Bee. n, AH elective officers, elected at tho first general municipal election bold after ihe t iltlug effect of this charter, shall hold their offices for the term ot two years, commencing on tb* first Monday In April next succeeding their election, except a* provided In Hec. 190 of this charter. Sec. li. The mayor shall appoint th* clerk ot the mayor. The mayor shall appoint the fol- L.wlng officer*, subject to continuation by a majorlti of ihe rounc.il, to wit: Tho city aud itor, tiie superi' itnirieiit ot buiiuiiiga, the members of the police, park and Are commis sions, the members of the board of health, the building commissioners and the directors of ihe Los Angeles public library. The council shall appoint theclty engineer, the city clerk and the street superintendent. Sec. 7. The city scho 1 superintendent shall be appointed by the board of education. The chief of police shall be appointed by the board of police commissioners. The chief engineer of the flro department shall bo appointed by the board of fire commissioner*. Th* health officer ahull be appointed by the board of health, and the librarian by tne directors of the public library. Bee. 11. All appointed officers ahall hold office un il removed by the appointing power, which shall have the power ot removing iv all cases; provided that where confirmation is required the assent of the confirming tody shall be requisite for removal. Th* couucll *h*ll have power to • uspend any officer of the city pending trial, against whom criminal proceedings based on misdemeanor in office, or civil action for the recovery of money due to the city have been oommenced, and the mayor shall appoint a substitute for such o*o ■ during suspension. In voting upon ih j appointment, confirma tion, suspension and removal of officers the member* of tha council, or other body ap pointing confirming, suspending or remov ing, shall vote by open ballot or call of roll, and th* ballot or vote ol each member shall be spread upon the minutes. Sea Id. Two-thirds of the members of tha council ahall constitute a quorum for th* transaction of business, but no ordinance •hall be passed or other act done granting a franchise, making any contract, auditing any bill, ordering any work to be dove, or supplies to be furnished, disposing of or leasing the city property, ordering any assessment lor street improvement, or building sewers, or any other act to be done involving the payment ot money, or the incurring of debt by the city, unless two-thirds of the members of the whole council vote in favor thereof. All other ordi nance* may be passed by vote of a majority of the whole council. Sec. 17. All bond* ol officer* must be ap proved by the council, as alio the bonds of any contractors with the city, except Such as arc otharwlse provided for by the state law. Tha city clerk snail indorse upon such bonds the date of their approval, which indorsement •hall be signed by the pre lding officer of the Council, and the i ity clerk. Bee. 18. No councilman or othor city officer ■ha 1 b* interested, directly or Indirectly, in any contract In which the city Is a party, or made by any otfloer nf the city on behalf of the city. Any violation of this section shall be a misdemeanor, and upon conviction thereof, besides the penalty that may be imposed by a court of competent jurisdiction, the council shall declare the office vacant, and any person convicted of a violation ol this section shall be forever disqualified from holding any office under this chartei. Nor shall auy officer of the city be a surety on any bond given to tha city, or to any person for tha benefit of the city. Nor (hall any person wbo I* Interested In contract* with the city be a surety on any bond given to the city by auy officer, deputy or employee. Sec. 31. The council shall have power, by ordinance, to regulate and provide for lighting of streets, laying down gas pipe* and erection of lamp posts, electric tower* and other ap paratus, and to regul*t* the sale and us* of gas, water and electric light, and fix the price of gas water and electric light, and the rent of gas, water and electric meter* within the city, and regulate the inspection thereof; and to regulate telephone service and th* use of tele phones within the city, and lo flx and deter mine the charge- for telephones and telephone service and connection*; and to prohibit or regulate the erection of pole* for telegraph, telephone or electric wire In tbe public ground*, street* or alley*, and th* placing of wire thereon; aud to require the removal from the public grounds, streets or alley* of any or all such poles, and the removal and placing Under ground'of any or all telegraph, tele phone or electric wires. It shall not make any aontract for removing f arbage, sweeping streets and lighting street* or a longer term than two years. Aud they ■hall advertise and receive proposals fur all such contract* not less thau six months be fore the expiration of any such existing con tract. It shall not within ninety days next preccdl Ing the date of holding a general municlpa elc-ction nor within the thirty days next im mediately following, including the day of holding such general municipal election, pass any ordinance, order or resolution granting to any person or parsons or association of person* or corporation whatever, any privilege or franchise for th* construction, axtensinn or operation of any street railroad or extension of time for th* construction or operation of any street railroad, over