A delegation from the Cass County Bar Association appeared before the board with recommendations and sug gestions relative to the accommodations in the proposed new court house for the courts, attorneys and library for court purposes. Holte as regis ter of deeds for the rhotrth of Novem ber showing fees collected of $679.90 was received and read and on motion ordered filed. All voting aye. Tax petition from the St. Anthony & Dakota Elevator Co. was received re questing that they be allowed to pay the original amount of tax assessed against the St Anthony & Dakota Lum ber Co. in the village of Page for the year 1902, for the reason that there was an error of the assessor i'n assessing the same to the Lumber Co., there be ing no company in existence, and for the reason of this error they had not re ceived any notice of this tax. Upon motion- duly seconded th pe tition was granted and the auditor in structed to notify the. sheriff of such abatement. All voting aye. The Chairman of the public property com. reported that Mf. C. H. Porritt who had been awarded the contract for installing the heating plant* in the coun ty jail building at a previous meeting of the board, had been repeatedly noti fied that the plant was not working sat isfactorily and npt according to con tract and further in view of the fact that an expenditure of $364.25 had been nec essary to satisfactorily complete the heating of the jail building, he would move that the auditor be instructed to present a bill to Mr. Porritt in the amount of $164.25, being the amount paid for thtf completion of the heating plant according to the contract of Mr. Porritt, which he had failed to complete, and iH[ "excess of the amount due him on the above named contract namely $200, 00. Board met pursuant to adjournment with all members present, and spent the day in consulting with the various officers as to their needs in. the way of furniture for transacting business in their respective offices, also confer ring with the state's attorney relative to the procedure necessary for calling a special election for the purpose of de tefmining the wishes of the voters of the county in regard to the matter of bonding the county for funds to re build the court house. The board adjourned to meet at 9 o'clock a. m. on Thursday, Dec. 10th. THURSDAY*,.DEC.. IO. 1903 Board met a 9 o'clock pursuant to adjournment with all members present. The following resolution was present ed and read by Com. O. G. Barnes who moved jtt& Stfoption, seconded bjr Com Davis. v RESOLUTION. Whereas on the seventeenth day *f November, A. D.. 1903, the court hpuse and additions thereto, were toally de stroyed by fire, and whereas at tlie time of said fire an addition was in he course of construction and nearly com pleted, and whereas at this time, it is deemed wise and expedient by the board of county commissioners, to mod ify and change the plans, drawings and specifications, and. to' complete said addition in accordance with such change, plans, drawings and specifica tions. Therefore, Be it resolved that the architect is hereby directed to prepare a written order to the contractors. Powers & Johnson, requiring them to complete said building in accordance with such amended plans, drawings and specifications, and that upon the prepara tion of such amended plans, draw ings and specifications, the amount necessary to complete said building be determined and agreed upon by and be tween the commissioners and contrac tors. The question being upon the adoption of the above resolution, the roll was call, ed and there were ayes five (5) and nays none (o) and so the resolution was de clared adopted. Those present and voting in' the affirmative were Corns. Barnes, Brown, Davis, Landblom and Newton. The following resolution was present ed and read by Com. Barnes who mov ed its adoption seconded by Com. Brown. ^1- RESOLUTION.,. '"Whereas, "On the sevent^lftln ^ay of November, A. D., 1903, the court house and additions thereto, were totally de stroyed by fire, and Whereas, At the time of said fire an addition was in the course of con struction and nearly completed, and, Whereas, At this time it is deemed wise and expedient by the board of county commissioners, to modify and change the plans, drawings and speci fications, and to complete 'said addition in accordance with such change, plans, drawings and specifications, now, there fore, Resolved, That the architect is hereby directed to prepare a written order to the contractors for the plumbing and heating, Fargo Plumbing & Heating Co., requiring them to complete said building in accordance with such amended plans drawings and specifications, and that upon the preparation of such amend ed plans, drawings and specifications the amount necessary to complete said buildings be determined and agreed up on by and between the commissioners land contractors. B» ..JffP ^HK Whereas, Said county has insufficient buildings for its use for-..a court house and county officers, and, •Whereas, In the judgment of the board of county commissioners of said county and state, there is immediate and pressing necessity to provide an ade quate building to accommodate the courts and other officers of said coun ty, now, therefore, Resolved, That an election be order ed, and the county auditor is hereby or dered and directed to order an election and publish notice of the same, as pro vided by law, for the purpose of deter mining by a vote of the electors of said county, the question of issuing its bonds, for the purpoose of the erection of a court house, in the sum of two hundred thousand doljars, ($200,000.) One hun dred thousand dollars ($100,000) of said bonds being in the denomination of five hundred dollars each ($500.00,) and one hundred thousand dollars ($100,000) of said bonds being in the denomination of one thousand dollars each ($1,000) each running for a period of twenty (20) years and drawing interest at the rate of not to exceed four (4) per cent. The question being upon the adoption of the above resolution the roll was call ed and there were ayes five (5) and nays none (o) and so the resolution was declared adopted. The board met at 2 o'clock pursuant to adjournment with all the. members present. Bill of Pontiac township for $255.88 for rebuilding bridge in said township was 011 motion allowed at $205.88 and the auditor was instructed to draw war rant in payment of the same. All vot ing aye upon the call of the roll. Petition of J. O. Molsterteigen Was re ceived asking that a personal tax against him 011 the tax list of 1903 in the city of Fargo, be cancelled for the reason that the property assessed was also assessed as real estate, and the recommendation of the city council be ing in favor of granting the same it was moved and seconded that the peti tion be granted and the treasurer noti fied to cancel the same. All voting aye. Petition for refund from 14 L. Loom is for amount of money paid on certifi cate of tax sale on house and lot in the S. E\ of sec. 10, township 138-53, for the reason that said certificate w as issued erroneously was received and 011 motion same was granted and the au ditor and treasurer instructed to make the proper charge back. Board consulted with Architect Han cock and the contractors Johnson & Powers relative to the completion of the addition to the court house under contract with them. It was moved by Com. Brown and seconded by Com. Barnes that the au ditor be instructed to advertise fpr bids for supplying the county, with furniture for furnishing the offices of the coun ty officers according to list of cuts and specifications now on file with the coun ty auditor. Motion prevailed upon the call of the roll, all members voting aye. Bond of Fargo Washburn Co/ was presented for the approval of the board, said bond being in the sum of $500.00 with Alex Stern and Wm. J. Price as sureties, and was attached to their contract 4or furnishing the County with lignite coal for the ensuing year. On motion the sureties were approved and the chairman authorized to sign the con. tract with them. All voting aye. On motion of Com. Brown the audi tor was instructed to issue a duplicate of county warrant No. 797 in the sum of $4.00 to Fred W. Bailey the original having been lost and the county having been indemnified against loss.
