This complaint Is brought under sec tion 70 of the general sanitary ordinance of this city, which section reads as fol lows: "All milk sold or offered for sale with in the limits of the city of L,os Angeles shall conform to tbe standard herein- 1 after fixed, und the health officer or the Inspector shall base his Inspection of milk on said standard, which is here by fixed and adopted as follows: The specific gravity of milk shall not be less than 1028; the amount of solids In milk shall not lie less than 12 per cent there of; the amount of cream by weight shall not be less than :i per cent thereof, or by volume not less than 8 per cent there of; the amount of water shall not be more than .88 percent thereof." Such being the contention. It Is nec essary to consider whether or not suld section 70 Is void upon the ground of be ing unreasonable in its provisions or operation. It appears ln evidence that the results of the examination of over 25,000 sam ples of milk aryl cream In the city of Chicago that the specific gravity varied from 1.028 to 1.034, the average being 1.081; tin- total solids from 10.X5 per cent to 115.27 percent, the average being 12.50 per cent; the fat from 2.04 per cent to 6.17 per cent, the average being 3.65 per cent; the cream from 2 per cent to 26 per tent. It will be observed that the specific gravity provided by said section 70 is 1.028, the lowest ot said tests; that the amount of solids required Is 12 per cent, being 50 per cent below the average of said tests; that the butter fat required is 2 per cent, being 65 per cent below the average of the Chicago tests. It also appears that the milk received at a creamery In this city averaged about 3.50 pei- c.-ut of butter fat, but. that much of it averaged about -i pet cent, and some of it averaged 2.08 and 2.09 per cent. Also that while the aver age amount of cream in tlie milk of the orange county dairies is considerably higher than in tht! vicinity of this city, yet it occasionally goes as low as 2.08 per cent there; so it conclusively ap pears that pure milk in this vicinity may not contain more than 2.0S per cent J of cream by weight. j It also appears, according to the I official reports received by the health I department of this city, that there is | no city, so far as known, ln the United States having a regulation of this kind, which fixed the percentage of cream I by weight at less than 3 per cent, and I that most of them ure higher, varying I from 3.20 to 2.50 per cent. It is conceded that this ordinance Is ' n. sanitary regulation, and that the City I council has a right to adopt some such I a regulation, but it is contended that I the standard adopted in this ordinance I is so high that It is unreasonable.