or upon any or part of any street road or highway, square* or park with in th* city. Any franchise or privilege granted or attempted to be granted In violation of or c n.rary to tha foregoing provision* shall ba absolutely void and of no effect. In granting a frauchise for construction, ex tension or operation of an? street lailroad, they shall tn addition to the restrictions re quire! by the law* of this state require the canto be run so as to make at least fifteen min utes headway, (that is to say they shall run car* at least every fifteen minutes from 7 a.m. to 10 p. m. and as often as thirty minutes headway tthat Is to a y they shall run cars at least every thirty minutes) from d a m to 7a. m., aud from 10 p. m. to 12 p. m. over the entire line from starting point to tha end thereof. And they shall also further provide that it at any time for the space of three months the said road or any part thereof shall be unused as a street railroad and the cars run at least as ofton as every fifteen minutes from 7 a m to 10 p. in., the franchise for the portion or por tions unused shall be tuereby forfeited and become th* property of the city. Sec. 32. It shall, by ordinance, provide for the naming of sircets and numbering of houses, and for regulating and proven ting the exhibi tion of banners, flags or placards a ross tha street, or sidewalks, and for regulating or sup pressing public criers,.advertising, riugiug of bell*, and other noises. It shall, by ordinance, forbid the erection or display on any building or property of tha city, of any banner, devlco or flag of any state or nation, except that of the United states, the state of California, or the city of Lo* Angoles. It may, by ordinance, authorize the expendi ture of money not to exceed the mm of one thousand doll .rs, in any one fiscal year, for tha proper celebration of the 4th of July and other public demonstrations. tec. 40. Thacouncl'shall on th* firat Mon day id October in each year flx the rate of the olty taxes, designating the number of cents on each one hundred dollars for each fund, which rate shall then be certified by the city clerk to the county auditor of Los Angeles county, and ihe olty taxes of said city shall thenbecol ect-d by the county officers at the sam* time and in the tame manricr that state and county taxes are collected, and turned over to 'he city treasurer who shall then disburse the same. Provided, that In case the city council ahall at any time by a vol* of all its members, ordain that theclty taxes shall be a sessed, levied, equalized and collected by the city officers, the city council sua 1 have power-to appoint a city assossocandacity tax collector, tlx their sal aries, and provide for a system of assessing, levying aud collecting city taxes aud equallx lng-assessment*. ■ > All sessions ot the council and ot any boards of commissions appointed under the provision* of this charter or tbat may hereafter bo ap pointed shall be open to tb* public. Sec. 41 The mayor Is the txeautlv* offlcar of ihe corporation, and must axareiaa a careful supervision over all Iti attain. It ibill be the duty of th* mayor, annually. at the first meeting o! th* conncil under this charter, and on the firat meeting In Januarrof eaoh year thereafter, to coromuntc*te byffies sage to th* council a general statement ol the condition and affairs of the corporation, and to recommend the adoption of such measures as he may deem expedient and proper; and to make such special communlction to the coun cil from time to time aa he shall deem expedi ent It shall be his further duty to be vigilant and actlv., in the enforcement of the ordinances of tho city; to exercise a constant supervision over the acts and conduct of all its ofticers and employees; to receive and examine into all complaints made against them for violation or neglect of duty. and liivo-tigato all bonds of city officials semi annually and certify as to their solvency to the con mil or proper noard. And ho shall perform such othor duties and have such other power* as are elsewhere in this chaiter or by ordinance, Imposed upon or gianted to htm. Sec. 43. The oily auditor shall act as the gen eral accountant and fiscal agent of the city, and shall exercise a general superintendence over all the offleers of the city charged In any manner with the receipt, collection or dis bursement of the city revenues. lie shall keep a complete set of books, In which ho shall set for li In* plain and busi ness-like manner every money transaction of the city, so as to show at all times the state of each fund, from what source the money was derived, and fur what purpoae any money was expended, and also all collections made and paid into th* treasury by each officer or any other person He shall, oo application of any person in debted to the elty holding money payable In to tne city treasury, or desiring to pay money therein, certify to the City Treasurer the amount thereof to what fundappllcable, and by whom to be paid. He shall, upon the deposit ot the receipt of the city Treasurer for money paid Into the city treasury, charge the C.iy Treasurer with the amount received by him, and give the person paying the same a receipt therefor. It shall be his duty to pporlton among the several funds all public money at any time In the city treasury, not by law or ordinance specifically apportioned and appropriated, and forthwith notify the City Treasurer of such apportionment or appropriation. He shall countersign and dollvor to