant to adjournment with all members present. The board spent the afternoon in specting plans and specifications fpr new furniture for the new addition to the court house and also in receiving bids and inspecting samples of .hard ware trimmings for the said addition. Resolved, That the county auditor be, and is hereby directed to give no tice of the sale of real property for de linquent taxes remaining delinquent in the year 1903 for the preceding year by publishing a notice of such sale, pre pared in the forni and manner as pro vided in Section 1259 of the Revised Code of 1899, such sale to be held on the first Tuesday in December, 1903, and to continue from day to day until com pleted, said notice to be published three times once in each week for three suc cessive weeks, in The Morning Call and Fargo Daily Argus, one publication to be made in tue daily edition of said paper and the two following publica tions to be made in the weekly edition of the same paper, said paper being one of general circulation in Cass County N. Dak., having a daily and weekly edition, both published at Fargo in said County and State. The first publica tion to be made at least nineteen days before the day of sale and ea^i publi cation to be made on the same day of the week. The question being Upon the adoption of the resolution the roll was called and there were ayes five and nays none and so the resolution was declared adop ted. Barnes presented and read the following resolution and moved its adoption, seconded by Com. J. G. Brown. RESOLUTION. Whereas, It appears to the county commissioners ot Cass county, North Dakota, that it is necessary to make a special assessment upon the lands sub ject to assessment for the construction of Argusville Drain No. I3 Smith Drain No. 10 and Reed Drain No. 9 for the purpose of paying the amount of annual interest falling due November 1st, 1904, on the bonds issued for the tost of said drains now therefore, be it Resolved, That a special tax or assess ment in aggregate sum of two thousand eight hundred sixty-nine and 79-100 ($2,869.79) dollars, be and the same is hereby levied upon all lands subject to assessment for Argusville Drain No. 13 for the purpose of paying .the interest due November 1st, 1904 on the said bonds issued for the cost of said drain and it is further resolved that a special, tax or assessment in the aggregate sum of five hundred eighty and 20-100 ($580.20) dollars, be and the same is hereby levied upon all the lands sub ject to assessment for the Smith Drain No. 10 for the purpose of paying the interest due November 1st, 1904 on the bonds issued for the cost of said drain and it is further resolved that a special tax or assessment in the aggregate sum ,of one hundred thirty-six and 56-100 ($136.56) dollars be and the same is hereby levied upon all of the lands sub ject to assessment for the Reed Drain. No. 9 for the purpose of paying the in terest due November 1st, 1904, on the bonds issued for the cost of said drain, and it is further resolved that the au ditor of Cass County be and he is here by authorized and directed to apportion each of said respective levies according to the proportion to be borne by each tract as appears by the records from the Drainage Board.. The roll was called upon the adoption of the above resolution, and there were ayes four(4) and nays one(one) and so the resolution was declared adopted.
