14. To create offices and provide lor the
election or appolutment of officers oner than
tbose established by this oharter, or by the
general law, whenever the publio convenience
loay require ths same, and prescribe their
dalles and fix their compensation. (But tbis
ahall not be construed to authorize the crea
tion of new offices and ths appointment of
other officers lo perform ihe duties by this
charter assigned to ofllcers provided for here
in, other tban the necessary deputies and as
sistants to the ofllcers of sala oity.)
15. To acquire, by purchae, condemnation,
or other lawful means, property, both real and
personal, Including water ana water rights,
within or without the corporate limits, neces
sary or convenient for municipal purposes, or
for tbe exercise ol tha powers granted to said
corporation.

IV. To provide and maintain a proper and
ifflcient fire department, and make and adopt
luch measures, rules and regulatlo » lor the

against inundations.

garbage and other injurious and inconvenient
matter within the elty, and for tha disposition
of the same.

a misdemeanor in.all proper cases, and to pre
scribe the punishment therefor, by fine or im
prisonment, or by both: but such flne not lo

2s. To make and enforce within its limits
such local, police, sanitary and other regula

23. To exercise all municipal powere neces
sary to the complete and efficient manage
ment and control ol the municipal property,

powers as are forbladen or are controlled by
general law.

Sec. 4. The following officers sball be elected
by the electors of tba city of Los Angeles, to

And the Council herein provided ihall hare
power, by ordinance, to c tabltsh and change
iho boundaries and numbers thereof when
ever it may deem it expedient, but until
changed by the Council, the said wards shall
remain as abov - described and established.
Sec. A. All elective officers, elected at Ibe
! first general municipal election held after the
t .king effect of thli charter, shall hold their
offices for the term of two years, commencing
on the first Monday in April next succeeding
their election, except ai provided in Hec. 190
of -this charter.
Sec. 11. The mayor shall appoint the clerk ot
the mayor. The mayor shall appoint the (01
--1 ■wing officers, subject to confirmation by a
majorit, of the cou mil, towlt: The city aud
itor, the snisri tondent of buildings, he
member- of the police, park and tiro commis
sions, the incmheri< of the board of health, the
I building cmiinii .sioi.en and the directors of
the Los Angeles public library. Thecouncil
shall appoint tho city engineer, the city clerk
and the sue t superintendent.
8 c 7, The city s;ho l superintendent shall
be appointed by the board of education. The
chief of police shall be appointed by tho board
of police commissioners. The chief engineer
of the Are department ahall be appointed by
I Ihe board ol lire commissioners. The health
< officer shall be appointed by the board of
health, and the librarian by tne directors of
the public llbrarv.
sec. 11, All appointed officer! ahall hold office
un il removed by the appointing power, which
ahall have the power of removing In all cases;
provided that where confirmation Is required
the assent of the conttrmlng tody shall be
requisite for removal.
T he council shall have power to suspend any
officer of tbe elty pending trial, against whom
criminal proceedings based on misdemeanor
In office or civil action for tbe recovery of
money due to the clly have been commenced,
and tha mayor ihall appoint a substitute for

