The present caae was tried before Judge Khaw, who rendered a judgment in favor of the city for the sum of f9721.64, and an appeal «aa taken for tbe bank by Meears. Meenager et al. vs. Hamilton et al., the submission was set aside and the cause placed on the Los Angeles bank calendar for argument. Tbe order of the anperior court grant ing a new trial in tbe case of W.J. Shanklin, appellant, vs. J. H. Hall, reapondent, is affirmed. It wae an ac tion to recover for services rendeited in tbe exchange of certain real estate. Judgment went for the plaintiff and the appeal was from tbe motion granting a new trial. An electric car going weetward, abont 6 o'clock p. m., waa crowded—in all the car only one aeat waa unoccupied. Tbat particular aeat waa next to a woman wbo had placed a large bundle on it, and who never offered to remove it for tbe benefit of any of tbe many passen gers wbo were atanding. Directly in front of ber waa an old gentleman, poorly clad and bent with age, who looked first at tbe woman and then at tbe aeat occupied by tne bundle. It was evident to all those aronnd that the old gentleman wanted the aeat, bat did not care to aak the woman to remove the bundle. At Sixth and Broadway a large, well dressed man boarded the car. Taking in the aituation at a glanca, ha walked up to tbe woman and took tbe objec tionable bundle from the aeat and aat down without uttering a word. In a moment he got np, and after giving bia aeat to tbe old gentleman, remarked to a friend in a voice plainly heard all over tbe car: "There ia a grand opportunity here for a profeasor of etiquette, especially veraed in common politeneea." Tbe woman with tha bundle flushed, but eaid nothing, and at the corner of Ninth atreet and Broadway ahe bad tbe car stopped, and looked at everybody around, the large man in particular, with a glance of supreme contempt, and as ahe alighted everybody in ithe car smiled, except tha old man, who hung hia head in deep meditation, no doubt thinking of the many selfish people in the world. Gibbons, a dressmaker resid ing at 356 Buena Viata atreet, atated that Ormondy, who reaidea at the same place, need abnaive language to ber. On concluaion of tbe evidence Jndge Anatin discharged the defendant. John Higgine, who waa found gnilty Wednesday of stealing aome carpenters' toola, waa sentenced yesterday by Justice Auatin to serve 50 day* with the chain gang. Justice Anatin yeaterday sentenced John Murphy to 40 daya in tbe city jail. Murphy waa convicted on Wednesday of petty larceny. Arthur Dalea waa arreated yeaterday by Bailiff Appel and lodged in dnrance vile. Dalea ia accnaed of assaulting a China man aome time ago. Conatable Ricbardaon attached the office fixtures and furniture, yesterday, belonging to tbe Southern California Smelting and Refining company. Boyle Heights furnished aome diver sion yesterday in Justice Austin's court. , Harry Cowlee and bia wife were on trial for an alleged battery, the com plaining witness being also a resident of tbe heights. Miss H. K. Porter took the' witneaa stand and swore that on tbe 23d of Sep tember she was watching the peregrina tions ot aome chickens. She leaned over the fence which divldea the Cowlea mansion from tne abode of the Porters, when the bncolic quiet of tbe scene waa diatnrbed by Mr. Cowlea, wbo tnrned a hose on ber, considerably damaging both ber spirita and ber coatnme. On cross-examination it developed that Miss Porter bad been a aonrce of annoyance to the Cowleaea for aome time. Cowlea admitted that Miaa Porter stood in the way of the hose, bat it was entirely an accident that tbe water struck her. Judge Austin imposed the nominal penalty of S3 on the proprietor of tbe hose.
