Sec. 214. The Chief of Police may detail for detective duty, such mcmbcrß of the department as he may select not to ex oeed a number to be approved by the unanimous vole of the hoard. He shall designate a Captain of Detectives to act as Captam over the. officers so detailed. Suoh Captain nf Detectives shall rank ns Captain of Police, and his duties shall be defined by the board and the Chief of Po lice. The numbers so detailed for de tective duty shall be known and ranked as detectives,. They muy be removed al any time from such detail by being re stored to their former rank, by tho Chef of Pollco. Their duties shull ba defined by the rules and regulations of the board, by tho orders of tho Chief of Police and by the ordcis of the> Captain of Detective*. Bee. 215. Tho Police Force of tho city, exclusive of subordinate officers, shall not he lees In number than one police officer for each one thousand inhabitants thereof; •uch number of Inhabitants to bo ascer tained by tha last census taken either un der national, stata or municipal author ity. Sec. 216. Every police officer shall, upon the arrest of ony person charged with the commission of crlmo, search tho person of sue h offender, nnd take from him all prop erty and weapons, and forthwith deliver the same to Ihe prison-keeper, who must deliver the samo to tho Property Clerk, to be by him kept until other disposition ba mado thereof according to law. Sec. 217. All promotions in the dopart ment shull bi from the next lower lank, seniority of service and meritorious public service being considered. Sec. 218. Any member of tho department guilty of any offense or violation of rules snd regulations, shall be liable to be pun ished by reprimand, or by tine to be fixed by the boarei or by dismissal from Ihe department; but no fine shall ever be Im posed at any one time for any offense ex ceeding ono month's salary. Sec. 219. No member of the department shnll be subject to dismissal for any OBUse. or to punishment for snv breach of duty or misconduct therein, except nf ter a fair and impartial trial before the board upon a verified complaint, filed with the board, setting forth specifically tho •cts complained of, and after such reason able notice to him of the time und place of hearing ns the board may by rule pre scribe; provided that any such com plaint signed by the Chief of Pollco or by tho board or a member thereof, need not be verified. The accused shall be entitled upon such hearing to appear personally, and such hearing shull be conducted in all respects in accordance with such gen eral regulations as the board may. by res olutions entered upon its minutes, from time to tlmo adopt. Sec. 220. All property or money token under suspicion of having been stolen, or feloniously obtained, the result of crlmo or constituting tho proceeds of crime; nnd all property or money taken from Intoxi cated or Insane persons, or other persons Incapable of taking care of themselves; or property, or money lost or abandoned, thst muy In nny way come Into the pos session or custody of any member of the department, or of any Criminal Court of the city or Judge thereof, shall bo deliv ered to the Property Clerk, who shall en ter in a record book, to bo kept by him for thnt purpose, a full and explicit descrip tion of the same, together with the name of the person or persons from whom re ceived, the names of any claimants there to, the time of the seizure and the final disposition thereof. Sec. 223. If any property or money In the custody of tho Properly Clerk be re quired as evidence in uny court, it shall be delivered to any officer who shull pic sent nn order ln wilting to thut effect from such court, and the clerks of such court shall be responsible for the safe de livery of suidi property or money to the Properly Clerk. Sec. 224. All valuables and money In the custody of the Propeity Clerk, sliall be deposited by him for safe keeping with tho City Treasurer in such manner, nnd subject to such rules and regulations as may bo preset Ibcd by tha board, and ap proved by the Council. Sec. 225. Upon request, in writing, found ed upon resolution of the Board of Trus tees of any society incorporaled and ew lstlng under the provisions of tho Act of the Legislature of the State of California entitled. "An act for the more effectual prevention of cruelty to animals," up proved March 20th, 1574, or under tho pro visions of an Act of said Legislature en titled, "An act for the Incorporation of so cieties for prevention of cruelty to chil dren," approved April 3rd, IS7H. ihe Chief of Police shall detail a pollee officer of the department to be known as the Humane Officer, to perform all ot the duties of a special officer of either or both of the said societies within the limits of tho Clly of Eos Angeles; provided, thai thoreshall not be nt any one time more than one of ficer so detailed. Sec. 220. The sold officer shall, under eue-h rules and regulations as the Chief of Police shnll from time to time provide, In tho premises, report to and act under the direction of tho officers of the said society, or of either of them, which shall have petitioned for his appointment, as above provided, nnd which shall have by resolution, accepted him as such special officer after such detail rmd appointment made by the Chief of l'qllce, as aforesaid; provided that the ultimate authority over the said Officer