In voting upon ths appointment, confirma
tion, suspension and removal of officers thu
member!of the council, or other body op
fiolntlng confirming, suspending or remov
ng, ihall vote by open ballot or call of roll,
and the ballot or vote of each member ihall
be spread upon tho minutes.
Seo. 10. Two-thirds of the members of the
council ihall constitute a quorum for the
tranasctlnn of business, but nd ordinance
shall be passed or oiher act done granting a
franchise, miking any contract, auditing any
bill, ordering any work to he done, or supplies
to be furnished, disposing of or leasing thecity
property, ordering any assessment ior street
Improvement, or building sewers or any other
act to be done involving the payment of
money, or the Incurring of debt by the city,
unless two-thirds ol the members of the whole
council vote In favor then of. All other ordi
) nunc, a may be passed by vote of a majority of
the whole council.
Sac. 17. All bonds of officers must be ap
proved by the council, as also the bonds of
any contractors with Ihe city, except such as
are otherwise provided lor by the state low.
The city clerk shall Indorse upon such bonds
the date of their approval, whioh Indorsement
•hatl be aigned by the pre Idlng officer of tbe
council, and the i Hy clerk.
Sec, IS. No councilman or other city officer
sha 1 be interested, directly or indirectly. In
any contract in whlca the city is a party, or
made by any officer of the cfty on behalf of
the clly. Any violation of this section shall be
a misdemeanor, and upon conviction thereof,
besides the penalty that may be Imposed by a
court of competent jurisdiction, the council
shall declare the offico vacant, aud any person
convicted of a violation ot this section shall be
forever disqualified from holding any offico
under this chartci. Nor shall auy officer of
ihe oity be a surety oa any bond given to the
city, or to any person for the benefit of the
oity.
Nor sball any person who li interested in
contracts with the city he a surety on any
bond given to the city by aay officer, deputyor
employee.
Sea 31. The council shall have power, by
ordinance, to regulate and provide for lighting
of streets, laying down gas pipe! and erection
of lamp posts, eleotrio towers and other ap
paratus, and to regulate tbe sale and use of
gas, water and electric light, and fix the price
ot gas water and electric light, and tho rent of
gas, water and electric meters within thecity,
and regulate the Inspection thereof; and to
regulate telephone service and the uio of tele
phone! within the oiiy, and io fix and deter
mine the charge for telephone! and telephone
•ervtce and connections; a- d to prohlbttor
regulate the erection ol poles lor telegraph,
telephone or electric wire In the public
grounds streets or alleys, and the placing of
wire thereon; and to require the removal from
the public grounds, streets or alleys of any or
all such poles, and the removal and placing
under ground of any or all telegraph, tele
phone or electrle wires.
It shall not make any contract for removing
?:arbage, sweeping streets and lighting streets
or a longer term than two years. And they
shall advertise and receive proposal! fur all
such contracts not loss than six montha be
fore the expiration ol any luch existing con
tract.
It shall not within ninety days next precedl
Ing the date ol holding a general munlcipa
election nor within the tbirty dayi next im
mediately following, including the day of
holding such general municipal election, paai
any ordinance, order or resolution granting to
any person or persons or association of persons
or corporation whatever, any privilege or
franchise lor tha construction, extension or
operation ol any street railroad or extensio.i of
time for the construction or operation of any
street railroad, over or upon any or part of any
stieet road or highway square! or park with
in the city. Any franchise or privilege granted
or attempted to bo granted In violation of or
c n rary to the foregoing provisions shall be
absolutely void and of no effect.
In granting a franchise lor conitruction, ex
tension or operation of any street lallroad,
they shall in addition to the lestrlctlons re
quired by tbe laws of thli atate require the
cari to be run io ai to make at least fifteen min
utes headway, (that Is to say tbey shall run can
at least every filteen mlnuten from 7 a.m. to 10
p. m. and as often as thirty minutes headway
ithat ii to 8 y they sball run can at least every
thirty minutes) from o a m to 7a. m., ana
from 10 p. m. to 12 p. m. over the entire line
from staninn point to the end thereof. And
they shall also further provide that if at any
time (or the spaoa of three month! tho said
road or any part thereof sbaL be unused as a
street railroad and the cars run at least aa
often as every fifteen minutes from 7 a m to
10 p. m . the franchise (or the portion or por
tions/ unused shall be thereby forfeited and
become the property of the city.
Sec. 32. It shall, by ordinance, provide for the
naming of srects and numbering of .houses,
and for .emulating aud preventing the exhibi
tion ol banners, flags or placards a rosi the
streot, or sidewalks, and (or regulating or sup
pressing publio criers, advertising, ringing of
bells, and other noises.
It ihall, by ordinance, forbid the erection or
display on any building or property of the
city, of any banner, device or nag of any state
or nation, except that of the United states, the
itato ol California, or the city of Lot Angelas.
It may, by ordinance, authorize tbe expendi
ture of money not to exceed tho sum of one
thousand doll in, in any one fiscal year, for tho
proper celebration ol the 4th of July and other
public demonstrations.
eoc. 40. The council shall on the first Mon
day of Octobor In each year fix the rate of the
city taxes, designating the number ol cents on
each one hundred dollars for each fund, which
rate shall then ba certified by the city clerk lo
theoounty auditor of Los Angelea county, and
ihe city taxes of said city shall then boool ect, d
by tho i ounty officers at the same time and in
the same manner that state and county taxes
are collected, and turned over to 'he oity
treasShvr wbo shall then disburse the same.
Provided, that In case the city council shall at
any time by a vote of all ita members, ordain
that tho city taxes shall be a sessed. levied,
equalised and collected by the city officers, the
city council sha 1 bave power to appoint a city
assessor aud a city tax collector, fix their sal
aries, and provide (or a system of aisesting,
levying and collecting city taxes and equaliz
ing assessments.

of commissions appointed under the provisions
of this charter or that may hereafter be ap
pointed .hall be open to the public
The council shall have full power tb pais
ordinances upon any other subject of municipal
control or io carry into effect any other powers
oi the municipality.

