The jury, in charge of a genial Deputy Sheriff, and looking as though a due sense of their respon sibility to the commonwealth bad neither dolled tbe edge of their re spective appetites nor caused tbem to lose a good night's rest, had al ready filed into tbeir box. The op poelog counsel took tbeir seats, though somewhat late, at tbeir ta bles, and the defendant, attended ac she was yesterday, was brought into Court and seated herself by ber counsel. Bhe was attired wltb the same careful plainness; and, as then, was bien ehauaUe, bien gau tie. > Nor had the anxious night left any traces, save a slightly deep ened ebade under tbe large, full eyes, on tbat impenetrable mask, which is tbe face of a girl, it is true, but of one whose girlhood waa blotted out forever by the events of a week so big with fate ta ber and to the lover who fell by her hand. The first witness sworn was Hor tewate Abarta, who was examined through the interpreter, and is six teen years of age. Bhe Bald: My sleter left home at &i a. m. oo tbe Friday preoeding the shooting and returned on Monday morning. I admitted ber and asked If she were married. She said no, but that she was to be married. Bhe went away, and on Tuesday aame again and again left. I went to the depot with my other sister; returning, I found Lastania in tbe house, crying. Bhe said all she wished was to die, I told ber I would seek Cbico and ask blm to marry her. The witness then detailed the events of tbe drlye of Forster and tbe two girls in tbe hack. Forster said he would marry ber slster,and ordered the hack to be driven to tbe church, but changed the order. Lastania became very pale. On reacbiug tbe 'White House corner I had a con versation with Forster, endeavor ing to persuade him to marry my sister. He said he would do so when he took her to Tucson. I have "been with my sister during her In carceration. Bhe bas complained of her head and has slept none. I have feared to leave her alone, and bave been with ber constantly. When tbe shot was tired I stood the nearest to Forster. I did not know that she bad a pistol. Mr. White here objected to leading questions by the defense. Witness resumed tbat she beard the shot. Cross-examined by Mr. White, witness said that Bhe was not at home On Friday when her sister went away; of this she was in formed by her mother. Ou Friday evening Laatauia was sought for, Mr. Madogao, who made inquiries, eald tbat he bad beeu informed that Lastania had been seen iv a back with Forster. Ou Saturday and Sunday Lastania was not looked for, as uo good could bt done. Ou Monday Lastania was at home from 6 till 11 in the morn log, and left in a hack,-accompa nied by ber little brother. Oi; Tuesday she came at 11, ami re maining Aye minutes, weut away, but came back almost at once ami went away as quickly. Lastania returned about 1- and Trafford soon after. At once the witness went ti tbe depot with her sister aud re turned at half-past 1. In regard to the clrcumstanoei attending tbe killing, as well as those which followed it, the cross examination, which was loug and searching, failed to shake the direct testimony of the wituess, uud the details were corroboratory of tbe facts already elicited during tbe trial. When Mr. White begau to enquire about Lastauia's conduct and tbe like while in jail, Col. Wells objected to tbe turn of cross examination as irrelevant aud use less. The objection was uot sus tained. Tbe witness occupied an hour lv testifying. During tbe examination cf this witness the mother of tbe defend ant at one time tiroke down and weptsilently for some moments The witness herself, possibly for the purpose of concealing her emo tion, was very highly rouged, while her eye-brows were very much over-delineated. Mrs. Abarta, mother of Ihe de fendant, then took the stand, uud said.* Bhe does uot remember pre cisely when Forster became ac quainted with her daughter or first called. She refused to allow ber daughter to ride out with Forster. Always when Forster called Bhe, or another, was present.- Laatauia was never alone with Forster. Lastania bas always been in deli cate health and has v sweet temper. The three girls went lo the Fxeo House with Forster and iteginaldo del Valle by invitation of Rancho Fico. Dr. Worthlngton and Dr. Wise and others atleuded Lustanb> on a certain occasion ou account of female troubles, from which she bas suffered greatly for three or four years. On the llth of March Lastania and a sister went to con lesslon. Returning, Lastania said she was tired, and would not go with ber sister Isabel to tbe depot, but soon left the house, for wituess was unable to find her. Finally Bhe waa told tbat tbe girl bad beeu seen hurrying along the street with her hat lv her band. Bhe next saw Lastania at 6a. m. on the 14th of March. Lastauiu came to her room and ssylug, "pardon me, mother," burst Into tears. Witness asked if tbe daughter were married, and she answered no, but that was to be. Witness told ber that if she did not marry she should uever enter the house agalu. Here the witnees broke down and wept for a few moments. On Tuesday she saw Laatauia again, who told her that Forster had promised to marry her and bad shown ber what she be lieved to be a marriage license. On Tuesday Lastania looked wi Id. Las tania