th* proper officer all licenses. A or collectable bytm city or 'any ollicer, em ployee or department thereof, must be paid direct to the city treasurer, th* order of the auditor directing the city treasurer to receive the nme, and specifyihg the fund to which It shall be charged, having first been obtained. Provided that nothing lv this section con tained shall l>r construed as in any manner in terfering with or affecting the payment ol taxes to the city tax collector, or moneys paid on account of street assessment* to the city officer pc : forming the duties superintendent of streets. Tbe auditor shall prescribe a system of books and records to be kept by each department of the city government, and a form ot monthly reports to be made from each department to the city auditor, showing all business transac tions of the department, all receipts ana dis position of material and supplies, tools, etc., to the end. that ihe auditor may hase a com plete and accurate knowledge of all the busi ness transactions of tbe city and of the several departments, and be enabled to keep full and accurate records of tiie same, and report monthly thereon to the council. This system of books and reecrds of reports shall be submitted to the council, and on ap proval by a majority of the council shall at one* be put in foroe by tne several officers and deoartment*. And tne said system of books, records and report* shall not bo changed ex cept after the proposed changes have been submitted by the auditor to, and have been approved by tbe council. No warrant* for salary, In favor of any olty official or employee, shall be approved by the auditor until all report* required of such offi cer or employe* by the city system of accounts hereinbefore provided for, shall have boon made. He shall keep In hi* office, tn a place accessi ble and open at all times during office hours to the publio. a book containing an alphabeti cal list of th* names of all p rsons who are bondsmen for officer* of the city, giving the names of the officers for whom they are bonds men and the amount for which they becam* surety. < The city auditor ■hall b* • •killed ac countant. He shall report to the council at th* regular meeting of each week th* condition of each fund In the city treasury and the amount drawn from each fund tb* preceding week. Heshallmak* and present a report to the council at i.s meeting in the second week of December of each year, showing all financial business transactions of the city for the pre ceding year ending the 30th day of November last. He shall audit and approve all demand* ■gainst the olty before payment, and keep a r cord of the same as hereinafter provided In Artlclo XXL He shall on or before the first day of August in each year make and present to the council a report as to the revenue and expenses of the city for tbe current fiscal year, in which he shall set forth estimates of (1) the revenue from other souroes than taxation; (2) the' Itemized expenditures; (Si the itemized amount* necessary to be raised by taxation for each fund. He shall perform such other duties a* shall be required of him by this cbarter or by ordi nance. He shall devote hi* entire time to the duties of his .office. Sec. 44. it shall be tbe duty of tb* city treas urer to reoelve and keep all moneys that shall com* to the city by taxation or otherwise, and to pay the aame out on demand* legally audited In the manner herein after provided; upon warrants issued by the auditor, and without such auditing and upon such war rants, he shall disburse no publio moneys whatever, except the principal and Interest of the municipal bonded indebtedness when payable. He shall receive no money Into th* elty treasury unless accompanied by the certificate of the city auditor provided for In section 43 hereof. He shall issue receipts In daplioata to all persons paying money Into the treasury. One of which receipts shall be forthwith deposited with tha city audi or. He shall make a report at the close of **eh business day, to the auditor, showing all money* received during tbe day, together with the number of each receipt given by him therefor, and what account ana from whom received and to what fund applied. He shall, on or before the seventh day of eaoh month, make out and present to the council a full and complete statement of the receipts and expenditures for the preceding calendar month; and he shall make such special reports from time to time a* may be re quired by tbe council. The mayor, city attorney, olty auditor, the finance committee of the city conncil, or any special committee appointed by the council, separately or collectively, and with the aid of an accountant selected by such officer or com mittee, shall have the right and power to ex amine the book* of the treasurer at all times; and the mayor, auditor or finance committee shall also have the right to inspect and count all public moneys under tho treasurer's con trol, or on deposit elsewhere. Whenever the city shall provide a proper vault and safes in the city hall for the k- eping of the city money, the treasurer shall keep said money* in said vault, except as hereinafter provided. ■ He shall devote his entire time to the dutle* of his office. He shall report, at the close of eaoh busi ness dny, to the city auditor, all, receipts and payments of money made during trie day, giv ing the number, of the receipt issued or claim paid, the name of the party paying or who was paid, and the name of the fund charged or credited with such receipt or payment, as th* case may be. Sec. 49. In addition to other dutle* Imposed upon him by this charter or by ordinance of the council, the city engineer shall: 1. Make or cause to be made all surveys. In spections and estimates required by the council. . 