PROPOSED AMENDMENT I To the Charter of the City ot Los Angeles The following amendment! to the charter of the City of Loi Angelei, as adopted by Joint resolution No. 2, adopted January :mt, lsßli, are hereby proposed to be iiibmltted to the qualified voter! of said city: The foil wing section! to be amended so ac to read en follows to wit,: SurriOK 2. Sec. ft. All elective officer!, elected at the first general municipal election held, after the ti king effect of this charier, shall hold their ofllcca for the term of twoyeari, commencing on the firit Monday ln April next succeeding their election, except as provided In Sec. 19U of this charter. Sec. l>. Ihe mayor shall appoint the clerk ot the mayor. Tho council shall appoint the city engineer, the city clerk and the stro, t superintendent. B<c. 7. The city scho 1 superintendent ihall be appointed by Ihe board of education. The chief of police ehall be appointed by the board of police commissioners. The chief engineer of the Are department ahall be appointed by the board of tire commissioners. The health officer shall be appointed by the board of health, and thejlbrarian by the directors of the public library. Sec. 9. All appointed officers shall hold office un il removed by the appointing power, whioh ihall have the power of removing in all cases; provided that where confirmation li required the assent of the confirming tody shall be requislto for removal. The council shall have power to suspend any officer of the city pending trial, against whom criminal proceeding! baaed on misdemeanor in office, or civil action for the recovery of money due to the city have been commenced, and the mayor ehall appoint a aubitltute for iuch oasc • during suspension. In voting upon the appointment, confirma tion, suspension and removal of officers the member! of the council, or other body ap pointing confirming, luspending or remov ing, ihall vote by open ballot or call of roll, and the ballot or vote of each member ihall be spread upon the minutea. Sea. Id, Two-thirds of the members of the council shall constitute a quorum for the transaction of business, but no ordinance shall be passed or other act done granting a franchise, making auy contract, auditing any bill, ordering any work to he done, or supplies to be furnlined, disposing of or leasing thecity firoperty, ordering any assessment for itreet mprovement, i r building sewen, or any other act to be done Involving the payment of money, or the incurring of debt by the city, unless two-thirds of the members of the whole council vote in favor thereof. All other ordi nances may be passed by vote of a majority of the whole council. Sec 17. All bonds ot officers muit be ap proved by the council, as alio the bonds of any contractor! with the city, except iuch as are otherwise provided for by the stale law. The city clerk shall indorse upon such bonds the date of their approval, which Indorsement shall be signed by the pre lding officer of the council, and the i itv clerk. Sec, IS. No councilman or other city officer she 1 be Interested, directly or indirectly, in any contract in which tho city li a party, or made by any officer oi tue city on oehait oi the city. Any violation of this section shall be a misdemeanor, and upon conviction thereof, besides the penalty that may be Imposed by a court of competent jurisdiction, the council shall declare the office vacant, and any person convicted of a violation ol this section shall be forever disqualified from holding any office under this chartei. Nor shall auy officer of the city be a surety on any bond given to the city, or to any perion for the benefit of the city. Nor ihall any perion who is Interested ln contract! with the city be a surety on any bond given to the city by auy officer, deputy or employee. Sec 31. The council thall have power, by ordinance, to regulate and provide for lighting oi streets, laying down gas plpei and erection ot lamp posts, electric towers and other ap paratus, and tc regulate the aale and use of gas, water and electric light, and fix the price of gas water and electrlo light, and tha rent of gas, water and electrlo meters within the city, and regulate the Inspection thereof; and to regulate telephone service and the vie of tele phone! within the city, and to fix and deter mine tbe charge • for telephones and telephone eervuee and connection!; and to prohibit or regulate the erection of polei for telegraph, telephone or electric wire In tbe .public ground!, street! or alleys, and the placing of wire thereon; and to require the removal from the public grounds, streets or alleys ot any or all such poles, and the removal and placing under ground of any or all telegraph, tele phone or electric wires. it shall not make any contract for removing garbage, sweeping itreet! and lighting streets for a longer term than two years. And they shall advertise and receive proposals for all •uch contract! not less than six months be fore the expiration cf any such existing con tract. It ihall not within ninety daya next pracadl Ing the date of holding a general municipa electlon nor within the thirty days next Im mediately following, including the day of holding such general municipal election, pass any ordinance, order or resolution granting to any person or persons or association of persons or'corporation whatever, any privilege or franchise for the construction, extension or operation