Barry bail, although the statute allows it in cases when proof of the disagreement by the jury is not shown to have been caused by misconduct of the jury or defendant or counsel. No put of was offered by the state of any misconduct on the part of the jury, but the judge scored the jury sharply stating that he had every reason to believe that there were those who had not paid much attention to the evidence or to the instruction of the court as to the law or to the oaths they had taken when entering on their duty. MILL BUYS ELEVATORS. Valley City Times Record:—A deal was closed last week by which the Russell-Miller milling company be comes the owner of the Monarch and Great Western elevators in Valley City. As the mill already has a tive year lease of the Alliance elevator, it gives the company control of all the elevators in the city. There has been more or less friction ftfr a number of years between the elevator companies doing business in tt}is city and the mill. The latter in stitution has been in tbe market at all times for good wheat and has paid very little attention to list prices, grades, dockage and other matters which the elevator agent was forced to take in consideration. The ele vators at different times have en deavored unsuccessfully to agree on prices witih the mill people and the result has been that sometimes, in order to buy grain, they have had to ||iy more than was justified by the market quotations. The fact that the mill owns or con trols all the elevators in the city doas not necessalily mean that there will be no competition in this market. There are two elevators at North Valley City and three others within a radius of five miles, and in addition there is W. 11. McLMierson, who is a pretty lively competitor in the ^rain bysiness. Manager Helm states that the "merger" will make no difference so far as the mill's customers are con cerned. They will be dealt with as liberally in the future as in the past. The purchase of the two elevators gives the mill a good deal more storage room for grain and will probably en sure a more steady and reliable supply. The milling company has a state ment in the papers that it requires about 600,000 bushels of wheat a vear or nearly twicc the amount annually unarketed in Valley City and needs the storage house of the elevators to store the grain. They ask the co operation of the local merchants and county commissioners in getting bet ter roads into the town in order to induce farmers to haul the grain need ed at the mill and say there need be no fear of any lack of competition in Valley City. A curious hiwsuit regarding the own ership of lands was tried recently i:i Ceylon. Ti:e trouble originated :it an archery competition lield by King Para krauia Ualiu VI.. who ruled over Cey lon in the fifteenth century, in which there were two champions who outdis tanced all the rest and alike hit every mark that was submitted to them. 'flu king was irbnut to divide the prize when from a neighboring pond a frog was heard to croak. The kin seized upon a solution and declared that whichever could '.it the frog, aiming only by ear. should gain the prize. One of tlie arch ers transfixed the frog with the arrow. So delighted was the monarch that, be sides tlie original prize, be gave to the winner ail estate of "0.000 acres. Tlie claimants in tlie lawsuit were the de scendants of the archer. A UiMiItliful Cowtmur. When the Kraser high landers landed In North America in 1757. it was pro posed to change tlie dress on account of the cokl winters and hot summers. The officers successfully opposed this and were ultimately justified by the highlanders being the healthiest sol diers in tlie army. In the campaign in Holland in 1704 some regiments lost as many as 800 from disease, but the Black Watch, which bad 300 recruits .« its ranks, had only twenty-five cas ualties, including tlie killed in battle.
