FARGO, X. D., Nov. 11.—The first
of the group of pre-election criminal
actions and ^ivil procedures brought
by Nonpartisan league officials and
leaders, 'both in official and private
life, went by the boards Saturday
when Judge A. T. Cole or tne Cass
county district eourt, presiding as
magistrate in the cases of Dan Mc
Laren and L." M. Thorsell, .charged
with violating the corrupt practices
act in the last "primary election, dis
missed the charge.
Attorney General William Langer
was in Fargo, but failed to appear at
the court house to prosecute the crim
inal charges that had been filed about
six or seven weeks before the elec
tion by F. A. Brons^n, assistant attor
ney general, who at that time was a
candidate for justice or the supreme
court.
Mr. McLaren was placed on the
witness stand, and testified to events
that occurred on election day. Fol
lowing his evidence, the state having
failed to aoppear, Attorney Barnett,
representing, Mr. McLaren and Mr.
Thorsell, moved for the dismissal of
the charges, which motion was imme
diately granted.
Stanley Abbott, an assistant in the
office of the state commissioner of
agriculture and labor, made the- com
plaint on which the errests were
made. The complaint was filed, Mr.
Langer recently announced, the day
following the primary election. It
wasn't till six or eeven weeks be
fore the general election, however, be
fore any action waws taken by him.
