MRS, TUTTLE LOST IN DIVORCE CASE SUPREME COURT HANDS DOWN DECISION DISMISSING AP PEAL FOR TRIAL. Syllabus and Decision of Court Is Giv en Full Mrs. Tuttle Made Mis take in Accepting Money. The supreme court yesterday dis missed the appeal iu the divorce case of William P. Tuttle against Louise Tuttle. The case was originally tried before Judge Winchester of the dis trict court and the divorce was grant ed, the sum of $300 a month alimony and $1,250 counsel and suit fees be ing allowed to Mrs. Tuttle. The counsel and suit fees were ac cepted by the defendant, and a mo tion wag made to dismiss the appeal on the ground that the defendant had accepted benents under the de cree and therefore could not appeal. This motion was granted by the su preme court. Col. Tuttle Is a resident of Dawson and formerly lived in Chicago, where he was a board of trade operator and wealthy. His wife is a resident of Chicago. Col. Tuttle took up his residence at Dawson several years ago. He was a candidate for the legislature at the election in 1908 and at a special elec tion to decide a tie vote he was granted the certificate of election.