2. He shall have tbe exclusive control and supervision of all publio Work* of whatever nature, done by the city: 3. All such work is to be performed to his entire satisfac tion. 4. Ha shall appoint all assistants in field and office which he may from tim* to time con sider necessary to the proper and efficient working of his department. f>. He shall have power to suspend, dismiss and reinstate any and all of the officers or em ployees of hi* department. He shall, with th* approval ot the city council, establish the salaries or wage* to be paid such officer* or employe, s. li. Ha hall appoint all inspectors and fore men and employ all laborers necessary In hia opinion to carry out effectually any work under hi* control. All such Inspectors and foremen and laborers shall be paid such wages a* may b* determined by him, with the ap proval of the city council. They shall be *uo ject to suspension or dismissal by him with out notice, aa tha Interests of the city may seem to require. .7. The mayor snail appoint three citi zens, two of whom shall bo architects in good standing and who shall have practiced their profession not less than three years in thiscity, all of whom shall serve without compensation, to constitute the board of hni ding commission ers of the city. Sec. 51. The water overseer shall have the general charge, care and supervision of all waters and water works belonging to the city, and the distribution of said waters, so far as the same shall be entrusted to himbyordi nence, and shall perform such other and fur ther duties as may be prescribed by ordi nance. He shall devote his entire time to the duties of the office. All the waters and water works of the city, both for irrigation purposes as well as for do mestic and manufacturing purpo-es, shall b* under the control of a water commission of three (3) citizens tj bo appointed by the mayor by and with the approval of the Common Council, not more ihan two of whom shall be long to the same political party, and all pow ers vested in the water overseer, as fo tho man agement, sale and distribution of such water and general charge thereof shall be vested In said water commission. Bee. 57. The health officer shall have power* and perform such duties a* are herein or may by ordinance be granted loor be imposed upon him. Both he and his deputies shall devote their entire time to the duties of I heir office. Sec 58. It shall be the duty of the mayor, city attorney, city treasurer, chief of police, ciiv auditor, health officer, water overseer, city clerk, city ongineer, superintendent of build ings, chief engineer of the fire department, city school superintendent, board of director* of the Los Angeles public library, board of park commissioners and the board ol water com ml sioners, each to present to the council at its meeting in the second week in December of each year, a report for the preceding year end ing 3(>th of November last, which shall show as follows: (1) The city attorney shall, In hi* report, present an abstract of all actions and proceed ings in the supreme and superior courts, where the city Is an interested party; and shall show what cases have been disposed of during the year, and In what manner, nnd the condition ol those remaining on the calendar. (2) The city treasurer shall show, In his re port, specifically, the amount of all indebted ness of the city; ol money received by him during the year, the date of receipt thereof and from whom; the amount paid out, when, and to whom; and the date and number of the demands on which the respective amounts aro paid. (3) The city auditor shall make a proper statement of the transaction* of bl* office, a* provided in section 43. (4) The chief ol police shall report the num ber ol arrests made by him. th* offenses charged and how disposed of, tne number and names of the policemen employed, when ap pointed and when discharged, and all money and other property received Irom prisoner* and the disposition ol the same, 5. The health officer shall show the condi tion ol the health of thee ty during the year, and the number of cases of diseases which be has treated; and other matters ol interest per taining to hia office. ti. The water overseer shall, in hi* report, ■how the amount of water rates or charges collected by him; and shall make a detuiled statement of the condition ol the water syst-ms oi the city, so far as tho same are entrusted to bis charge. 7. The report ol the city clerk shall show the ni mber ol licenses issued, and lor what amount. 8. The report ol the city engineer shall show the character, cost and condition ol all publio works and improvements in course of con struction during the year. 9. Tho report ol the superintendent of build ings shall show the cost of erection, alteration and repair of all buddings during the year; and shall show also the general result of his in spection of buildingsdurlng the year. He shall report also the number of building permits is sued by him. 10. The street superintendent shall report upon the condition of the streets of the city and the Improvement* of the same during the year; and shall show what action was taken by him in the enforcement ol ordinances per taining to street obstructions and in regard to devifttiom Irom contract in the construction ol publicworks. 