THE LOS ANGELES DAILY HERALD: THURSDAY MORNING, AUGUST 30, LBBB.
A LEGAL SOCKDOLAGER.
Let Is Work the Problem Out.
Impressario Coughlin had his prima
donna, the mellifluous Minnie Huff ar
rested for grand larceny last night. The
charge is that she walked off from the
stage with masculine smalls and doublet
belonging to the impressarial wardrobe.
A nice legal question arises in this ar
rest. Of course Minnie was clearly
within the law in putting on the apparel,
whether for rehearsal or performance. If
she refused to undress afterwards, and
walked off within the things that she had
legally put on, at what exact point does
the felony come iv. At the refusal to
undress? A woman is not compelled by
law to undress. Suppose she had no
other things handy, it would be an act of
propriety for her to refuse. But suppose
that the"impressario had availed himself
of the old law maxim, that one can take
his own wherever he finds it, and pro
ceeded to seize his things, who would
have been responsible to the law for the
shock that would have been sus
tained by the public? Not Minnie,
surely. The naked facts might
have trojbled her; but the impressario
would clearly have been responsible to
the law for the consequences to the pub
lic. If the law does not permit a creditor
to levy upon one's personal effects in di
rect and actual use, how can a prima
donna be held for larceny and stripped
of the property, even it the </i/om owner
ship is In another, when she placed it on
in the performance of a professional duty
and in her legal right. She might be
pursued for contumacy, if the court had
ordered her to undress and she had re
fused ; but this would have been in the
nature of a civil proceeding. To force
her to undress, vi et armit by legal pro
cess would in a case like this be rather
uncivil; and whilst we believe that Min
nie would have the tight to redress, if
she thought fit, (even in a case of misfit,)
the damages to the impressario could
oily be nil. There might also arise a
nice question as to the legal identifica
tion of the party attainted. Is, for in
stance, Minnie Huff when sl:e is to all
intents and purposes Prince Fortunatus,
a male or a female ? Answer us that,
"aye, marry, and perpend." There be
imbroglios in this extraordinary case.