Shall be vested In the Chief of Police, and in case of difference of opinion between him-and the officers of such society or societies as to the duties to be performed by such officer or tho manner of their perform ance, the decision of the Chief of Police In such matters shall be final. Sec. 227. The Chief of Police shall have from time to time, sole power of revok ing the detail of such officer and substi tuting another police officer ln his place. Sec. 228. The Board of Police Commlssloneis ls h-reby vested with power and authority to construct and maintain such system, and It ls hereby mado the duty of the Council to provide sufficient funds thoro for. Sec. 229. The Board of Police Commis sioners, the Chief of Police and tho sever al officers and employees of the police de partment shall exercise such other powers and be subject to such other duties not In conflict with this chatter as are or may lie prescribed by ordinance of tho Council or by general law. ARTICLE XXI. / POLICE COURTS. Sec. 230. The iudlclal power of the city shall be vested In such police courts, and In such Justice's courts (the latter to be vested with both civil and criminal juris diction) and In the Judges of all such infe rior courts, us are now, or may hereafter be, piovlded by the Legislature. ARTICLE XXII. i|P FIRE DEPARTMENT. Sec. 231. Tho Fire Department and all property appertaining thereto shall be under the management anel conttol of the Hoard of Fire Commissioners, consisting of five members, who shall bo appointed by tho Mayor, each of whom shall Borve without compensation. No person shall bu appointed as Fire Commissioner who shall not have been nn elector of tho city for at least five years next preceding his appointment. Sec. 232. The Board shall never bo so constituted as to contain moro than three members of the same political par ly. Tho term of ofllce of tho Commis sioners shall bo four years. ThOße first appointed shall so classify themselves by lot that they shall respectively go out of office, one at the ond of ono year, ono nt the end of two years, one at tho end of three years, and two at the ond of four years. Sec. 233. The commissioners Bhall or ganize by electing one of their number President, who shall hold ofllce for one year. The board shall appoint a Secre tary, not of their nnmbor, who shall be clerk of tho department and Secretary of the hoard, and shall keep all accounts and records of the department and of the relief and penßlon fund, and perform such duties as the board may prescribe. The board shall meet once a week and as often as tho business of the department may require, and all Its meetings shall be public. Sec. 234. The board Bhall organize the department, create and establish such fire companies ns it may deem necessary, appoint and prescribe the number and duties of the officers,' members and em ployees of the department and the uni form and bndges to be worn by them, have control of all property, buildings and equipments of the department and the purchase, erection and repairs there of, and exercise full power and authority over all appropriations mnde for the uso of tho department, and over all expendi tures of all moneys for tho use thereof. The board shall classify the service and make the rules for appointments and pro motions under tho civil service require ments of this chartor, and shall enforce all ordinances affecting flra Interests re lating to fire limits, boring for oil, stor age of hny. fire escapes, erection of en gines, establishment of laundries, shops and factories and all matters which by ordinance have been or may be entrusted to tho board. The salaries of all officers and employees of Ihe department, except when prescribed by this charter, shall be fixed by ordinance. Sec. 235. The board shall make such rules and regulations as may be neces sary to secure discipline and efficiency of the department; and for any vtolotlon of such rules and regulations may im pose reasonable lines upon officers, mem bers and employees of the department, reprimand, reduce In grade or dismiss, or suspend any of them, ns iho board may by rule proßcrlbe. Such fines shall ba de ducted from the monthly warrants of the officers, members nnd employees upon whom they are imposed and Bhall bo transferred by tho Treasurer to the Fire man's Relief and Pi-nelon Fund. Sec. 236. No member or employee of tho Fire Department, except callmen, shall bo engaged ln any other employ ment. Seo. 137. The Board shall,. Immediately upon their appointment and qualifica tion, proceed to organize the Firo De partment in accordance with the provis ions of fhis charter, and in so doing the board shall moke Its appointments of of ficers and members from the persons constituting the force In the service of the Fire Department nt the time this charter goes into effect. Such officers and members shall not be required to pass any civil service examination. All future appointments and promotions shall be made by the board, subject to the provisions of Article XXVII of this charter. Bee. 235. No officer, member or em ployee shnll bo reduced In rank, fined or dismissed, except for cause, nor until after a trial. The accused shall be fur nished with n written copy of tho charges against him, at least three days previous to tho trial. Ho shall have the right to appear ln person and examine witnesses ln his behalf. All witnesses