11. The report of the chief engineer ol the fire department shall show the condition ol the fire department a d its apparatus, giving a detailed statement [hereof; also the work ol the department during the year. VI. The report ol the city school superin tendent shall show tho number and condition of the public schools, the number ol teachers and their salaries and tbe number ol pupils In attendance. 13. The report ol the board of director* ol the Lob Angeles public library shall show tbe condition of their trust for the year ending the 30th day of November ol that year; tbe vari ous sums of money received from the llbraiy fund and Irom other sources; for what pur pose such money h*a be«n expended, and the amount so expanded and tha balance on hand; tb* nuiabar *v books aud Mriodlaala an bond; the numher added by purchase, gift or other wise during the year; the number lost or missing; the number ot visitors attending; tho number of books loaned out, and the gen eral character and kind of such books, with such information and suggestions as it may deem of general Interest. 14. The government of the school de pnrtmvnt of the city shall be vested in a board of education, to consist of seven persons to b* elected as herein provided, to be called mem bers of the board ol education, who shall serve without salary. Bee. 70. The board of education shall elect one of its number president, and shall hold regular meeting at least once In each month, and special meetings at such times as shall be determined by a rule of said board. A majority of all the members shall constitute a quornm f rr the transaction of business, but a smaller number may adjourn from time to time. The board may determine the rules of its proceed ings. Its sessions shall be public, and its re cords Bhall be open to puolic inspection. Pec. 71. The board of education succeeds to. all the property right* and to the obligations of the board of education of the city of Los Angelea heretofore existing, and it shall have sole power: 1. To establish and maintain public schools, Including high schools, to change, consolidate and discontinue the same, and to establish school districts, and to fix and alter the boundaries thereof. 2. To appoint or employ and dismiss the city school superintendent, a deputy superintend ent, a clerk and such teachers, janitors, school census marshals, mechanics, laborer* and other emp oyees as may be necessary to carry into effect the powers and duties of the board; to fix, alter and allow their salaries or wages, and to withhold for good and sufficient cause, the whole or any part of the salary or wages of r.ny person or persons employed a* aforesaid. 3. To make, establish and enforce all neces sary and proper rules and regulation* for the government of publio schools, th* teachers thereof, pupils therein, and for carrying Into effect the laws relating to education; also to establish and regulate th* grade of schools, and datermine what text-books, course of itudy am mod* of instruction shall be used In ■aid schools. 4. To provide forth* school department fuel and lights, water, blanks blank book*, print ing and stationery; and to incur such other incidental expenses a* may be deemed neces sary by said board. 6. To build, alter, repair, rent and provide school houses, and to furnish them with proper school furnitura, apparatus and ap pliances. ti. To take and hold In fe*. or otherwise. In trust for the ctty, any and all real estate and personal property that may have been ac quired, or may hereafter be acquired, for the use and benefit of the public schools of the city ; and to sell or exchange and to lease any of Btichp ope ty; provldod that the proceeds of any Buch sale or exchange shall be exclu sively applied to the purchasoof other lots, or the erection of school houses. 7. To grade, fence and improve all school lots, and in front thereof to grado, sewer or pave and repair the streets, and to coustruct and repair sidewalks. 8. To sue for any and all property belonging to or claimed by ihe said board of education, and to prosecute and defend all action* at law or in equity necessary to recover and main tain th i full enjoyment and possession of said property, and to require the servioea ol the city attorney, free of charge, In all suoh cases. it. To determine annually th* (mount of money required for tbe support of the public schools and for carrying into effect all the pro visions of law in reference thereto; and, in pursuance of this provision, the board shall, on or before the 15th day ol July oi each year, submit in writing to the city council a careful estimate of the whole amount ol money to be received from the state and county and the amount required from the city for tbe above purposes, and the city council shall. In each year, fix the percentage of taxe* to be levied and collec ed for school purpose*; provided, that tbe amount to be thus levied for school purposes shall not exceed twenty cent* on each one hundred dollars' valuation upon the assessment ro 1, and that when collected it •ball be paid,into the school fund. 10. To establish regulations for the Just and equitable disbursement of all money* belong ing to the school fund. 11. To examine aud approve. In whole orln part, in the manner provided in Section 212, every demand payable out of the school fund, or to reject an? such demand for good cause. 12. 1 o discharge all legal Incumbrances now existing or which may hereafter exist upon any school property. 