Sec. 43. The city auditor ihall act ai tb* gen
eral accountant and fiscal agent of thecity,
and shall exercise a general superintendence
over all the officers of the city charged in arty
1 manner with the receipt, collection or dis
bursement of the city revcnuei.
Ue shall keep n complete act of booka, in
which he shall aot lor h In a plain and busl
ncss-llke manner everr money transaction ol
the city, io as to show at all times the atate of
each fund, from what source the money was
derived, and for what purpose any money was
expended, and also all collections made and
paid Into the treasury by eaoh officer or any
oihcr person
Ho shall, oa application ol any person in
debted to tue city holding money payable in
to tno city treaanry, or doslrlng to pay money
therein, certify to the City Treaiurer the
amount thereof to what fund applicable, and
by whom to be paid.
Ho shall, upon the depoalt of the receipt of
tho City Treasurer for money paid into the city
treasury, charge the C.ty Treasurer with the
amount received by him, and give ihe person
paying the same a receipt therefor.
It shall be his duty to >pporllon among tha
several funds all publio money at any time
In the city treasury, not by law or ordinance
specifically apportioned and appropriated, and
forthwith notify the City Treasurer oi mch
apportionment or appropriation. Ho shall
countersign and deliver to the proper officer
all licenses.
All moneys due or that may become due to
or collectable by tin city or any officer, em
ployee or department thereof, muat ba paid
direct to the city treaiurer, the order of the
auditor directing the city treasurer to receive
the same, and spcclfyihg ths (Und to which it
Bhall be charged, having first been obtained.
Provided that nothing in thli notion con
tained shall bo construed aa In any manner In
terfering with or affecting the payment .ot
taxes to the city tax collector, or moneyi paid
on account of street assessmente to the oity
officer pc: forming the duties superintendent
oi st reels.
The auditor ihall prescribe a systsm of books
and record! to be kept by each department of
the elty government, ana a form ol monthly
reports to be made from each department to
the city auditor, showing all business transac
tions of the department, all receipts and dis
position of material and supplies, tools, etc.,
to the end. thatthe auditor may have a com
plete and accurate knowledge of all the busi
ness transaction s of the cl ty and of tha several
departments, and be enabled to keep full aud
accurate records of the same, and report
monthly thereon to tbe council.
Thli system ol books and reecrdi ol reports
•hall bo submitted to the council, and on ap
proval by a majority of the council shall at
once be put In force by tne several officers and
departments. And tne said syltem ol books,
records and reports shall not be changed ex
cept after tbo proposed changes have been
submitted by the auditor to, and have been
approved by the oounelL
No warrant! for salary, In favor ol any oity
official or employee, shall be approved by the
auditor until all reports required ol such offi
ceror employee by tho city system of accounts
hereinbefore provided for, shall have bean
made.
He shall keep In his office, in a place acressl
ble and open at all times during office houri
to the publio a book containing an alphabeti
cal Hit of the names of all p-rsons who are
bondsmen for officers of the city, giving the
names ol the officers lor whom they are bonds
men and the amount lor which they became
lurety.
The city auditor Shall be a akilled ac
countant.
He shall report to the council at the regular
meeting of each weak tha condition ol each
fund lv the city treasury and the amount
drawn from each (und the preceding week.
He ihall make and present a report to the
council at in meeting in the seoond week of
December of each year showing all financial
business transactions ol the elty ior the pre
ceding year ending the 30th day of November
last.
He shall audit and approve all demands
against the oity before payment, and keep a
r cord of the same as hereinafter provided in
Article XXL
He ihall on or before the first day of August
in each year make and present to tha council a
report as to the revenue and expense! ol the
city lor the current Uses! year, in whioh he
ahall set forth estimates of (1) the revenue
from othsr sources than taxation; (2/ the
Itemiied expenditure!; (3i tha itemised
amounts necessary to ba raised by taxation for
each fund.
Ha (ball perform mch other duties as shall
be required df him by thli charter or by ordi
nance. He ihall devote hli entire time to the
duties of his office.
Seo. 44. It shall be the duty ol tha city treas
urer to receive and keep all moneyi that shall
come to the city by taxation or otherwise, and
to pay tha same out oa demands legally
audited In the manner herein after provided;
upon warrant! issued by tha auditor, and
without such auditing and upon luch war
rant!, he shall diiburse ne public moneyi
whatever, except the principal and interest
of the municipal bonded indebtedneie when
payable.
He ihall receive no money into tha city
treasury unleas accompanied by the certificate
of the elty auditor provided tor in lection 43
horeol.
He shall Issue receipts In duplicate to aU
persdns paying money Into the treasury.
One ol which receipt! shall be forthwith
depoalted with the city audi or.
He shall make a report at tbe close of each
business day, to tiie auditor, showing all
moneys received during the day, together with
the number of each receipt given by him
therefor, and what account and from whom
received and to what land applied
He shall, on or before the seventh day of
each mouth, make out and present to the
council a full and complete statement of the
receipts and expenditures (or tha preceding
calendar month; snd -he shall make such
ipeclal reports irom time to time as may be re
quired by the council.
The mayor, city attorney, oity auditor, the
finance committee of the city council, or any
special committee appointed by the council,
separately or collectively, and with the aid of
an accountant lelectcd by luih officer or com
mittee, ihall have the right and power to ex
amine the books of the treaiurer at all times:
and the mayor, auditor or flnanoe committee
shall alio have the right to Inspect and count
all public moneyi under the treasurer 1 ! con
trol, or on deposit elsewhere. Whenever the
city shall provide a proper vault and safes in
tho city hall for the k-oping of the city monoy,
the treasurer shall keep sold moneys in said
vault, except as hereinafter provided.
He shall devote his entire time to the duties
of his oflice.
He ahall report, at the close of each busi
ness day, to the oity auditor, all receipt! and
payment! of money made during the day, giv
ing the number of the receipt issued or claim
paid, the name of tbe party paving or who
was paid, and the name of the fund charged or
credited with suoh receipt or payment, as the
case may be.
Sec. 48. In addition to other duttei imposed
upon him by thli oharter or by ordinance ol
tbe council, the city engineer shall:
1. Make or cause to be made all surveys. In
spection! and estimates required by the
counoil.
2. He shall have the exolailve control and
supervision nf all publio works ol whatever
nature, done by the city.
3. He shall have the final decision, (unlesa
otherwlae provided hy ordinance) aa to tha
proper looatlon of telegraph, telephone, elec
tric light and other poles, as well ai the proper
a'lgnnienl and depth below the mrface of tel
ephone, telegraph and electrle wirei, gas or
water pipes or private drains or any other pri
vate construction above and below ground in
which a decision rests with the city. All such
workii to be performed to his entire satisfac
tion.
4. He ihall appoint all aulitanti in field and
office whioh na may Irom time to time con
sider necessary to the proper and efficient
working of his department.
5. He shall have power to suspend, dismiss
and reinst-te any and all of the officera or em
ployees ol his department He •hall, with the
approval of ths oity counoil, establish ths
salaries or wages to be paid such officers or
employei A
IS. He hall appoint all inspectors and lore
men and employ all laborers neceasary in hli
opinion to carry out effectually any work
undor his control. All such Inspector! and
foremen and laborers shall ba paid suoh wagai