shall be ex amined under oath and all trials shall bo public. Sec. 239. When any officer, member or employee shall become temporarily disa bled by reason of Injuries received while ln the actual performance of his duties, so as lo incapacitate him from perform ing his duty, the board may allow any or nil of his salary during tho continuance of such temporary disability. Sec. 240. The board shall see that all contracts awarded and work done for the department are faithfully performed and ehall. upon the owardlng ot any such contracts, exact an adequate bond for Iho prompt and faithful performance of the samo. Tho provisions of Article XIV of this charter shall, so ror as the same eun be made applicable, apply to all pro posals and contracts made, awarded or entered Into for the erection and repairs of buildings and apparatus and for fur nishing supplies to tho department. Any contract made ln violation of any of the provisions of this charter 6hall be void. The board shall cause to be made exact property returns from each company oi division, which shall Bhow ln detail all stores and property received, used and remaining on hand for each quarter, and shall enter the Issuance of each artlclo to each company or division ln appropri ate books. Sec. ga, Tho board shall appoint a Chief Engineer, who shall have control of tho department under the board. He shall be charged with the special duty of superintending the extinguishment of fires. The Chief Engineer shall be tho chief executive officer of the department, and It shall be his duty to see that all laws, orders and regulations ln feres in the city or mode by tho board concerning the department, aro enforced. Soc. 242. The Chief Engineer may sus pend any subordinate officer, member or employee of tho department for incom petency, or any violation of the rules and regulations of the department, and shall forthwith report ln writing such suspen sion, with his reasons therefor, to the board fot their action. He shall vigilant ly observe the condition of tho apparatus and workings of the department and re port ln writing thereon at least once a month to the board ond make such rec ommendations and suggestions respect ing tho same as he may deom proper. Sec. 243. The Chief Engineer may, dur ing a conflagration, cause to bo cut down, or otherwise removed, any building or structure for the purpose of checking the progress of such conflagration. Sec. 241. The Council shall have power, whenever In Its Judgment it shall ba proper, to provide by ordinance for a TBE PBOPOSED CITY CHASTER Firemen* Relief Fund, and make the necessary rules and regulations for its maintenance and application. Bee. 243. The board shall bo authorized to receive nil donations for the benefit of the department and lo apply the same for the purpose donatod. Soc. 246. Tho hoard, on the written rec ommendation of the Board of Directors of Iho corporation lenown as the Under writers' Flro Patrol of Los Angeles, may appoint such persons as may be recom mended by said Board of Directors, as Fire Marshal and Assistant Flro Marshal. Vacancies occurring In the ofllce of Fire Marshal or Assistant Flro Marshal shall be filled ln tho same manner. The sala ries of said Fire Marshal and of his as sistant and deputies shall be fixed and paid by said Board of Directors of said Underwriters' Flro Patrol of Los Angolos, and in no event shall tho city bo liable therefor, or for any part thereof. Tho Flro Murshal shall report to and ba sub ject to the ordors of tho Flro Commls sionors, and may be discharged by them for cause In the samo mannor aa herein provided for other employees. Sec. 147. Tho Fire Marshnl, or in case of his disability, tho Assistant Fire Mar shal, shall attend all flras which may oc cur In the city, and he shall take charge of and protect all property which may be Imperiled thereby. Sec. 24R. The Flro Marshal may call upon policemen during the time of any fire for the purpose of protecting prop erty until the arrival of the owner or claimant thereof, and In case the owner or claimant of such property does not take chare* of th" Bame within twenty four hours, the Fir* Marshal may havo such property stored at tho owner's or claimant's expense and risk. Soc. 213. The Fire Marshal shall b» charged with tho enforcement of all laws and ordinances relating to the Btorage, sala nnd use of oils, combustible materi als and explosives, together with the In vestigation of the cause of all fires. In all cases where there is reason to believe that fires tire the result of crime, or that crlmo has been committed In connection therewith, the Fire Marshal must report Ihe same in writing to the District At torney. The Fire Marshal shall also have the care of, and may sell, subject to the orders of the board, all property saved from fire, for which no owner can ba found, and at once pay the amount realized from any such sale Into the city treasury. '"*■ ARTICLE XXIII. ~~ DEPARTMENT OF ELECTRICITY. Bac. 250. Thoro Is hereby created a Department of Electricity which shall havo charge of tho construction and maintenance of tha fire alarm and pollco telegraph and telephone systems, city lighting and power systems and all other electrical appliances belonging to tho city, and shall be under the control of tho Board of Flra Commissioners. Sec. 251. There shall be appointed by the said board a practical and skilled