Italia of Atoka, we havo boon fur nished tho following correct ropy of the decree of tho citUenshlp court which sat at South McAlestor at tho December term in which tho Choctaw and Chickasaw nations, or tribes of Indians, wero plaintiffs, and J. T. U Idle, D. 8. Riddle. 1,. A. IUddlc, Kl.'zabeth Cawsy, Joshua Casoy, An drew IJ. HID, L. T. Hill. Jamos W. Bal throp, T. D. Arnold and John II. Ilratchcr were tho defendants. Decem ber 13, 1902. Tho Choctaw and Chickasaw nations, plaintiffs, vs. J. T. Kiddle ct al.. de fendants. This day this cause came on to bo heard, and hat to been fully argued rjy counsol, was submitted to the court on the pleadings, exhibits and testi mony. Upon consideration whereof, tbo court finds that due and leftal nc tlco of tho pendency and prayer of this suit has been given to the defend ants herein In conformity to law. That said defendants appeared at tho hearing hereof In person and tiy counsel and that each and all of said defendants who desired to bo heard wero heard. That notice to each of the said The Choctaw and Chickasaw nations or tribes In each and erery of the np plications for admission or enrollment as citizens in either of said nations of tribes In the procecdngs heretofore had" for that purpose beforo tho com mission to tho Ave civilized trlbca un dcr the act of congress approved Juno 10, 1896, was Indispensable and that like notlco to each of said nations or tribes in tho proceedings on appeal from tho decisions of said commission . and which wero heard In tho United States district courts within and for tho Central and Southern districts of tlio Indian Territory was likewise In dispensable. And tho court further finds on the Issues Joined that such notlco was not given to both of said nntlons or tribes In said proceedings boforo snltl com' mission or In said courts on sold ap peal. And tho court further finds that on tho hcnrlng of said causes In said United Stntos district courts and each of them, proceeded to hear nnd deter tnlno said causes do novo and In said hearings did not conflno tho Bamo to a rovlew of tho proceedings heretofore had In said causes before said com mission. That by rcnaon of each nnd both of said facts to wlt, that said hearings beforo said commission and in said United atntcs district courts woro without notlco given to both or said nallonB or tribes nnd by reason of tho trial of Bnld causes 1n snld United States district courts do novo, all of said fludlngs, orders, Judgments and decrees of tho said commission nnd said courts admitting any and all such persons to citizenship or enrollment In snld nations or tribes or cither of them ought to bo set nslde. annulled nnd hold for naught. It is therefore ordered, adjudged and decreed that each and every of such Judgments, orders nnd decrees so ren dered and ontcred as aforesaid, by wiia commission without notice to both of said nations or tribes or uoon hearing In said United Staos district courts and either of them upon trials uo novo aro sot asido, annulled and held for naught.