13. To prohibit any child under six yeari ot age from attending tne public schools. 14. In its discretion to establish kindergar ten schools for the instruction ol children be tween the ages of live aud six years, and Indus trial and manual training schools or depart ments. 15. To receive and manage property or money acquired by bequest or donation in trust for the benefit of any school, educational purpose, or school property. 111. And generally to do and perform such other acts as may be necessary and proper to carry into force and effect the powers conferred on said board, and to Increase the efficiency of the public schools in said city. 17. Mo member of the board of education shall, during the term for which he shall have been elected, be eligible to any office to be filled or confirmed by the board of education, nor shall any member ol the board ol educa tion be seltcted to fill any vacancy that may occur In any office when such vacancy Is to be filled or confirmed by the board of education. Sec. 72. All contract* for building ahall b* given io the lowest bidder thereof, offering adequate security, to be determined by the board after due public notice, published for not less than ten days in the official newspaper of the city. It shall be the duty of th* board to furnish all necessary supplies for the publio schools. All supplies, books, stationery, fuel, printing, goods, material, merchandise, re pairing and every other article and thing sup plied to or done for the public schools, or any of them, when the expenditure to be Incurred on account ol such matter may exceed three hundred dollars, shall be done or furnished by contract let to the lowest bidder after like pub lic advertisement; provided, tbat tbo board of education may rejeot any and all bid* under this section, Provided, that the board ol education may by requisition authorize any appointee, com mittee or agent of said board to bind the said borird for the payment of any sum ol money not exceeding three hundred dollars; which requisition shall be approved by a two-thirds vote ol said board, spread upon the minutes previous to the Incurring ol the Indebtedness. Bee. 77. The said school fund shall be used and applied by said board of education for the following purposes, to wit: 1. For the payment ol the salaries or wages ot the superintendent, deputy superintendent, clerk, teachers, janitors, school census mar shals, and other person* who may be employed by said board, 2. For tbe erection, alteration, repair*, rent and furnishing of school house*. 3. For the purchase money or rent of any real or personal property purchased or leased by said board. 4. For th* discharge ol all legal Incum brances on any school property. 5. For lighting the echool room* and the offices and rooms of tha superintendent and board of education. ti. For supplying the schools with fuel, water, apparatus, blanks, blank books, and necessary ■cbool appliance*, together with book* for in digent children. 7. For supplying books, printing and sta tionery for th* use ol the superintendent and board ol education, and for the incidental ex pense* of the department. 8. For grading and Improving all echool lots, and for grading, sewering, planking, or paving and repairing street*, and constructing ana repairing sidewalks In front thereof. Sec. 83. The mayor ahall appoint a board of five directors for said library, who shall serve without compensation and be known as th* award of director* ol th* r-oi AvaUi public library, and who shall b» chosen Irom th* citizens at large, male or female, without re gard to their pol itic.il opinions, but with rn.er ence to their fitness lor aaid office, anf no member of the city council shall be a member of the board. Such board, by a majority of all the members, to be recorded In the minutes with the ayes and noes at length, shall have power to make and enforce all such by-laws, rules and regulations as may be necessary or expe dient for its own guidance, and for the admin istration, government and ptotection of such library, reading room and property; to deter mine the number of officers and assistants to be appointed for such library and reading room, aud to determim aud define their du ties, to anpoint a librarian and necessary as sistants, and such other employees as may be necessary, and. for good cause, to romove them; except the payment of the salaries of the city librarian and assistants and other employees, uich salaries shall be fixed by the elty coun cil by ordinance: and order the drawing and pay-tent of all moneys out of said fund for such expenditure or liabilities as are herein authorized, subject to the geneial provisions for the payment of demands on the city treas urer contained in article 21; and to have the general supervision, care and custody of the grounds, rooms or buildings constructed, leased or set apart for that purpose, and gen erally to do all that may be necessary to carry out the spirit aud intent of this charter in establishing • public library and reading room; provided that all moneys received for such library shall be deposited in the treasury of the city to the credit ot the library lund, and shall be kept separate aud apart from other moneys of the city, and shall be drawn from said fund upon demands authenticated by tho signatures of the president and clerk of the board, and approved by the mayor and council in the same manner as other demands drawn upon the general