ol any street railroad or extension of time for the construction or operation of any street railroad, over or upon any or part of any street road or highway, square! or park with in tha city. Any franchise or privilege granted or attempted to be granted in violation of or c mrary to the foregoing provision! thall be absolutely void and of no effect. In granting a franchise for construction, ex tension or operation of any itreet isilroad, they shall in addition to the teatrictioui re quire.! by tbe laws of this atate require the canto be run so as to make at leaat fifteen min utes headway, (that is to say they shall run cars at least every fifteen minutes) from 7 a.m. to 10 p. m. and aB often as thirty minutes headway tthat is to s y they shall run cars at least every thirty minutes) from ti a m to 7a. m., and from 10 p.m. to lis p. m. over the entire Hue from starting point lo the end thereof. And they shall also further provide that if at any time for the space of three months the said road or any part thereof shall be unused oa a street railroad and the cara run at least aa often as every fifteen minutes from 7 a. m to 10 p. m , the franchise for the portion or por tions unused shall be tuorchy forfeited and become the property of the city. Sec. 32. It shall, by ordinance, provide for the naming of streets end numbering of houses, and for i emulating and preventing the exhibi tion of banners, flags or placards a rose the street, or sidewalks, and for regulating or sup pressing public criers, advertising, ringing of bells, and other noises. It shall, by ordinance, forbid the erection or display on any building or property of the city, of any banner, device or flag of any state or nation, except that of the United States, the state of California, or the city of Los Angeles. It may, by ordinance, authorize the expendi ture of money not to exceed the sum of one thousand dolltrs, in anyone fiscal year, for the proper celebration of the 4th of July and other public demonstrations. See, 40. The council ahall on the flrat Mon day of October in each year fix the rate of the city taxes, designating the number of cents on each one hundred dollars for each fund, which rate shall then be certified by the oity clerk lo the oounty auditor of Los Angeles county, and the elty taxes of said city shall then be col ected by ths county officers at the same time and in the tame manner that state and oounty taxea are collected, and turned over to the city treasurer who ihall then disburse the same. Provided, that in caie the city council shall at any time, by a vote of all its members, ordain that the city taxes shall be a-seased, levied, equalized and collected by the city officers, the city council sha 1 have power to appoint a city asiessor and a city tax collector, fix their sal aries, aud provide for a system of assessing, levying and collecting ulty taxes aud equalis ing assessment!. All sessions of the council and of any boards of commissions appointed under the provisions of this charter or that may hereafter be ap pointed shall be open to the public. The council shall have full power to paaa ordinencesupou auy other subject of municipal control or to carry into effect any other poweri of the municipality. Sec, 41 'ihe mayor Is the executive officer of the corporation, and must exerolse a careful supervision over ail its affairs. It shall be tha duty of the mayor, annually, at the first meeting of the council under this charter, and on tbe first meeting In January of each year thereafter, tn communicate byTnes ■age to the council a general etatement ot the condition and affairs of the corporation, and to recommend the adoption of such measures as he may deem expedient and proper; and to make such special communication to the coun cil from time to time as he shall deem expedi ent It shall ho his further duty to be vigilant and acllv 1 in the enforcement of the ordinances of the city; to exercise a constant supervision over the acts and conduct of all its otneers and employees; to receive end examine Into all complaints made aganst them for violation or negioct of duty. a d Investigate all bonds of city officials semi annually and certify as to their solvency to the council or proper eoard. 'Iho city auditor shall act as the gen eral accountant and fiscal agent of thecity, and shall exercise a general superintendence over all the officers of the city charged In any I manner with the receipt, collection or dis bursement of the city revenues. He shall keep a complete eet ot books, ln which ho shall set for h In a plaln-and busi ness-like manner every money transaction of the city, so as to show at all times the state of each fund, from what sourco the money was derived, aud for what purpose any money wae expended, and also all collections made and paid Into the treasury by each officer or any other person He shall, on application of any person in debted to the city holding money payable In to tho clly treasury, or desiring to pay money therein, certify to the City Treasurer the amount thereof to what fundappllcable, and by whom to be paid. He shall, upon the deposit of the receipt of the City Treasurer for money paid into the city treasury, charge the C.ty Treasurer with the amount received by him, and give the person paying the same a receipt therefor. It shall be his duty to .pportion among tha several funds all public money at any time in