ject to suspension or dismissal by him with

7. He shall cause a weekly return to be made

He shall approve, by indorsement in writing,
the form and validity ot all official or other
bonds required oy this Oharter, or by ordinance
ol the council, before the same are submitted
to tho council or mayor for final approval.
He ahall approve In writing the draft! of all
contracts before the lama are entered Into on

Both he and bla deputies shall devote their
entire time to the duties of their office, and it
ihall be unlawful for thorn to aocept any feci,
payment, emolument or thing of value other
than that received from the city for the per
formance of any legal practice.
Sec. AO. The mayor ihall appoint three citi
zen!, two of whom shall be architect! In good
standing and who ihall have practiced their
profenlon not less than three years In this city,
all of whom shall serve without compensation,
to commute the board of bul ding commission
ers of the city, The budding commissioners
shaii meet at lean one* a month.
The building department shall conlst of a
building auperlntendent and an assistant su
perintendent (and ihe latter must be a plumber
of approved character and experience), bo h of
whom shall be appointed by said building
commission; and of as many other officers ana
employees as the. council may by ordinance
from time to time determine to be necessary.
The salaries of all officers and employees of
tbe building department (except that of the
superintendent of buildings) shall be fixed by
ordinance The board of building commission

the government of the department, and tlx and
enforce the penalties ior their violation. The
board of building commissioners shall have
such other powers and perform luoh other du
ties as may bs granted or imposed by ordi
nance.
The auperlntendent of buildings shall be an
architect, builder, or master mechanic of ap
proved character and experience. Be ihall
superintend the erection of all buildings
erected by or for tha city. Ha shall have
charge of the enforcement of all ordinances
pertaining to party walls and to the erection,
construction, alteration, repair or removal of
building!, and the nature and arrangement of
heating, plumbing and ventilating appli
ances.
Seo. Al. The water overseer shall have the
general charge, care and supervision of all
waters and water worki belonging to the city,
and the distribution ot aaid waters, ao far as
the aame shall be entrusted to hlmbyordl
nence, and shall perform such other and fur
ther duties as may be prescribed by ordi
nance. He shall devote his entire time to tbe
duties of the office.
All the waters and water works of the city,
both for Irrigation purpose! ai well aa for do
mestic and manufacturing purpo,ea, ihall be
under the control of a water commission of
three (8) citizens to be appointed by the mayor
by and with tbe approval of the Common
Council, not more than two of whom shall be
long to the same political party, and all pow
ers vested in the water overseer, as to the man
agement, sale and distribution of such water
and general charge thereof ahall be vested in
laid water commission.
Said water commission, when appointed,
ahall have control of all mattera relating to tba
conatructlon, management and maintenance
and control of the water and watar works
of the city and ol the di tributlon and sale or
rental of water And of the collection of rates
for the same.
Said water commission shall annually fix
the rates 10 be charred for water, which rate
shall not be enforced until its approval by tha
council.
Sec. S3. The itreet superintendent shall have
the general care of, ana frequently Inspect the
street! ot, the cily. He ihall reoelve and In
v stigate all complaints as to their conultlon.
and shall have charge of the enforcement of
all ordinances pertaining to street obstruc
tions.
He shall frequently Inspect all publio works
pertaining to itreet Improvements while the
lame are in course of construe ion, Inn ect and

erwise; and shall at onoa report to the council

tha fire department a d its apparatus, giving
a detailed statement thereof; alio the work of
the department during the year.
12. The report of the city school superin

ol the public schools, the number of teachers
and their salaries and the number of pupils in
attendance.

condition of their trust for the year ending the
80th day of November of that year; tba vari

pose auch money has been expended, and the

14. The report of the park commissioners
shall show the condition of the parks, with
the kind, cost and the expense ot the imp ova
menu, Including the entire cost and expense
of the department lor the year ending Novem
ber 30th last preceding
Sec. 01. The following named officers of said
city shall respectively execute to said munici
pal oorporation bonds In the following sural
respectively, conditioned for the faithful dis
charge by them of the duties of their respective
offices, to wit:
The bond of the city auditor ia fixed at $10,

The bond of the city treasurer is fixed at
$150,000.
The bond of the city engineer Is fixed at

The bond of the city attorney Is fixed at $5,

The bond ol the water overseer is fixed at
$2,000.

