NON-SUITED. A Case Which Involved the WashiDgton Gardens. JUDGE W. P. WADE'S DECISION. The Title of the Property Is Vested in the Name of David V. Waldron. There was tried on Friday last, before Department 3 of the Superior Court, the case of Mary Flashner, by her guardian, against our well known fellow-citizen, David V. Waldron, involving the title of the Washington gardens property.valued .at about $125,000. The case was an in teresting one, as it shows very clearly that one in possession of property ever so long may be called upon to defend his title. This property belonged to Marcus Flashner, who died, leaving as his only heirs his wife (who subsequently married a Mr. Matfield) and Many Flashner, an only child,who from an accident received in infancy lost her mind, and was subse quently declared an incompetent by our courts. Mr. Flashner died about 1859, and his widow finding the property now known as the Washington garden tract unproductive, sought to sell it. This she did in 1868 to Mr. Waldron fdr $0,000, which was considered a very high price for the property at the time. In order to get a clear title, certain court proceedings were had in the court to provide for the sale of Mary Flashner's interest. Ber uncle, Geo. King, was appointed by the court to sell her interest in this property, The price was agreed upon and the sale confirmed by the Court, and Mr. King was by the Court named as trustee to make the sale and receive the interest of his ward. This he attended to. He re ceived the money for this child and Mrs. Flaahner, now Mrs. Matfield, received hers. Many years elapßed, Mr. Waldron all the time feeling assured that his title was good and knowing that he had bought the property in good faith and paid a good price for it. Some years ago there were mutteringa as to his title, and a suit was instituted by Mrs. Cath arine Waldron, who then held the fee againßt Mary Flashner to quiet title. Judge Brunson acted in that suit for Mrs. Waldron, and this child was repre sented by Mr. Hartman, then a well known member of the bar, who was ap pointed by the Court aa her guardian ad libum. The case was fully and fairly tried, and resulted, as might have been expected, in a judgment, quieting the title, and declaring that Mary Flashner had no interest therein. This wonld have been thought to have ended the matter, but lately a suit was brought in the interests of Miry Flash ner, this imbecile, to secure the prop erty. She acted through a guardian, and Messrs. Graff, Gibbon & Creighton were her attorneys. Mr. Waldron was represented by Smith, Wilson & Smith. Tne case was opened for trial on Friday, and Mr. Waldron had in attendance a long array of our old residents as wit nesses, in his favor, and his attorneys were prepared to meet any case that could be advanced by the plaintiff, but no case was developed against him at all, and upon the close of the plaintiff's testi mony and without putting the defend ant on any proof, the Court, on the motion of Mr. Waldron's attorneys, decided that the case should be dismissed. All the equities of the case were in favor of Mr. Waldron, and we are glad of the re-r .t. He paid for the property and paid its full worth, owned it adverse to the world for over twenty years, and it would have been a hardship indeed had any other decision been made. Judge Wade followed the jurisprudence of the State, which is well settled that the title of property can ba quieted as against a minor or imbecile, and that the disabilities of the law made for their protection should be thus used only, and not as a means of oppression to others. We congratulate Mr. Waldron on the result. He is well known and well liked; has the confidence of all our people, and his friends extend to him their well wishes. A PALATIAL HOME. Tne magnificent Keitdenceolu.il. Ireland. A Herald reporter was yesterday afternoon taking his usual rounds noting the many improvements in the building line, and while going along Grand avenue and Figueroa streets, noticed many costly, expensive and ornamental homes which were the perfection of architec tural deßign. Turning down Kinney street he also noticed many cosy and home like residences, but among the numerous beautiful houses for which Los Angeles ia so well noted, the reporter's attention was called to that of Mr. D. H. Ireland. Mr. Ireland, who is one of the oldest gas works builders in the United States, bears the proud reputation of having erected forty five gas works in the principal cities of this country. He arrived in Los An geles three years ago, and the climate being so favorable to bis wife, concluded to settle here. On the left-hand side of Kinney street he erected and furnished a beautiful residence, which he afterwards sold at a handsome advance, having in mind all the time the erection of a more elaborate domicile. The present resi dence of Mr. D. H. Ireland, which is one of the most beautiful in Los An geles, was designed by the gentleman himself and his plans were carried out by Architect Merithew. The rooms, which are eleven in number, are very large and airy, and are furnished with all the modern improvements. The house throughout is famished with nat ural Oregon pine. The building, from an external view, is tbat of a seaside home, •nd among its many advantages are its wide and circular verandas. Mr. Ireland made a very careful and complete inspec tion of the many residences in Los An geles, and after surveying them sll, governed his ideas accordingly. The interior of the house is filled with many of the beautiful and home-like improve ments that are known in modern times, and really reflects great credit on Mr. Ireland's taste and judgment. In the rear of his residence is a spacious barn and poultry house. In addition are fine strawberry beds and beautifol as well as rare exotics, which go to make a place, an the poet says, "a thing to be ad mired." Special Price Until New Year.