the olty treasury, not by law or ordinance specifically apportioned and appropriated, and forthwith notify the City 'treasurer qf such apportionment or appropriation. He shall countersign and deliver to the proper officer all licenses. Provided that nothing in this section con tained shall be construed as ln any manner in terfering with or affecting the payment ol taxes to the city tax collector, or moneys paid on account of street assessments to the city officer performing the duties of superintendent of streets. The auditor shall prescribe a system of books and records to be kept by each department of the elty government, and a form of monthly reports to be made from each department to the city auditor, showing all business transac tions ol the department, all receipts and die position of material and supplies, tools, etc., to the end, that Iho auditor may have a com plete and accurate knowledge of all the busi ness transactions of the city and ol tha several departments, and be enabled to keep full and accurate records of tbe same, and report monthly thereon to tbe council. This system of books and records of reports ■hall be submitted to the council, and on ap proval by a majority of the council shall at once be put in foroe by tne several officers and departments. And tne aaid aystem of booka, records and reporta ahall not be changed ex cept after the proposed changes have been submitted by the auditor to, and have been approved by the council. Ho shall keep In his office, in a place accessi ble and open at all times during office hours to the publio, a book oontaining an alphabeti cal list of the names of all p rsons who are bondsmen for officer) of the city, giving the namea of the officers for whom they are bonds men and the amount for which they became surety. The city auditor shall ba a skilled ac countant He shall report to the council at tha regular meeting of each week the condition of each fund ln the city treaiury and the amount drawn from each fund the preceding week. He ahall make and present a report to tha council et i s meeting in tbe aecond week of December of each year, showing all financial business transactions of the city for tbe pre ceding year ending the 30th day of November last. He shall audit and approve all demands against the city before payment, and keep a r cord of the same aa hereinafter provided ln Article XXI. He ehall on or before the first day of August ln each year make and preaent to the council a report as to the revenue and expenses of the city for the current fiscal year, in whiob he ■hall set forth estimates of (1) tho revenue from other sources than taxation; (2) the Itemized expenditures; (3| the Itemized amounts necessary to be raised by taxation for each fund. He ahall perform auch other dutiea as ihall be required of bim by this charter or by ordi nance. Ho shall devote his entire time to the duties of his office. Sec. 44. It shall be the duty ot the city treas urer to receive and keen all moneys that shall come to tha city by taxation or otherwise, and to pay tbe same out on demands legally audited lv the manner herein after provided: upon warrants Issued by the auditor, and without such auditing and upon suoh war rants, he shall disburse no publio moneya whatever, except the principal and Interest of the municipal bonded indebtedness whan payable. He ahall receive no money Into the elty treaiury unleu accompanied by the certificate ot the city auditor provided for ln section 43 hereof. He shall Issue receipts ln duplioate to all persons paying money Into the treasury. One of which receipts ahall ba forthwith deposited with the city auditor. He shall make a report at the close of each business day, to the auditor, shewing all money! received during the day, together with the number of each receipt given by him therefor, and what account and from whom received and to what fund applied. He shall, on or before the seventh day of each month, make out and present to the council a full and complete statement of the receipts and expenditures for the preceding calendar month; and he shall make such special report! from time to time ai may be re qulred by the council. The mayor, city attorney, city auditor, the finance committee of the city council, or any apecial committee appointed by the council, ■eparately or collectively, and with the aid of an accountant selected by such officer or com mittee, shall hive the right and power to ex amine the books of the treasurer at all times; and the mayor, auditor or finance committee ehall also have the right to inspect and count all public moneys under the treasurer's con trol, or on deposit elsewhere. Whenever the city shall provide a proper vault and safes in the city hall for the keeping of the city money, the treasurer shall keep said moneya in said vault, except as hereinafter provided. He shall devote his entire time to the duties of his office. He ehall report, at the olose of each buai neas day, to thecity auditor, all receipt!and fiav merits of money made during the day, giv ng the number of the receipt issued or claim paid, tho name of the party paying or who was paid, and the name of the fund charged or credited with such receipt or payment, aa tha case may be. Sec. 43. In addition to other dntles Imposed upon him by this charter or by ordinance ot the council, the city engineer shall: 1. Make or cause to be made all surveys, In spections and eatimatea required by the council. 