The work of the canvassing board of Walsh county shows that Wells, the democratic candidate for super intendent of schools won out cvet Sonerdahl, the republican candidate, with but a very small majority. Knew His Parent''. H. Shaw of the county treasurer's office was well acquainted with the parents of Charles Allman, the man recently killed iu East Grand Forks. Mr. Shaw came west from Waldo. Wis., where Allman's parents lived. Snowball Party. Elaborate preparations are being made for the snowball party to be given by the Elk lodge Friday even ing. It is the third dance of the season's series, and a large number will attend. Every one attending is expected to wear white clothes, and the ball room scene will be a most beautiful one. At the meeting of the Yeoman lodge held Tuesday evening, nominations of candidates for the various offices fofr the next year were made. Following the transaction of the routine busi ness, asocial session was enjoyed. A fine program had been arranged for by members of the lodge in the nature of a surprise for the ladies of the lodge, and the surprise was complete. Among the speakers were Dr. John Fawcett and .1. C. Hart. Their ad dresses were both interesting. Mr. Fawcett told of the workings of the lodge, of its foundation and growth, and gave a most interesting account of the work accomplished. REFERREOTHEpIER RACK The commissioners transacted rou tine business Monday afternoon, al lowing bills on ditching contracts and establishing school district No. 275 in the town of Winger. Tuesday morn ing there was a final hearing on ditch No. 68 in the town of Queen. The viewers are T. Torkelson, T. E. Kjol liaug, F. M. Hartley and the engineer is J. E. Beim A number of farmers were in and several assessments were corrected. It was finally decided to refer the ditch back to the viewers and after a few changes it will prob ably be recommended. Orvis Hinds was appointed engineer on the diteh in the town of Andover. Contract Let Soon. The contract for the building to be erected here by the Hamm Brewing company will be let within a few days at St. Paul. Ladies Aid. The Ladies Aid society of the M. I BADLY THIS YEAR S LEVY- ACTION MIST THE COUNTY Has Been Started as Result ef an Old Ditch Case—Caused by a Non Settlement. Another phase of the trouble which has been caused by the non-settlement of the celebrated Ditch No. 48 contract was brought out yesterday when an' action was started against the county by the State bank of St. Hilaire which will endeavor to collect through the courts the sum of $980.77, which they claim in due 'them for work on the ditch. They have an assignment of the contract from Larson and Ander son, the contractors. This is the case in which W. E. Black purchased the claims of several laborers and brought suit against his attorney, W. EL Howe, to recover the money from the county. He claimed that as the county bad taken a de fective bond from the contractors, that the laborers who worked on the ditch and who did not receive their pay from the contractors could recover from the county and his claim was sustained by the courts. Now the State bank of Hilaire brings a suit to compel the county to pay them the full amount of the money that Is still coming to Larson and Anderson for digging the ditch. The county claim, however, that they should first pay the laborers out of this amount that is owing to Larson and Anderson, and that after the laborers are paid, then the bank should have the remainder. The case will be up at the winter term of court. MNCEL CASE^ POSTPONED Failure of Certain Records to Arrive From Crookston Canned De lay In Case. Contract Made After Last Year's Levy and Should Have Been in This 1 see since there has been a let up in the write up of the city recorder of East Grand Forks that he has be come decidedly anxious to fret into print again and in the last issue of the Herald throw a couple wagor. loads of bouquets at himself in refer ence to a supposed discovery concern ing the sewer assessments on Sixth street between DeMers and Kittson avenues. Had he been assured of some one following him and exposing the truth he would in all probability have remained out of print—badly as he dislikes to do so. The facts con cerning that business is that the con tract was let for the same on Nov. 8, 1905 and the work was finished on Dec. IS, 1905, and paid for so far as Contractor Mcliraith was concerned on the following day. Now, sewer assessments must be included in the levy which is made following the time mentioned, and the law requires that the sewer commission shall report on the same on or before the first day of October. It can thus be seen that the sewer assessment which the sharp eyes of the city recorder saw—it is a good place to laugh- was turned ove. to the Incoming administration which is the present one, as unfinished busi ness. It was the duty of the recorder to see that the commission was ap pointed and the levy for the same made at the time the levy for current expenses was.made this year. Instead of detecting ah error or even an over sight In the last administration he has merely showed that he himself either did not know his duty or neglected or forgot t, and that hlB rush into print was merely for the purpose of hiding his owfc negligence. His record breaking record in this matter Is something like the one he made in the collection of electric light bills a few months ago which had accumulated during the time he was looking after a saloon in the absence of the proprie tor during the latter's absence and for which time the city was paying his salary. The perfume of that wonder ful bunch ot self-thrown bouquets smells more like rotten cabbage since the truth is known. —A Member' of the Old Administra tion. The case of the state vs. John Dan cel, charged with excavating a public highway, scheduled to come up in mu nicipal court today has been continu ed Indefinitely on account of the fail ure of certain records to arrive from Crookston. The only point Involved is the ownership of the property at the end of the bridge, which is claimed by both James Jarvis and the city. Dancel was employed by Jarvis, and, it will be remembered, was engaged in tearing up the approach of the old point bridge when arrested. Funeral Tuesday. The funeral of Ben Guy, the Crook ston man killed at Bemidjl was held yesterday. FOR ITS SAFE KEEPING Says Cash Was Given to Him —Cannot Furnish the Bonds. Prank Rinnert was bound over to the grand jury this morning on a charge of grand larceny, it being charged that he stole a sum of $135 from Ernest Hertner, recently of Can ada. The robbery, it is claimed, took place Tuesday morning, in a local sa loon. Rinnert was a rested shortly after. On the stand today, he claimed that Hertner had given him the mon ey for safe-keeping. He was placed under $1,000 bonds, which he is una ble to furnish. "BOBBY" MITCHELL JOYOUS Socialist Vote la East Grand Forks Lnrsrest in State fer City ef Its Slie. The socialist vote in East Grand Forks was the largest of any city In the state of Minnesota for its size, according to "Bobby" Mitchell, who is feeling pretty good over Oils fact.
