Shoe Department MRISt1 IMC SET Action Will Be Tried on its Merits Before Judge Nuessle of the District Court TO DECIDE IP INJUNCTION BE MADE PERMANENT Temporary Restraint Asked By Second District Residents Refused Last Month The question whether there .shall be a permanent injunction granted to re strain the city commissioners from carrying out their paving program in the Second district wll be determined at the hearing which has been fixed for Friday morning at 10 o'clock in the chambers of Judge Nuessle when the case will be tried on its merits. A hearing for a preliminary injunc tion was held in September but the ap plcation was dismissed by the court. Since then it has been stated that the property owners of the district con cerned have amended to a certain ten or their grievances, which now allege that the specifications were indefinite, that the contract entered into by the city commissioners was invalid be cause it delegated power to the city engineer and further because of irreg ularities in the commisison's proceed ings. The commission will be represented at the hearing by City Attorney Me Curdy, who will be assisted by Attor neys Miller and Young. The plaintiffs' attorneys will be F. H. Register, R. M.