2. He shall have the exclusive control and supervision nf all publio worka of whatever nature, done by tha city. 3. He (ball have the final decision, (unless otherwise provided by ordinance) as to the proper location of telegraph, telephone, elec tric light and other poles, as well as the proper alignment and depth below the surface of tel ephone, telegraph and electric wires, gas or water pipes or private drains or any other pri vate construction above and below ground in which a decision rests with the city. All such work ia to be performed to his entire satisfac tion. 4. Hs shall appoint all assistant! in field and office which ne may from time to time con sider necessary to tha proper and efficient working of his department. A. He shall have power to suspend, dismiss and reinstate any and all ot the officers or em ployees of hia department. He ahall, with tha approval of the oity council, establish the salaries or wages to be paid auch officers or employe* s. b. He hall appoint all inipectora and fore men aud employ all laborers necessary in hii opinion to carry out effectually any work under hii control. All such inspectors and foremen and laborers shall ba paid such wages ai may he deteiminod by him, with the ap proval of the city council. They ihall be sub ject to suspension or dismissal by him with out notice, as the interests of the city may aeem to require. 7. lie ihall cause a weakly return to be made to him of all workme,. employed and material used during the week, a>a uf the amount, de scription and cost of th* work done, and he shall examine and certify aii bills against the city for material and labor ut -vvmtract work under hjs control. 5. The water overaeer ihall hare the general charge, care and supervision of all i watera and water work! belonging to the city, and the distribution of laid waters, so far as the same ihall be entrusted to him by ordl ' nence, and shall perform iuch other and fur ther duties as may be prescribed by ordi nance. The street superintendent (hall have the general care of, and frequency Inspect the streets of, the city. He shall receive and ln v itlgate all complaints as to their condition, and ehall bare charge ot the enforcement ot all ordinances pertaining to street obstruc tions. He shall frequently Inspect all publio works pertaining to street Improvement while the ■ame are ln oouneof construction, Inspect and approve or reject all material used ln such construction, whether done by contract or oth erwise; and ihall at once report to the council all deviations from contracts and uae of Im proper material and bad workmanship ln such works; and shall have th-. power, pending in vestigation, to stop all work thereon. It shall be the duty of the mayor, city attorney, city treasurer, chief of police, cliy auditor, health officer, water overseer, city clerk, city engineer, superintendent of build ing!, chief engineer of the fire department, city school superintendent, board of directors of the Loi Angelei public library, board of park commissioners ana the board of water com mi sioners, each to present to the council at its meeting in the second week in December of each year, a report for the preceding year end ing 30th of November last, which ihall ahow aa follows: (1) The city attorney shall, in his report, present an abstract oi all actions and proceed ings ln the supreme and superior courts, where the city Is an interested party; and shall show what cases have been disposed of during the year, and in what manner, and the condition of those remaining on the calendar. (2) The city treasurer shall show, ln his re port, specifically, the amount oi all indebted ness of the city; of money received by him during the year, the date of receipt thereof and from whom; the amount paid out, when, and to whom; and the date and number of the demands on which the respective amounta are paid. (3) The olty auditor shall make a proper statement of tbe tranaaotiona of hia office, aa provided in section 43. (4) The chief of police shall report the num ber of arrests made by him, the offenses charged and how disposed of, the number and names of the policemen employed, when ap pointed and when discharged, and all money and other property received Irom prisoner* and the disposition oi the same, 5. The health officer shall ihow the condi tion of the health of the city during the year, and the number of caiei of diseases which he has treated; and other matters of intereat per taining to hii office 6. The report of the city engineer shall show the character, cost and condition of all publio works and improvement! in course of con itruction during the year. B. The report of the superintendent of build ings shall show the coit of erection, alteration and repair of all bu ldings during the year; aud shall ihow also the general reault of hii in ipection of buildings during tbe year. The report of the city school superin tendent ihall show the number and condition of the public schools, the number of teacher* and their salaries and the number of pupili ln attendance. 