Sec. 09. The officer! of ihe city ihall receive
in full compensation for all services of every
kind whatever rendered by them, the follow
ing salaries, payablo in monthly installments,
at the end of each calender month:
The mayor shall receive $3000 per annum.
Each councilman shall receive $1200 per
annum.
Tha city clerk ihall receive $2400 per an
num.
The city andltor shsll reoelve $2400 per
annum.
The city treaiurer ihall receive $2400 per
annum.
The elty engineer ihall receive $3000 per
annum.
The city attorney shsll receive $3000 per
annum.
The superintendent of building! ihall re
ceive $1800 per annum.
The chief oi police ihall receive $3000 per
annum.
The health officer shall receive $2000 per
annum.
Tho itreet superintendent ihall receive
$2000 per annum.
Sec ti9. The government of the school de
partment of the city shall be vested in a board
of education, to consist oi seven persons to be
elected as herein provided, to be called mem
bers of the board ol education, who shall serve
without salary.
Seo. 70. The board ol education shall elect
one of Its number president, and shall hold
regular meeting at least once In each month,
and special meetings at such times as shall be
determined by a rule of aaid board. A majority
of all the members shall constitute a quorum
for the transaction of bu.ilness, but a smaller
number may adjourn from time to time. The
board may determine the rules of its proceed
ings. Its sessions ihall be public, and its re
cords shall be open to public inspection.
Sec. 71. The board of education succeed! to
all the property rights and to the obligations
of the board of education of the city of Los
Angeles heretofore existing, and it ihall have
•010 power:
1. To establish and maintain public achools,
Including high schools, to change, conaolidate
and discontinue the aame, and to establish
achool districts, and to fix and alter the
boundaries thereof.
2. To appoint or employ and dismiss the city
ichool superintendent, a deputy superintend
ent, a clerk and auch teachers, janitors, ichool
ceniui marshals, mechanics, laborers and
otner emp oyees as may bo necessary to carry
Into effect the powers and duties of the board;
to fix, alter and allow their s .lories or wages,
and to withhold for good and sufficient cause,
the whole or any part of the salary or wages of
any person or persons employed as aforesaid.
3. To raako, establish and enforce all neces
sary and proper rules and regulations for the
government of public schools, the teachers
thereof, pupils therein, and for carrying Into
effect the laws relating to education; also to
establish and regulate the grade of schools,
and determine what text-books, courie of
study an i mode of Instruction shall be used in
■aid schools.
4. To provide for the ichool department fuel
and light!, water, blank! blank books, print
ing and stationery; and to incur such other
incidental expenses as may be deemed neces
sary by said board.
ft. To build, alter, repair, rent and provide
school houses, and to furnish them with
proper school furniture, apparatus and ap
pliance!.
0. To take and hold In lee. or otherwise, in
truit for the city, any and all real estate and
personal property that may have been ac
quired, or may hereafter be acquired, for the
use and benefit of the public schools of the
city; and to sell or exchange and to lease any
of such p ope ty; provided that tho proceeds
ol any aucb sale or exchange shall be exclu
sively applied to the purchase of other lots, or
the erection of school bouses.
7. To grade, fence and improve all school
lots, ana In front thereof to grade, sewer or
pave and repair the streets, aud to oonstruot
and repair sidewalks.
8. To me for any and all property belonging
to or claimed by the said board of education,
and to prosecute and deiend all actions at law
or In equity necessary to recover and main
tain ths full enjoyment and possession of said
property, and to require the servloes of the
city attorney, tree ol charge, In all such cases.
If. To determine annually the amount ol
money required for the support of the public
schools and for carrying Into effect all the pro
visions of law in reference thereto; and, in
pursuance ef thli provision, the board sball,
on or before the ISth day of July of each year,
submit in writing to the city council a careful
estimate of the whole amount of money to be
received from the itate and county and the
amount required from the city for the above
purposes, and the city council ihall, In each
year, fix the percentage ol taxes to be levied
and collec ed far ichool purposes; provided,
that the amount to be thus levied for ichool
purposes ihall not exceed twenty cent! on
each one hundred dollar!' valuation upon the
assessment ro 1, and that when collected it
•hall be paid into the ichool fund.
10. To establish regulations for the just and
equitable disbursement oi all moneys belong
ing to the school fund.
11. To examine and approve, In whole or In
part, in the manner provided in ejection 212,
every demand payable out of tbe school fund,
or to reject any such demand for good cause.
12. 1 o discharge all legal incumbrances now
existing or which may hereafter exist upon any
school property.
15. To prohibit any child under six years of
age from attending tne public schools.
14. In its discretion to establish kindergar
ten sohools for the instruction of children be
tween tbe ages of lire aod six years, and indus
trial and manual training schools or depart
ments.
15. To receive and manage property or money
acquired by bequest or donation in trust for
the benefit of any school, educational purpose,
or school property.
16. And generally to do and perform such
other acts as may be necessary and proper to
carry Into force and effect the powers conferred
on said board, and to increase the efficiency of
the public schools in eaid city.
17. No member ol the board ot education
shall, during the term for which he shall have