funds of the city. All libraries and reading rooms heretofore established by said city, and all property, real and personal, thereto belonging, shall be turned over to the charge, custody and admin istration of the board of directors, with like powers and liabilities as if such library haa been established under this charter. They shall have power and authority to cre ate a museum in connection with said library and to appoint a curator therefor, provld d : that ito expense shall be incurred therefor outside of the funds provided for the main- | tenanceofsald library. , ■cribe the rules and regulations for the gov ernment of the police force fix nnd enforce the penalties for their violation; provided that removals shall be for cause only. fcec. 111. The board of (ire cord oners shall prescribe the rules and regulntio.is for the government of the department and tlx and enforce tho penalties for their violation, and removals shall be made only for cause. Sec. 120. There Is hereby established in and for the city a department to be known as the board of health, to consist of five members, namely: Tho mayor, who shall be ex-ouicio member and president of the boird, and four citizens, to be appointed without regard to their political opinion, by the mayor, 'lime of said citizens shell be physicians in good standing and graduates ot some reputable medical college. Sec. 124. The board shall appoint and may remove at pleasure a health officer, who shall also act as city physician, and whose duties as such shall be defined by ordinance, lie shall be a graduate of a reputable medical col lege, and shall have practiced medicine at least three years, and be a citizen and resident for two yean in the city and have his license to practice medicine recorded with the county clerk of Los Angeles county, in accordance with the laws of the state of California regu lating the practice of medicine. He must re side within the city limits, and devote Uu en tire time to the duties of his office. The board shall also, when authorized by ordinance, have the power to appoint an assistant health officer and such other officers and assistants as the sanitary condition of the city may require. Sec. 102. The said corporation shall have the right and power to construct, maintain and operate waterworks, dams, reservoirs, ditches, canals and other means to conduct the said waters from the said river or other sources, or elsewhere, and to supply th* city and its inhabitants with water, and to dis tribute such water either in zanjas, pipes or otherwise into, upon and over the lands within the limits of said city, or elsewhere; all water mains by whomsoever hereafter laid In said city shall be of such material and of such ca pacity as shall be prescribed by ordinance: provided, that no such main shall hereafter b* laid in said city of lea* dimension* than four inches in diameter. Sec. 195. General municipal elections shall be held in aaid city on the first Tuesday after th* first Monday In March, 1896, and on th* first Tuesday after tbe first Monday in March every two years thereafter, at which shall be elected a mayor, a city attorney, a city treas urer. At said election to be held in March, 1898, there shall also be elected seven member* of the board of education from the city at large and by the electors of each ward of the city one member of the city council at each suc ceding election the members of the board of education and the members of the city council shall lie elected as in the next section hereof provided. Sec. 196. The officers elected at a general municipal election shall, after they have qual -1 illed as provided in this charter, enter upon the discharge ot the duties of tiie offices to which they nave been elected on the first Mon day in April succeeding their election; and the members of tbe council elected from the even-numbered wards in said city shall, after the first election, serve for the term of two years; and those elected from the odd-num bered wards in said city shall serve ior a term of four year* and thereafter the term of office of each oi th* councilmen of (aid city shall be for a term of four years. After the first elec tion the members of th* board of education shall decide by lot who shall serve for four years and who for two years ithree of said members to serve for two years and four of said members for four years), and thereafter the term of all members of the ooard of educa tion shall be for four years. The other officers of said city elected at said general municipal election shall serve for two years, and until their successors are elected and qualified, except as herein provided as to councilmen and members of the board of edu cation, and except In case of an election to fill a vacancy at a special election, in which case they shall, after qualifying as herein pro vided, enter at once on the discharge of the duties of the office and shall serve for the re mainder of th* term of suoh office and unat their successors have been elected and quali fied. Sec, 197. Special elections shall be held for the purpose of electing a mayor or any other officer herein made elective by the people, in case of a vacancy occurring In any of the said offices, or for other purposes not especially provided for. In the event ol any such va cancy, such election shall be ordered and held without delay; provided that the council shall in all such cases, except in the event of a vacancy in the council, have power to fill such vacancy until an