electrician who Bhall be called the City Electrician and who shall have general supervision of the Department of Elec tricity, including electric lighting and power, fire alarm and police telegraph and telephone systems. Sec. 252. The said board shall- appoint, subject to the provisions of Article XXVII of this charter, the City Electrician and such assistants and employees as may be necessary to maintain and keep tho elec tric and telephone systems ln working order. Sec. 253. Tho Bonrd of Fire Commis sioners and the Board of Pollco Commis sioners shall each have supervision and management of the electric systems and wires of their respective departments. Soc. 254. Any citizen, firm or corporation may, for the purpose of police or fire pro tection, be connected with the police or fire signal systems or telephone or tele graph systems, with the consent of the fire or police hoards, a-- the case mny be, upon making fair payment for the connec tion and use thereof. Such rates of pay ment shall be fixed by ordinance of the Council, but no connection shall be made so as to Interfere with the use of the sys tems by the police and fire departments. Sec. 255. The City Electrician Is also charged with the duty of enforcing all the rules, regulations, orders and require ments made by ordinance of the Council in regard to the inspection and supervi sion of electrical wires and appliances, and tho currents for furnishing light, hoot snd power ln or upon, the streets and buildings ln the city. Sec. 256. The Board of Flra Commis sioners, when authorized by ordinance, shall appoint an electrician from the de partment of Electricity, as Inspector of Electric Wiring and Appliances, who shall serve as n deputy in the office of the Su perintendent of Buildings. He shall per form nil the duties of Electric Inspector and shall issue all permits nnd make all Inspections pertaining theieto as provid ed by ordinance, and keep a record of the samo and report all permits Issued lo tho Superintendent of Buildings. He shall collect the charges Tor permits and Inspections and deposit the funds received with the Treasurer. All permits issued by him shall be countersigned by the Au ditor. ARTICLE XXIV. DEPARTMENT OF PARKS. Bee. 267. All lands and real property lo cated In or belonging to the City of Los Angeles which have been heretofore or which may be hereafter set apart or dedi cated for the use of the public as public parks, pleasure grounds, or nny boule vard that may hereafter be dedicated or constructed for the purpose of connecting any of said parks, shall be under tbe ex clusive control and management of a Board of Commissioners who shall be known and designated as Park Commis sioners. Sec. 255. The Commissioners shall be five ln number. They shall bo appointed by tho Mayor for a term of four years \ and shall receive no compensation for their services. They shall so classify themselves by lot that one of them shall go out of office at the end of one yoar, ono at the end of two years, one at tho end of three years, and two at the end of tour years. Sec. 259. The Commissioners shall or ganize by electing ono of their number President, and they may elect a Secretary, who ls not a member of the Board. The Board shall establish rules and regula tions for Its government nnd for tho per formance of its duties, and for tho con- 1 duct of Its officers and employees, and shall require adequate bonds from all of them, except laborers, for the faithful performance of their duties ln such sums as may ba fixed by it. The«person elected President shnll hold his ofllce for one year, or until his successor ls elected. The Board must hold regular meetings at least once a month, and as many special meet ings ns II may deem proper. Three of tho Commissioners shall con stitute a quorum for the transaction of business. Tho Board shall have the cx cluslvo authority to purchase all articles and materials, nnd to procure all work and labor ln this department, and to make contracts therefor. No contract shall be entered Into authorizing the expenditure ot money without tho approval of the Board. Every- contract exceeding two hundred dollars ln amount shall be open to public competition, unless ths Board shall determine in any given case to have the work done by days' labor. All the provisions in this charter relating to contracts, not inconsistent herewith, shall bo applicable to all contract work or dered by the Commissioners. Sec. 260. The Board shall have the com plete and exclusive control, management and direction of the aforesaid parks, grounds nnd boulevards, and to that end may, In accordance with the provisions of Article XXVII of this Charter employ, gppolnt, remove, discharge or suspend su perintendents, laborers, surveyors, engl-' LOS ANGELES HERALD. They shall havo the exclusive management and disbursement of all ; funds legally appropriated or received from any source for the support of said parks or grounds. Sec. 261. Tha Chief or Police shall, on the request of the Board, detail such members of the Police Force of th* City for service In saiel parks, grounds and boulevards, us may be necessary for the enforcement of the law and for the proper ohservnnco of the rules and regulations of tho Board, and the Board may provide a place of detention within either of said public places, In which tho persons ar rested for violating any of tho ordinances of