13. The report of the board of director! of the Loi Angelei publio library ehall ihow the condition of their trust for the year ending the 30th day of November of that year; the vari ous sums of money received from the libiaiy land and from other sources; for what pur pose such money has been expended, snd the amount so expended and the balance on hand; . - the number at books a-d nsriodieal* on hand; th* cumber added by purchase, gift or other wise during the rear; the number lost or missing; the number of visitors attending; the number of books loaned out, and the gen eral character and kind of such books, with such Information and suggestions as it may deem of general Interest. 14. The report of the park commissioners ihall show the condition of the parks, with the kind, cost and tho expense ot the Improve ments, including the entire cost and expense of the department for the year ending Novem ber 30th last preceding. Bee. (il. The following named officers of laid city shall respectively execute to said munici pal corporation bonds ln the following sums respectively, conditioned for the faithful dis charge by them of the duties of their respective offices, to wit; The bond of the city auditor is fixed at $10, --000. The officers of the city ihall receive in full compensation for all services ol every kind whatever rendered by them, the follow ing salaries, payable ln monthly installment!, at tbe end of each calender month: The mayor ihall receive $3000 per annum. Each councilman ihall receive $1200 per annum. The city clerk shall receive $2400 per an num. Tho city auditor ahall receive $2400 par annum. Thecity treaaurer shall receive $2400 per annum, The city engineer ahall receive $3000 per annum. The city attorney shall receive $3000 par annum. The superintendent of building! shall re ceive $1800 per annum. The chief oi police ihall receive $3000 par annum. The health officer ihall receive $2000 par annum. The street superintendent shall receive $2000 per annum' Sec 09. The government of the achool de partment of the city shall be vested in a board of education, to consist of leven perions to be elected as herein provided, to be called mem bers of the board ol education, who shall serve Without salary. Sec. 70. The board of education ihall eleot one of its number president, and ihall hold regular meeting at least once in each month, and special meeting! at such timei as shall be determined by a rule of laid board. A majority of all the member! ahall conitltute a quorum for the transaction of business, but a smaller number may adjourn from time to time. The board may determine the rules of its proceed ings. Its sessions shall be public, and its re cord! shall be open to public inipection. Sec. 71, The board of education succeed! to all the property right! and to the obligation! of the board of education of the city of Loi Angeles heretofore existing, and it shall have lole power: 1. To establish and maintain publio echools, Including high schools, to change, consolidate and discontinue the lame, and to eitabllsh school districts, and to fix and alter the boundaries thereof. 2. To appoint or employ and dismiss the elty ■chool superintendent, a deputy lunerintend ent, a clerk and iuch teacher!, janitors, school census marshals, mechanic!, laborers and other emp oyeei as may be necessary to carry Into effect the poweri and duties of the board; to fix, alter and allow their itlariea or wagei, and to withhold for good and sufficient cause, the whole or any part of the salary or wages of any person or persons employed as aforesaid. 3. To make, establish and enforce all neces sary and proper rules and regulation! for the government of publio school!, the teachers tbereof, pupils therein, and for carrying into effect the laws relating to education; also to establish and regulate the grade of schools, and determine what text-books, course of itudy and mode of instruction ihall be used ln •aid schools. 4. To provide for the school department fuel and lights, water, blanks blank book!, print ing and stationery; and to incur such other incidental expenses as may be deemed neces sary by said board. ft. To build, alter, repair, rent and provide school houses, and to furnish them with proper ichool furniture, apparatus and ap pliance!. ti. To take and hold ln fee, or otherwise, in trust for the city, any and all real estate and personal property that may have been ac quired, or may hereafter be acquired, for the use and benefit of the public echools of the city; and to sell or exchange and to lease any of such property; provided that the proceeds of any such sale or exchange shall be exclu sively applied to the purchase of other lota, or tbe erection of school houses. 7. To grade, fence and improve all school lots, ana ln front thereof to grade, sewer or' pave and repair the etreets, and to construct and repair sidewalks. 8. To sue for any and all property belonging to or claimed by the said board of education, and to prosecute and defend all actions at law or in equity necessary to recover and main tain the full enjoyment and possession of laid property, and to require the service! ot the city attorney, free of charge, in all such cases. 