been elected, be eligible to any office to be
filled or confirmed by the board of education,
nor shall any member ol the board of educa
tion be selected to fill any vaoancy that may
occur in auy office when such vacancy is to be
filled or confirmed by the board of education.
Sec. 72. All contracts for building shall be
given io the lowest bidder thereof, offering
adequate security, to be determined by the
board after due public notice, published for
not leu than ten days in the official newspaper
of the oity. It shall be the duty of the board
to furnish all necessary supplies for the public
schools. All supplies, books, stationery, fuel,
printing, goods, material, merchandiser, re
pairing and every other article and thing sup
plied to or done lor the publio schools, or any
of tbem, when the expenditure to be incurred
on account of auch matter may exceed three
hundred dollars, shall be done or furnished by
contract let to the lowest bidder after like pub
lic advertisement; provided, that tbe board of
education may reject any and all bids under
this section.
Provided, that the board ol education may
by requisition authorise any appointee, com
mittee or agent of said board to bind the laid
board ior the payment oi any sum of money
not exoeeding three hundred dollars; which
requisition shall be approved by a two-thirdi
vote oi laid board, spread upon the minutes
previous to the inourrlng ot the Indebtedness.
Sec. 77. The laid ichool fund shall be used
and applied by said board ol education for tha
lollowing puiposes, to wit:
1. For the payment of the lalariei or wages
ol the superintendent, deputy superintendent,
clerk, teachers, janitors, school census mar
ihals, and other perioni who may be employed
by md board.
2. For the erection, alteration, repairs, rent
and furnishing oi sohool houses.
3. For the purohase money or rent of any
real or personal property purchased or leased
by said board
4. For the discharge ol all legal incum
brances on any ichool property.
ft, For lighting the ichool rooms and the
offices and rooms oi the superintendent and
board ot education.
0. For supply ing the school! with fuel, water,
apparatus, blinks, blank books, and necessary
si nool appliances, together with books for in
digent children.
7. For lupplting books, printing and sta
tionery for the vie of the superintendent and
board ol education, and for the incidental ex
penses of the department.
8. For grading and improving all school lots,
and for grading, sewering, planking, or paving
and repairing streets, ana constructing ana
repairing sidewalks in front thereof.
Sec. 83. The mayor shall appoint a board of
five dlreutors ior laid library, who shall serve
without compensation and be known as the
board af director! oi tha Loi Anvatas publio
library, and who ihall bo chosen from the
citizeni at large, male or female, without re
gard to their politlcil opinion!, but with reler
ence to their fitness for said office, and no
member of the city council shall be a member
of the board.
Sec. Hi>. Such board, by a majority of all the
members, to be recorded in the minutes with
the ayes and noes at length, shall have power
to make and enforce all such by-laws, rules
and regulations as may be necessary or expe
dient for Its own guidance, and for the admin
istration, government and protection of such
library, reading room and property; to deter
mine the number of ofllcers and assistants to
be appointed for inch library and reading
room, and to determine and define their du
ties, to appoint a librarian and necessary as
sistants, and such other employees as may be
necessary, and. for good cause, to remove them;
except the payment of the salaries of the city
librarian and assistants aud oilier employees,
which salaries shall be fixed by tbe city coun
cil by ordinance: and order the drawing and
payment of all moneys out of said fund for
such expenditure or liabilities as are herein
authorized, subject to the general provisions
for the payment of demands on the city treas
urer contained in article Ul; and to have the
general supervision, care and custody of
the grounds, rooms or buildings constructed,
leased or set apart for that purpose, and gen
erally to do all lhat may be necessary to
carry out the spirit and Intentof this charter
In establishing a public library and reading
room; provided that all moneys received for
such library shall be deposited in the treasury
of the city to the credit of the library fund",
and shall be kept separate and apart from
other moneys of the city, and shall he drawn
from said fund upon demands authenticated
by the signatures of the president and clerk of
the board, and approved by the mayor and
council in the sanio manner as other demands
drawn upon the general funds of tho city.
All libraries aud reading rooms heretofore
established by said city, and all property, real
and personal, thereto belonging, shall ba
turned over to the charge, custody anil admin
istration of the board of directors, with like
powers and liabilities as if such library haa
been established under this charter.
They Bhall have power and authority to cre
ate a museum in connection with said library
and to appoint a curator therefor, provld-d
that no expense shall be incurred therefor
outside of the funds provided for tho main
tenance of said library.
Sec. 95. Tne police commissioners shall pre
scribe the rules and regulations for the gov
ernment of the police force, tlx and enforce
the penalties for their violation; provided
that removals shall be for cause only.
ccc. 111. The board of tire commissioners
sball prescribe the rules and regulations for
the government of tho department and tlx and
enforce the penalties for their violation, and
removals shall be made only lor cause.
Sec. 120. There is hereby established In and
for the city a department to be known as the
board of health, to consist of five members,
namely: The mayor, who shall be ex-otlicio