the City may be detained temporarily. Sec. 262. Tho Board shall havo authority to direct and regulate the planting, pres ervation, trimming and pruning of shade nnd ornamental trees and shrubbery In nny or all of the streets, alleys and pub lic grounds of the city; also the trim ming and pruning of trees and shrubbery already planted and the removal of suit able trees and shrubbery from such streets, alleys, public places or grounds. Sec. 263. For the purpose of carrying out Ihe provisions of the foregoing sec tion, the Board shall, ln accordanco with the provisions of Artlplo XXVII of this charter, appoint a City Forester and prescribe his duties. Sec. 264. The Board may receive dona tions from persons and corporations, and legacies nnd bequests for the Improve ment of said parks, grounds and boule vards. All moneys thnt may bo derived from such donations, legacies and bo quests shall, unless otherwise provided by the terms of such gifts, legacy or be quest, be deposited ln tho treasury of the City to the credit of the Park fund. Tne same may be withdrawn therefrom nnd paid out In the same manner as Is pro vided for Ihe payment of moneys legally appropriated for the support and Improve ment of such parks, grounds and boule vards. If the moneys derived from such gifts, bequests or legacies shall nt any time exceed In amount the sum necessary for immediate expenditure on said parks, grounds and boulevards, tho Board shall Invest all or a part of the same ln Interest hearing bonds of the United States, or of the State of California or of any munici pality thereof. Sec. 269. The Board shall establish rules and regulations for the use and govern ment of the aforesaid parks, grounds and boulevards and for carrying out the pro visions of this Article relating to trees and shrubbery ln the streets, alleys and public grounds of the City. Sec. 206. The Council shall provldo all necessary money for the meaintennnee, preservation and improvement of said parks nnd grounds and to that end shall annually levy a tax on all property In the City not exempt from taxation, which shall not he more than nine cents upon each one hundred dollars assessed valua tion of said property. ARTICLE XXV. DEPARTMENT OF PUBLIC HEALTH. Sec. 267. There shall be n Board of Health consisting of five members, four of whom shall be appointed by the May or, and shall be licensed physicians of th> state anl must have been such and resi dents of the City of Los Angeles for five years next preceding their appointment. The Chief of Police shall be a member of the Board of Health by virtue of his office. The members of the Board of Health shall serve without compensation. They shall annually elect one of their number President and shall elect a secretary and define his duties. Sec. 268. Tho appointed members of tho board shall serve for four years, and those first appointed under this charter shall so classify themselves by lot that one shall go out of office at the end of one year, one at the end of two years, one at the end of three years and ono at the end of four years. Sec. 269. Three members of the board shall constitute a quorum, and the boatd shall hold regular meetings one* a month and special meetings as required, at the call of tho President. Tha Council shall provide a suitable place for the meetings of the board and an office for the Health Officer. The board shall adopt rules and regulations for Its government and have supervision over all matters pertaining to public health, including the sanllnry con ditions of schools, jails, city hospllals and all public buildings. Sec. 270. The Board of Health shall ap point a Health Officer who shnll have been a legal practitioner of medicine for seven years and shall have blen a resi dent of the city flvo years next preced ing his appointment, and shall have the power of removing such officer. He shall be the executive officer of the board and shall devote his entire time to tho duties of his office. He shsll see that all ordi nances in respect to public health and the rules and regulations ot the Board of Health are enforced, and shall receive all complaints of violations of such ordi nances, rules and regulations and Investi gate the same and act thereon. He shall make to Ihe board an annual report of the affairs of his office, including vital mortuary and other statistics, with such general observations as in his Judgment will improve the sanlfary condition of the city. He shall visit once In each quar ter all the public Institutions ln the cltv under tho charge of the Department of Public Health, and twice in each year ho shall visit every public school building in said city, and shall examine tho schools ln regatel to the monner in which they are lighted, ventilated, heated and partic ularly In regard to their sanitary condi tion, and report the results of his exam inations to Iho Board of Health ln Janu ary, April, July and October of each year. Sec. 271. Every physician in the cltv shull report to the Health Officer In writ ing every patient he shall have sick of ty phus, ship or yellow fever, Asiatic chol era, leprosy, smallpox, diphtheria or scar let fever, and every death from such dis ease. Immediately after It shall have oc curred. Every householder ln said cltv shall forthwith report to the Health Offl ! car the name of every inmate of his or ! her house whom he or she shall have reo | son