0. To determine annually tbe amount of money required for the support of the public ■chools and for carrying into effect all the pro visions of law ln reference thereto; and, in pursuance of thii provision, the board shall, on or before the 15th day of July of each year, Eubmit ln writing: to the city council a careful estimate oi the whole amount of money to bo received irom the state and connty and the amount required from the olty for the above purposei, and the city council ihall, ln each year, fix the percentage of taxei to be levied and collec ed for ichool purposei; provided, that the amount to be thus levied for school purposes shall not exceed twenty centa on each one hundred dollars' valuation upon the assessment ro 1, and that when collected It ■hall be paid into the school fund. 10. To establish regulations for the jnst and equitable disbursement ot all moneyi belong ing to the school fund. 11. To examine and approve, in whole or ln part, ln the manner provided in Section 212, every demand payable out of the school fund, or to reject any iuch demand for good cause. 12. '1 o discharge all legal Incumbrances now existing or which may hereafter exist upon any •ehool property. 13. To prohibit any child under ilx yean ol age from attending the public schools. 14. In its discretion to establish kindergar ten schools for the instruction of children be tween the ages ot five and six years, and Indus trial and manual training schools or depart ment!. 15. To receive and manage property or money acquired by bequest or donation in trust for the benefit of any school, educational purpose, or school property. Hi. And generally to do and perform inch other acts as may be necessary and proper to carry into force and effect the powers conferred on said board, and to Increase the efficiency of the public schools in said city. 17. No member of the board ot education ehall, during the term for which he shall have been elected, be eligible to any office to be filled or confirmed by the board ot education, nor shall any member of the board ot educa tion be selected to fill any vacancy that may occur in any office when suoh vacancy is to be filled or confirmed by the board of education. Sec. 72. All contract! for building ihall be given to the lowest bidder thereof, offering adequate security, to be determined by the board after due public notice, published for not less than ten days in the official newspaper of the city. It shall be the duty of the board to furnish all necessary supplies for the publio schools. All supplies, books, stationery, fuel, printing, good!, material, merchandise, re pairing and every other article and thing sup plied to or done tor the public schools, or any of them, when the expenditure to be Incurred on account of such matter may exceed three hundred dollars, shall be done or furnished by contract let to the lowest bidder after like pub lic advertisement; provided, that the board oi education may reject any and all bids under thia section. Provided, that the board oi education may by requisition authorize any appointee, com mittee or agent of said board to bind the said board for the payment of any sum of money not exceeding three hundred dollars; which requisition shall be approved by a two-thirds vote of said board, spread upon the minutes previous to the incurring of the indebtedness. Bee. 77. The aaid achool fund ihall be used and applied by said board ol education tor the following purposes, to wit: 1. For the payment of the aalariea or wagea •f the luperintoudent, deputy superintendent, clerk, teachers, Janitors, ichool censua mar shals, and other persons who may be employed by said board. 2. For the erection, alteration, repair*, rent and furnishing of school houses. 3. For the purchase money or rant ot any real or personal property purchased or leased by aaid board, 4. For the discharge oi all legal Incum brances on any achool property. 5. For lighting the achool rooms and the offices and rooms of the superintendent aud board of education. ti. Foriupplylug the schools with tuel, water, apparatus, blanks, blank books, and necessary school appliances, together with books lor in digent children. 7. For supplying books, printing and sta tionery for the use of the superintendent and board of education, and for the incidental ex penses of the department. 8. For grading and improving all achool lots, and for grading, sewering, planking,or paving and repairing atreeta, and constructing and repairing sidewalks in front thereof. Sec. 83. The mayor ahall appoint a board of five dlreotora for »id library, who shall serve without compensation and be known ai the heard oi director! oi tha Lo* Angelas public library, and who shall be chosen from the citizens at large, male or female, without re gard to their political opinions, bat with raier ence to their fitness lor said office, and no member of the city council shall be a member of the board. Sec. 86. Such board, by a majority ot all the members, to be recorded ln the minutes with the aye* and noes at length, shall have power to make and enforce all such b7-lawi. rules and regulations as may be necessary or expe dient for Its own guidance, and for the admin istration, government and protection of iuch library, reading room and property; to deter mine the number of officers and assistanti to be appointed for such library and reading room, and to determine aud define their du ties, to appoint a librarian and necessary as sistants, and such other employees aa may be necessary, and, for good cause, to remove them; except the payment of the salaries of the city librarian and assistants and other employee!, which salaries shall be fixed by the city coun cil by ordinance: and order the drawing and payment of all moneys out of said fund for iuch expenditure or liabilities ai are herein authorized, lubject to the general provision* for the payment of demand! on the city