election can be held. Sec 198. The council shall hay* power to submit to the electors of said city at any elec tion any question required to be so submitted I by the constitution, tne law, this charter, or by ordinance; provided that in case«uchquestion is required by said constitution, law, charter or ordinance to be submitted at a special or other particular kind of election, It shall be so submitted, and not otherwise. The council may at any special or general election submit to the vote of tbe electors to be affected by any act In question whether such act shall or shall not become a law; and in case a majority of all th* votes (ball b ■ cast against an act so submitted then It shall 1 o null and void; but lv cose a majority of all the votes shall be cast for such an act it shall be come a law at such time as the council shall designate. Sec. 203, No person sball be eligible to any municipal office under this charter who, at the time of his election or appointment 1* not a qualified elector of this city under the laws ol the state; and to be eligible to the offices of member of the council, in addition to tbe above qualifications the person elected must also have been a resident of the ward from which he is elected for at least two years pre vious to said election, and in case any member of tho council shad remove fiom the ward which he represent* his office shall Immedi ately become vacant, and the office shall be filled a* directed in this charter; provided that in oase a redistricting or redivi»ion ol the city into wards be made, whereby the lines or boundaries ol any wards are changed, the last provision in regard to residence shall not ap ply to any person elected as a member ol th* council before such change Sec. 206. Tbe officers of said city, Including the city assessor and city tax and license col lector, in office at the time ol the taking effect ol these amendments shall continue to hold their respective offices, receiving the same compensation provided ior in the charter un der which they were elected until the election or appointment, and qualification oi the first officers to be elected or appointed in their stead under the provis ons of these amendments; the assessor and tax and license collector to serve until the time when the officers elected at such election go Into office, with tha powers and duties vested in and imposed upon them by the charter under which they were elected, together with these amendments, and all ordi nances of the city; upon the taking effect ol these amendments tbe mayor shall appoint the board of building commissioner* and the board of water commissioners provided for herein. All other board* which have been ap pointed and are serving at tb* time of the taking effect of these amendments shall, unless sooner removed by the appointing power, con tinue in office until their successors are ap pointed by tbe officers to be elected at the first general municipal election to be held after the taking effect of these amendments. In cose the city council shall decide to have the city taxes assessed and collected by th* county officers, then and in that case the council may provide by ordinance what duties shall be performed by the assessor and tax collector who are In office at the time ol the taxing effect ol the** amendments. Sec. 207. Th* olty ol La* Angeles ahall act b* and 1* not bound by aay contract, or la any way llabl* thereon, unit** th* same Is m*d* in writing by order of th* council, the draft thereof approved by th* council and the same ordered to be, and be, signed by the mayor, or some other person authorized there to, in behalf of the city; provided that th' city attorney shall lndoise tbe same as to form and validity. But th* council, by an ordi nance, may authorize any officer, committee or agent of the city to bind tbe city without a contract tn writing for the payment of any sum ni money not exceeding three hundred dollars. Sec. 209. Bald demands, except demands payable out of the school fund, shall be pre sented to the council in duplicate on forms and blanks to be provided by the city clerk, and shall be referred to Its committee ou finance. The said commlttc* shall, by In dorsement thereon, approve or reject the same, in wholj or in part. The council shall then consider the said demands and the action of said committee thereon, and shall, if the same bo just nnd legal, approve the same; or may, if it so determine, p.pprove in part or reject the whole The action of the council shall bo In dorsed thereon, with the date of such action, and certified by the signatures of the president and city clerk; provided that it shall require thevutcsof two-thirds of the members of tn* whole council, under a call of the ayes and. noes, and the vote spread upon the minutes, to approve any such demand in whole or la part. Sec. 213. All demands payable out of the li brary fund must, before they can be approved by the city auditor, or paid, be previously ap proved by tho board of directors of the I-os An geies public library, by a vote of three mem bers thereof taken with the ayes and noes ami spread on the minutes, and the action of said board indorsed on said demand and signed by the presiding officer and tho clerk thereof. After the approval of said demands they shall be de livered to thecouncil and shall be referred to its finance committee and thereafter shall teko the same course and be acted upon in the same manner as provided lor in sections 209, 210 and 211 hereof. Sec. 21*.