to believe ls sick of typhus, shio or yellow fever, leprosy, cholera, smallnox j diphtheria or scarlet feves, and any deaths ■ occurring at his or her house from such ' disease. Sec, 272. The Health Officer shall report lo the City School Superintendent the names and residences of every persen sick of typhus, ship or yellow fever, Asiatic cholera, smallpox, leprosy, diphtheria or scarlet fever: and It shall be tho duty of the City School Superintendent when so notified of tho residence of any person sick of ony of the diseases enumerated to j refuse admittance lo the public schools of ' nny member of a family, one or more or whose Inmates are sick of any of tho aforesaid diseases; provided that the par ties excluded shall be readmitted upon Presenting a certificate from the Health Officer that there is no longer any danger from contagion. . s . ec .\ 2731 Whenever a case of smallpox, £i"Sf!. c cholera, yellow fever, typhus, tilphthcla or scarlet fever ls reported to the Health Officer, he .shall Immediately visit the premises, and the sold Health Officer, upon persona! Sec 274. The Board of Health shall ap point a City Physician who shall act as Police Surgeon, anel may appoint a physi cian and nurses for the hospital or hos pitals of ths city when it may be neces su ry. Sec. 275. No person shall remove a , smnllpox patient from any house or place within the limits of the city to any house or place without the permission of the Health Officer. ! Sec. 276. The Board of Health, when svcr and at such time as by them It ahall jc deemed necessary, may, by proclama tion, require all railroad cars or other public conveyances bound for this cltv, acforo tho samo shall land or stop at any lepot or landing or stopping place therein, lo Btop or touch at any or either of the ?ltes. places or boundaries selected and established for quarantine purposes, and leave all such Immigrants, travelers or persons, and all such sick, diseased or un clean persons with their stores and bag sage, as ln the opinion of the officers sta tioned at such quarantine sites, placos or boundaries shall bo deemed proper on ac count of ex.sting or general report of cholera, smallpox, or any contagious dis ease or diseases apprehended to endanger tbe health of tha city. Sec. 277. The said board shall make such rules and regulations for tho govern ment of tho quarantine or health of the city as from time to time It shall doom necessary, and the physicians or health officers in charge of ony quarantine «ia tion or place shall have power to mako and enforce such regulations us may bo necssary for the proper management ond conducllng thereof; and It shall bo the luty of all persons in quarantine, and all ngcnts, officers, policemen or others em ployed by the city about said quarantine stations or places, to carry out and obey the samo. Sec. 273. Tha Board of Health shall cause to be kept a record of all births, deaths, interments and cremations occur ring In said city; such record must ba kept In tha Health Office, and shall bo open for tha Inspection of any person during office hours. All physicians and midwlves in said city shall report to the Health Officer, on or beforo the sth of each month, all births occurring in his or her practice during the previous month. Any physician or midwife failing to mako such report shall be guilty of a misdemeanor. Soc. 279. No person shall deposit ln any cemetery or inter ln said city any human body without first having obtalnod und filed at the Health Office a certificate signed by a licensed physician or Coroner, setting forth as near as possible tho name, age, sox, color, place ot birth, oc cupation, date, locality and cause of death of tho deceased, and obtained from ths Hoalth Officer a burial permit. Physicians, when deaths occur ln their practice, must give the certificate herein mentioned, unless tho physician balleves such death lo be a proper case for Inves tigation by the Coroner; nor shsll any human body be removed or disinterred • without tho permit of tho Board of Health or Health officer or by order of the Coroner. See. 280. Superintendents of cemeteries within the boundaries of the city must return to Ihe Health Officer on each Monday the names of all persons In terred, cremated or deposited within their respestlva comoteries for the pre ceding week. Sec. 281. It shall bs unlawful to disin ter or exhume from a grave, vault or other burial place within the limits 3f the city the body or remains of any de ceased person, unless a permit for so do ing shall have been first obtained from th* Health Officer. Nor shall any body or remains disinterred, exhumed or taken from the grave, vault or Cither placo of burial or deposit be transported in or through tho streets or highways of said city unless the person or persons trans porting such bodies or remains shall first obtain from the Health Officer a permit In writing therefor. When an applicant for a permit to disinter a body shall de sire to remove said body beyond tho lim its of said city, and shall so state on making application, the permit, if tho same bo Issued, shall include the right to disinter and remove. Said permit shall accompany the body or remains. Sec. 252. The permits in tho last section may be granted, ln the discretion of tho Board of Health, undor such general re strictions and conditions as tho board may prescribe. Tho Health Officer