treas urer oontained in article 21; and to have the general lupervislon, care and custody of the grounds, rooms or buildings constructed, leased or let apart for that purpose, and gen erally to do all that may be necessary to carry out the spirit aud intentof thli charter ln establishing a publio library and reading room; provided that all moneyi received for iuch library ihall be deposited ln the treaiury of the city to the credit ot the library fund, and ihall be kept eeparate and apart from other moneyi of the city, and shall be drawn from said fund upon demands authenticated by the signature! of the president and clerk of the board, and approved by the mayor and council in the same manner as other demands drawn upon the general funds of tho city. All libraries and readiug roomi heretofore established by eaid city, and all property, real and personal, thereto belonging, shall be turned .vyer to the charge, cuitody and admin istration of the board of directors, with like Sowers and liabilities as if such library haa een established under this charter. They shall have power and authority to cre ate a museum ln connection with said library and to appoint a curator therefor, provided that no expense ihall be incurred therefor outside of the fundi provided for the main tenance of laid library. Sec. 95. Tbe police commlseloncrs shall pre scribe the rules and regulations for the gov ernment of the n ol!ce force fix and enforce the penalties for their violation; provided that removals shall be for cause only. fcec. 111. The bosrd of fire comralssionera shall prescribe the rules and regulation! for the government of the department and fix and enforce the penalties for their violation, and removal! ehall be made only for cause. Sec. 120. There is hereby established ln and for the city a department lo be known as the board of health, to consist of five members, namely: The mayor, who mall be ex-orficio member and president of the board, and four i citizens, to be appointed without regard to i their political opinion, by the mayor. Three ofiaid citizens shall be physicians ln good ■landing and graduate! of aome reputable | medical college. Sec. 124. The board ihall appoint and may remove at pleasure a health officer, who ahall also act aa city physician, and whose duties ■8 such ihall be defined by ordinance. He ahall be a graduate of a reputable medical col lege, and shall have practiced medicine at least three years, and be a citizen and resident for two years in the city and have hia license to practice medicine recorded with the connty clerk of Loi Angelei county, in accordance with the laws of the state of California regu lating the practice of medicine. He must re- Bide within the city limits, and devote his en tire time to the duties of hia office. The board shall also, when authorized by ordinance, have the power to appoint an assistant health officer and such other officers and assistants as the sanitary condition of the city may require. Sec. 192. The laid corporation ihall have the right and power to construct, maintain and operate waterworks, dams, reservoirs, ditches, canals and other means to conduct the said watera from the aaid river or other ■ources, or elsewhere, and to supply the city and Iti inhabitant! with water, and to dis tribute such water either in zan jus, pipes or otherwise into, upon and over the lands within the limits of laid city, or elsewhere; all water mains by whomsoever hereafter laid ln taid oity shall be of iuch material and ot such ca pacity ai shall be prescribed by ordinance: firovided, that no such main ihall hereafter be aid in said city of less dimensions than tour inches in diameter. Sec. 195. General municipal election! ahall be held ln said city on the flrat Tuesday after the first Monday in March, 1896, and on the first Tuesday after the firit Monday in March every two yean thereafter, at which ihall be elected a mayor, a city attorney, a city treas urer. At said election to be held ln March, 1896, thero shall also be elected leven members of the board of education from the city at large and by the electors of each ward of the city one member of the city council ateachiuc ceding election the member* of tbe board of education and the memberi of tbe city council ihall ba eleoted as in the next lectioa hereof provided. Sec. 196. The officer! elected at a general municipal election Bhall, after they have qual ified as provided in thli charter, enter upon the discharge ot the dutiei of the offices to which they have been elected on the fitst Mon day in April succeeding their election; and tho members of the council elected from the even-numbered wards in said city Bhall, after the first election, serve for the term of two years, and those elected from the odd-num bered wards ln said.city shall serve for a term of four yean and thereafter the term of office of each of the councilmen of eaid city shall be for a term of four years. After the firit elec tion the members of the board of education shall decide by lot who shall lerve for four years and who for two years tthree ofiaid members to serve for two yean and four of ■aid members tor four yean), and thereafter the term of all member! of the Doard ot educa tion shall be for four years. The other officers of said city elected at said general municipal election shall serve for two years, and until their successors are elected and qualified, except