The attention of tho treasury officials Is again call ed to the bank guaranty question In the southwest as affecting .not only the existing law In the state of Okla homa, but the problem pending before the legislature of Kansas Intended to produce a similar law In that state. A new situation Is presented as a result of agitation of plans for amending the Oklahoma law, which It Is expected will result In raising Important legal questions Involving the rights of cor porations In that stale, and perhaps I banks In different parts of the conn- i iry. Letters have been received at the departments from '1anl;s In Now York and In tlie southwest, Inquiring whether the proxsltton Involved In the proposed amendment to tho Ok' lahonia law would be In violation of the provisions of the United States constitution. The suggestion Is made that the promised amendment to the Oklahoma bank gunranty law would make It Illegal for any corporation organized under the laws of that state to make a deposit In any bank that Is not operated under tho bank guar anty system of tho state. Also, thai no bank In Oklahoma under the guaranty system shall be permitted to maintain a deposit with any national bank outside of that tsate. It appears that about thirty -five Oklahoma national bunks have relinquished their federnl charters to become stato banks un der the guaranty system. On November 27, 190S, the date of the last reort, there were 2SS banks In Oklahoma lth SI 1,447. 000 capital stock, Individual dctKislts $3t.,2SO.OOO and loans and discounts I3I.99S.00O. This shows only twenty four less luniks, whlcli nHiuis that there havv been new banks started under the national law to take the place of some of these that relin quished their charters to organize ns state banks. The most striking feature of these llgures Is the fact that while there Is a small diminution In the capital stock and Individual deposits of the Ok'ahoma batiks, their loans and dis counts are nearly 500,000 In oe?ss of the showing made Just previous to the guaranty lnw going Into effect. 'In oilier words, the volume of loans and discounts Increased by near ly $3,500,000 and the percentage of reserves Is about I per cent lower at present compared with a year ago. The situation In Kansas during the same period shows a gain of six In the number of national banks, from 201 to 210. The capital stock Is practi cally the same, as Is also the volume of their note Issues.