asked that Hortensia might go as her bridesmaid, aud the wit ness consented. Forster asked wit uess for permission to marry Las tania; this witness refused and finally forbade Forster tbe house, aa she desired her daughter to . marry Ramirez. Witness bas a sister who was crazy, and was sent to Stookton, but whether to the asylum or not witness does not knew. Being cross examined by Mr. Brown, tbe statement of tue wit ness did not materially vary from •That abe had already said. The qutstlon of effect produced on Las tauia's mind by ber physical Ills waa entered into very fully, and tba wltneas testified as to ber slaughter's mental condition at certain times being caused by those physical Ills. Mrs. Abarta .occasionally gave way to ber grief, but, on tbe whole, controlled her self very well. Ou several occa sions objections to tbe line of cross examination were taken by de fendant's counsel, and many of these objections were sustained by the Court on the ground of irrele vancy, but the prosecution suu ceeded in having Mrs. Abarta's evidence concerning ber sister's insanity stricken out as being hear say evidence. '.The defence made au attempt to bring out these facts, but unsuccessfully—except as the possibility of a bill of exceptions is taken iuto consideration. The Court ruled that all the witness's testimony as to her sister's insani ty be stricken out as hearsay evi dence; tbe defense excepted. Tbis witness was oo the stand for an hour and three quarters, when Mary C. Moiso was sworn for the defeuse: Wituess is keeper of tbe Moiso Mansion. Met defend ant in March, before tbe shooting of Forster, whom she saw about 8 o'clock on the Friday night before tbat time. Forster wished a room for himself and wife for one night. Defendaut remained at house till Monday? Wituess bad no conver sation with defendaut. Tlieie was no cross-examination. Mary Roberts, for tbe dtfeuse, testified that Bhe met the defend ant at the Moiso Mansion, where witness was housemaid, in March, on the Saturday morning before Forster was killed. It was iv de fendant's room. The bed had evi dently been occupied by one person only. Defendant said Bhe was run ning away with Forster in order to marry him in Arizona. Witness, being aßked her opinion, advised defendant not to do so, and defend ant said she would uot go. On Sunday morniug the bed indicated that more than one person had passed the night there, aud the sheets were in places bloody. Ou Saturday defeudaut remained all day lv her room, her meals being sent up to her. (No cross-examiua tion.) Michael Madigan was tlio next witness for the defeuse, and testi fied to searching for defendant after she left home, and looking for a marriage license. Tbis he did at Mrs. Abarta's request. A short cross-examination elicited nothing more. M. 8. Arevalo was tbe uext wit ness. He testified that a year and a half ago he went with others, by Forster's request, to serenade tbe defeudaut. Ou this occasion Fors ter said that it was too bad that so beautiful a gir.l should marry a monkey like Ramirez, accompany ing this with au insulting remark to Miss Abarta. Walter 8. Moore took tlie stand. He said he was present ut tlieopcu ingof the l'ico House, so often re ferred to. Tbe Misses Abarta came with Mr. Forster. He wus-ut the Fico House ou the second occasion of defendant's presence there. Forster acted toward the defeudaut wilh marked atteutiou, but wit ness admitted that be had seen young men pay similar attention io young ladus to wlioiu they were uot engaged. K.ven the defeudaut smiled lure; aud, when the audible smile of the concourse had ceased, Francisco Yndart was sworn, and testified that he was intimate with Forster. He visited the Abjrtas with wit ness. Forster asked witness's opln ion as to defendant becoming bis —Fore'er's—wife. Dr. Joseph Kurtz said: That be has known tlie defendant, profes sionally, for two years. He has treated her foi v severe case of sup pressed menses. She complained of suffering in her head. He has visited defendant while in jail. On March 23 I she was very nervous, und bad uot slept, apparently, *for several days. Witness examined the dtfendaut, aud found that she had recently ceased So be a virgiu. The Dr. then gave a very elaborate description of impulsive iusauity; using notes, by tlie permission of the Court, in doing so. He also explained tho difference betweeu the dllfertnt kinds of cerebral dis orders, especially those due to ir regularity iv the sexual peculiari ties of the female. Col. Godfrey put to tbe Doctor a supposititious case, having the peculiarities of that being investigated, and asked if a girl so treated would or would not be apt to luss her reason. To this the Doctor replied lhat the effect upou the mind ami reason of such v person would be to make her crazy. A further suppositious case was put as to such a person committing sui cide, and the Doctor thought it would be natural to such v diseased brain to do so. Iv answer to an other question as to whether it would be natural to such a brain to commit homicide, the Doctor said that he thought It would. Doctor Kurtz also testified us to the com parative authority of medical works. After the conclusion of Doctor Kurtz's direct testimony the Court ordered au adjournment until half past two.