member and president of the boird, and four
citizens, to be appointed without regnrd to
their political opinion, by the mayor. Time
of said citizens shsll be physlcianß in gomi
standing and graduates of some reputable
medical college.
Hec. 124. The board shall appoint and may ;
remove at pleasure a health officer, who shall
also act as city physician, and whose duties
as such shall be defined by ordinance. lie
Bhall be a graduate of a reputable medical col
lege, aud shall have practiced medicine at
least three years, and be a citizen and resident
for two yean in the city and have his license
to practice medicine recorded with the county
clerk of Los Angeles county, In accordance
with the laws of the state of California regu
lating the practice of medicine. He must re
side within the city limits, and devote his en
tire time to the duties of his office. The board
shall also, when authorized by ordinance,
have the power to appoint an assistant health
officerand such other officers and assistants as
the sanitary condition of the city may require.
Sec. 192. The said corporation shall have
the right and power to construct, maintain
and operate waterworks, dams, reservoirs,
ditches, canals and other means to conduct
the said waters irom the said river or other
sources, or elsewhere, and lo supply the city
and Its inhabitants with water, and to dis
tribute such water either in zanjas. pipes or
otherwise into, upon and over the landswithln
the limits of said city, or elsewhere; all water
mains by whomsoever hereafter laid in said
city shall be of such material and of such ca
pacity as sball be prescribed by ordinance:
provided, that no sui h main shall hereafter be
laid in said city of less dimensions than four
inches in diameter.
gee. 195. Ceueral municipal elections shall
be held in said city on the lirst Tuesday after
the first Monday in March, 1893, and on tha
first Tuesday after tbe first Monday in March
every two years thereafter, at which Bhall be
elected a mayor, a city attorney, a city treas
urer.
At said election to be held In March. 18911,
there shall also be elected seven members of
tbe board of education from the city at large
and by the electors of each ward of the city
one member of the oity council at each suc
ceding election the members of tbo board of
education and the members of the city council
shall i» elected as in the next section hereof
provided.
Sec. 196. The officers elected at a general
municipal election shall, after they have qual
ified as provided in this charter, enter upon
the discharge oi the duties of the offices io
which tbey nave been elected on the first Mon
day in April succeeding their elect on; aud
the members of the council elected from tne
even-numbered wards in said city shall, after
the first election, serve for the term of two
years, and those elected from the old-num
bered wards in said city shall serve for a term
of four years and thereafter the term of office of
each of the councilmen of said city shall be
for a term of four years. After the first elec
tion the members of the board of education
shall decide by lot who shall serve for four
years and who for two years' .three of said
members to serve for two years and four of
laid members for fiur years), and thereafter
the term of all members of the Doard of educa
tion shall be for lour years.
The other officers of said city elected at said
general municipal election shall serve for two
years, and until their successors are elected
and qualified, except as herein provided as to
councilmen and members of tbe board of edu
cation, and except in case of an election to
till a vacancy at a special election, in which
case they ihall, after qualifying as herein pro
vided, enter atonce on the discharge of the
duties of the office and shall serve for the re
mainder of the term oi such office and uniit
their successors have been elected and quali
fied.
Sec. 197. Special elections shall be held for
the purpose of electing a mayor or any other
officer herein made elective by the people, in
case of a vacancy occurring in any of the said
offices, or for other purposes not especially
provided for. In the event ol any Buch va
cancy, such election shall be ordered and held
without delay; provided that the council shall
In all such cases, except in tho event of a
vacancy in the council, have power to fill auch
vacancy until an election can be hi-Id.
Sec 198. The council shAll have power to
submit to the electors of said city at any elec
tion any question required to be so submitted
by the constitution, the lasrvthis charter, or by
ordinance: provided that In ease such question
1b required by said constitution, law, charter
or ordinance to be submitted at a special or
other particular kind of election, it ihall be so
■übmitted, and not otherwise.
The council may at any special or general
election submit to the vote of the electors to
be offected by any act in queßtion whether
luch act shall or shall not become a law; and
in case a majority of all the votes shall bacast
against an act so submitted then it shall lo
null and void; but iv case a majority of all the
votes shall be cast for such an act it shall be
come a law at such time as the council shall
designate.
Sec. 203. No person shall be eligible to any
municipal office under this charter who, at
the time of his election or appointment is not
a qualified elector of this city under the laws
of the state; and to be eligible to the offices of
member of the council, in addition to the
above qualifications the person elected roust
also have been a resident of the ward from
which be is elected for at least two years pre
vious to said election, and in case any member
of the council sha.l remove from the ward
which he represents his office shall immedi
ately become vacant, and the office shall be
filled as directed ill this charter; provided that
in case a redisricting or redlvision of thecity