shall prepare a book of blank permits, ln proper form and consecutively numbered, containing stubs on which, as well as In the permit, shall be entered a record of the transaction, giving tho name, age, sex, nativity, place of burial and destina tion ot remains to be transported and re moved. Sec. 283. Nothing In this charter ahall be taken to apply to tha removal of the remains of a deceased person from on* placo of Interment to another place within the same cemetery. Sec. 284. No parson shall receive for transportation or shall transport upon any boat, vessel or railroad car, or public or private conveyance, the body of any person who has died within the limits of said city, unless ssld body ls accompa nied by a permit for such transportation from tho Health Offleor. Any person vi olating any of the provisions of this sec tion shall bo guilty of a misdemeanor. Sec. 285. Any member of the Board of Health or the Hoalth Officer may admin ister oaths on business connected with the Health Department. Soc. 256. All pollco officers shall ba ex offlcio sanitary Inspectors. Sec. 287. Under tho supervision and di rection of the Board of Health, all mar kets and dairies doing business within the city, and nil products offered for sale for food. Including milk, moat, fish, poultry, bread, bugler, lard, cheese, fruits, vegetables. Ice and water, shall be inspected; and. whenever necessary, all such articles offered for sale for food or drink may bo condemned and de stroyed; and tho Board of Health shall appoint some suitable and proper person who shall be nn experienced chemist and bacteriologist and whoso duty it shall bo, under the direction of said board, to make examinations and analyses of all such food products, and make all bacte riological examinations In cases of infec tious and contagious diseases, nnd per form such other duties as said board may prescribe. Sec. 288. The Board of Hoalth shall ap point such Inspectors, subordinates and employees, subject to the civil service rules of this charter, as may be neces sary to carry out tho provisions of this article. ARTICLE XXVI. BUILTniNG DEPARTMENT. Sec 289. There is hereby created a Building Department In the City of Los Angeles which shall be furnished by tho Council with office rooms anel necessary supplies for the transaotion of business. Sec. 290. The Mayor shall appoint all the officers and employees of the depart ment, subject to the provisions of Article XXVII of this charter, except where otherwise provided by this article. Sec. 291. There shall be appointed by the Mayor a Superintendent of Buildings. He shull be i competent architect or prac tical master builder of approved charac ter and experience, who shall bo an elec tor of the Clly of Los Angeles at the time of his appointment, and shall have been a resident thereof for at least flvo years next preceding such time. The first appointment of the Superintendent shall be for one year and thereafter all ap pointments shall be for four years or un til his successor shall be appointed and qualified. He may be removed by tho Mayor for malfeasance, Incapacity or neglect of duty. Sec. 292 Tho Superintendent of Build ings shall havo management and control of Building Superintendence and Inspec tion. Sec. 291. There shall bo a deputy, who shall be known as tho Inspector of numbing who shall be a plumber of ap proved character and experience. He shall have charge of the Plumbing Department ond the enforcement of all ordinate* ant? laws relating thereto. Ho sball make all Inspections of plumbing when required so to do hy the Health Officer, and assist tn enforcing the sanitary laws. , Sec. 295. There shall be a deputy who shall bo Inspector of Boilers und Eleva tors. He shall be a mechanical engineer of apt roved character and experience. It shall be his duty to sec that the laws and ordinances pertaining to steam boilers, heating apparatus and elevators are en forced. He shall Issue all permits and certificates as therein provided. Sec. 296. When authorized thereto by ordinance, there may be a deputy who shall be Inspector of Electric Wiring and Apparatus In and about buildings. He shall be nn electrical mechanic and elec trician of approved character and experi ence, whose duty it shall be to sec that all laws and ordinances pertaining tr, electric wiring and apparatus and cur rents for furnishing light, heat or powei In or about buildings in the city are en fotced. Sec. 297. The other officers of tho de partment shall be such assistants and cm ?loyees as may be provided by ordinance rom time to time, as the growth of the city may demand. Sec. 298. The Assistant Superintendent and all deputies and Inspectors must be residents of the City of Los Angeles al the time of their appointment. Sec. 299. None of the aforesaid officer! or employees of the department shall be employed or engaged in nny other busi ness or Interested In any contracts, ot building, or furnishing materials to be used for any building ln the City of Los Angeles. Sec. 300. The Superintendent of Build ings or his assistants shall examine al buildings in course of erection or altera tion as often as practicable and enforce all ordinances pertaining thereto. ll< shall Issue and keep a record of all build Ing permits authorized, including plumb Ing, boiler and electric permits, all ol which permits shall be countersigned bj the Auditor. Sec. 301. The