as herein provided as to councilmen and members of the board of edu cation, and except ln case of an election to fill a vacancy at a special election, in which case they shall, after qualifying as herein pro vided, enter at once on the discharge of the duties of the office and shall serve for the re mainder of the term of auch office and until their successors hare bean elected and quali fied. Sec 197. Special elections shall be held for the purpose of electing a mayor or any otber officer herein made elective by the people, ln case of a vacancy occurring in any of the eaid offices, or tor other purposes not especially provided for. In the event ot any iuch va cancy, such election shall be ordered and held without delay; provided that tho council ihall in all such cases, except ln the event of a vacancy in tbe council, have power to fill auch vacancy until an election can be held. Sco 198. Tbe council shall have power to submit to the elector! of laid city at any elec tion any queition required to be so submitted by the constitution, the law, this charter, or by ordinance; provided that ln caie such question is required by said constitution, law, charter or ordinance to be submitted at a special or other particular kind of election, it ihall be ao ■übmitted, and not otherwise. The council may at any apecial or general election submit to the vote of tbe electors to be affected by any act in question whether iuch act ihall or shall not become a law; and in case a majority of all the votes shall be cast against an act so submitted then It shall be null and void; hut la case a majority of all the votes shall bo cast for such an act it shall be come a law at auch time aa the council ahall designate. Sec. 203, No person shall be eligible to any municipal office under this charter who, at the time of his election or appointment is not a qualified elector of this city under the laws of the atate; and to be eligible to the offices of member of the council, in addition to the above qualifications the person elected must alao have been a resident of the ward from which he is elected for at least two yean pre vious to said election, and in case any member of the council ahail remove from the ward which he repreaenta his office «h*U immedi ately become vacant, and the office ahall be filled as directed in this charter; provided tbat in caae a redistrictlng or redivlslon of the city into wards be made, whereby the lines or boundaries ot any wards are changed, the last provision in regard to residence Bhall not ap ply to any person elected as a member of the council before auch change. Seo. 206. The officers ofiaid city, including the city assessor and city tax and licenae col lector, ln office at the time of the taking effect of these amendment* shall continue to hold their reipective offices, receiving the same compensation provided for ln the charter un der which they were elected until the election or appointment, and qualification ot the firit officers to be elected or appointed in their stead under the provis om of these amendment!; the assessor and tax and licenae collector to serve until the time when the officer! eleoted at such election go Into office, with the powers and duties vested in and imposed upon them by the charter under which they were elected, together with these amendment!, and all ordi nance! of thecity; upon the taking effect of theae amendments the mayor shall appoint the board of building commlnioneri and the board of water commissioners provided for herein. All other boards which have been ap pointed and are serving at the time of the taking effect of these amendments shall, uclen sooner removed by the appointing power, con tinue in office until their lucceuori are ap pointed by tbo officers to be elected at the first general municipal election to be held after the taking effect of these amendment*. In case the city council shall decide to have the city taxe* assessed and collected by the county officers, then end in that case the council may provide by ordinance what duties shall be performed by the assessor and tax collector who are ln office at the time of the taking effect oi the** amendments. Sec. 207. The city oi Lo* Angeles ihall aot be and li not bound by any contract, or la any way liable thereon, unlesa tht made In writing by order of th* oouncil, th* draft thereof approved bj th* council ana the lame oraered to be, and be, elgned by the mayor, or come other perion authorized there to, ln behalf of the city; provided that th' city attorney ahall lndoue the Mine aa to form and validity. But the council, by an ordi nance, may authorize any officer, oommittee or agent of the city to bind the city without a contract in writing for the payment of any aum of money not exceeding three hundred dollars. Sec. 209. Said demands, except demand! payable out of the ichool fund, ihall be pre sented to the council in duplicate on forms and blanki to be provided by the city clerk, and shall be referred to it* committee ou finance. All demanda payable out of the li brary fund must, before they can he approved by the city auditor, or paid, be previously ap proved by the board of directora of the Los An geles public library, by a vote of three mem bers thereof taken with the ayes and noei and spread on the minutes, and the action of said board indorsed on said demand and signed by the presiding officer and the clerk thereof.