into wards be made, whereby the lines or
boundaries of any wards are changed, the last
provision in regard to residence shall not ap
ply to any person elected as a member oi the
council before such change
Sec. 206. The officers of said city, including
the city assessor and city tax and license col
lector, in office at tbe time of the taking effect
of these amendments shall continue to hold
their respective offices, receiving the same
compensation provided for in the oharter un
der which they were elected until the election
or appointment, and qualification of the first
officers to be elected or appointed in their stead
under the provis ons of these amendments:
the assessor and tax and license collector to
serve until the time when the officers elected
at such election go into office, With the powers
and duties vested in and imposed upon them
by the charter under which they were elected,
together with these amendments, and all ordi
nances of thecity; upon the taking effect of
these amendments the mayor shall appoint the
board of building commissioners and the
board of water commissioners provided for
herein. All other boards which have been ap
pointed and are serving at the time of the
taking effect of these amendments shall, unless
sooner removed by the appointing power, con
tinue in office until their successors are ap
pointed by the officers to be elected at the first
general municipal election to be held after the
taking effect of these amendments. In case the
oity council shall decide to have the city taxes
assessed and collected by the county officers,
then and in that case the council may provide
by ordinance what duties shall be performed
by the assessor and tax collector who are In
office at the time of the taking effect of tnese
amendments.
Sec. .07. The city of Los Angeles ihall not
be and ii not bound by any contract, or in
any way liable thereon, union the lame Is
made tn writing by order of tha counoil, the
draft thereof approved by the council and the
same ordered to be, and be, signed by the
mayor, Or some other person authorized there
to, In behalf of tbe city; provided that th
city attorney ihall lndoise the same as to form
and validity. But the council, by an ordi
nance, may authorize any officer, committee
or agent of the city to bind tne city without a
contract in writing for the payment of any
sum of money not exceeding three hundred
dollars.
Hec. 209. Said demands, except demands
payable out of the ichool fund, shall be pre
sented to thecouncil in duplicate on forms
and blanks to be provided by the city clerk,
and shall be referred to lti committee ou
finance. Tho laid committee shall, by in
dorsement thereon, approve or reject the same,
in whole or In part. The council ahall then
consider the said demands and the action of
said committee thereon, and shall, if the same
be just and legal, approve the same; or may, If
11 so determine, approve In part or reject the
whole The action of the council shall be in
dorsed thereon, with the date of such action,
and certified by the signatures of the president
and city clerk; provided that it shall require
the votes of two-thirds of the members ol the
whole council, under a call of the ayes and
noes, and tho vote spread upon the ininines,
to approve any such demand in whole or la
part.
Sec. 213. All demands payable out of the li
brary fund must, before they can be approved
by the city auditor, or paid, be previously ap
proved by the board of directors of the Los An
geles public library, by a voto of three mem
bers thereof taken with the ayes and noes and
spread on the minutes, and the action of Buid
board indorsed on said demand and signed by
the presiding officer and the clerk thereof. After
the approval of said demands they shall be de
livered to thecouncil and shall be referred to
its finance committee and thereafter shall tako
the same course nnd be acted upon In the sanio
manner as provided lor In sections 209, 210
and 211 hereof.
Sec. 214. Any demand returned to the city
clerk, with the objections of either the mayor
or city auditor, shall again be considered by
the council, and if it shall again be approved
by the council by the same vote, and taken,
recorded una endorsed in tlie same manner aa
required In section 201* hereof, the said objec
tion shall be thereby overruled. Any demand
returned to the board of education "with the
objection of tlie city auditor, shall again ne
considered by such board, and if such demand
bo again approved, as required tn thu first in
stance, such objection ot the city audltorshall
bo thereby overruled. Any demand, the ob
jections to which of the mayor have been
overruled, shall be delivered to the city
auditor, who shall have the same power and
perform the same duties in referent:- thereto
as if the same had been approved by the
mayor; aud any demand, the objection to
which of the city auditor has been overruled
by the council or board of education, as the case
may b-, shall be delivered to the elty auditor,
who shsll number and made a record of such
demand, as in the case of demands approved
by him.
Sec. 221. All public moneys collected by
any officer or employee of the city shall be
paid into the city treasury, without any deduc
tion on account of any claim for ices, commis
sions or any other cause or pretense; and the
compensation of any officer, employee or other
person so collecting money, shall he paid by
warrants on the treasury duly issued by the
city auditor.
That the following sections of said chacter ba
repealed, to wit:

That a new section be added to aaid charter
and numbered 229, which section shall be IS
lollows:
.Sec. 229. This charter as amended ahall
take effect from and after its approval by the
legislature.
The foregoing proposed amendments te tba
charter of the city of Los Angeles was adopted
by the council of said city at its meeting of
November 19, 1894, and the clerk was ordered
to publish the same in the manner provided
