Charles Hirshfleld against Henry W. Phelps for
failure to complv with law as to timber cnltnre
entry No. 1780. dated October «, 1879, upon the
sontb-west quarter section 30, township 139, range
63 w., in Stutsman county, Dakota Territory, with
a view to the cancellation of said entry contest­
ant alleging that Henry W. Phelps has not at an*
time planted or sown to seed trees or cuttings
more than five acres on said tract. That said
Phelps has failed to cultivate the few treeapl ant­
ed on said tract during the years 19%, 1888 aad
1884. That is to say there has been planted to
tr-es, not morejthan five acres since Phelps' entry.
That there is now on said tract not to excced fifty
trees all told. That said trees have not been cul­
tivated by any one since 1881. That no extension
has
granted said Phelps in which to plant
trees
or cuttings. That said tract ia not cul­
tivated or seeds, timber or cwttings sown or plant­
ed as rea uired by law.
The said parties arc hereby summoned to ap­
pear at this offlc* on the 10th day of December,