Superintendent of Build ings shall at least once a year make c trorough examination of all public build Ings and buildings used for large assem blies, Including theaters, music halls churches, hospitals, and schools, and re port to tho Council as to their safety ant provision for Ingress nnd egress, ant make recommendation as to the eorrec tlon of defects that may exist. A copy of the plans nnd sped flcatlons of every municipal building shal be deposited ln the office of the Superin tendent of Buildings. Sec. 804. Whenever called upon so to di by tho Superintendent of Buildings, I shall be tho duty of the City Engineer am Chief of the Fire Department to rendei assistance in the inspection of building: and plans. Sec. JO5. The Superintendent of Build Ings and his assistants shull render as sistance to the Fire Department, and n case of fire, he shall present all lntormn tlon he may have relative to the construe tlon and condition of the building on fire and adjoining buildings. Sec. 306. There Is hereby established t Board of Appeal, to which an appeal cai be taken from the Building Superintend ent. The board shall consist of threi members, as follows: The City Engineer, the Chief of the Fire Department and an architect to bi appointed by the Mayor, who shall be at architect of approved character and ex perlence and shull have beef an cloc'oi of the city of Los Angeles for at leas five years next preceding his appoint ment. The architect appointed by the Mivoi on the Board of Appeal shall receive ai compensutlon a fee of ton dollars for eacl appeal. He shall be appointed for fou: years, or until his successor ls appointee and qualified. Sec. 307. The Board of Appeal shall or ganize by appointing one of their numboi President, who shall hold office for oni year or until his successor ls elected. The board shall hold meetings on call of thi President to consider appeal. All notlcei of appeal must come from the Superin tendent of Buildings. Two members oi the bonrd shall constitute a quorum foi the transaction of business. The Assist ant Superintendent of Buildings shall bi Secretary of the Board of Appeal. A re ceipt shall bo given for the earns, and the money paid into the city treasury by tho architect or department in charge, ana there shall, at all times during the period or estimating or bidding on said building, be publicly exhibited in the office desig nated by tha department, during busi ness hours, a full set of plans, sections, elevations and specifications for the use. Information and convenience of tho con tractor estimating on tho work to be done. ARTICLE XXVII. CIVIL. SERVICE. Sec. 312. Immediately upon tho taking eff.e-t of this charter, the Mayor shall ap point five persons known by him to be de voted to the principles of civil service re form who shall constitute and be known as tho Board of Civil Service Commis sioners. They shall serve for the term of four years and without compensation. They sliall so classify themselves by lot, that one of them shall go out eif office at tho end of one year; one at the end of two years; ono at the end of three yenrs, and two at the end of four years. Three com missioners shull constitute, a quorum. All appointments to said commission, both original nnd lo fill vacancies, shall be so made that no more than three members sl all at the. time of uny appointment bo menibi rs of the same political party. Said commissioners shall hold no other public office or public employment. Sec. 313. Tho Mayor with tlw> consent of tho Council may remove any commis sioner for Incompetency, neglect of duty cr malfeasance In office. Sec. Sl4. Said commission ahall classify all the cilices and places of employment mentioned In Section 322 of this article with reference to the examination herein provided for. The offices and places so classified by the commission, shall con stitute the classified civil service of said city; and no appointment to any such of fices eir places shall be made, except un der nnd according to tho rules herein after mentioned. Sec. 315. Said commission shnll mnka rules to carry out tha purposes of this article and for the examinations and ap pointments In accordance' with Its pro visions, and the commission may, from time to time, make changes In such rules. Sec. 810. All rules mnde as hereinbefore provided, anel all changes therein, shall be printed for distribution by said com mission. Tho commission shall give no tice by publication In tho official paper of the place or places where said rules may be obtained, and in each said pub lication shnll bo specified tho date, not less than thirty days subsequent to the date of sucTi publication, when said rules shall go Into operation. Soc. Sl7. All applicants for offices, places or employments in said classified civil service, shall be subjected to examina tion, which shall be public, compelltlre and free to all citizens of the United States, with specified limitations as to residence, age, sex,' health, habits and moral character. Such examinations shall be practical In theli character and shall relate to those matters which will fairly test the relative capacity of the persons examined to discharge the duties of the position to which they seek to be ap pointed, and when appropriate shall In clude tests of physical qualifications, health, and manual skill. No question tn any examination shall relate to political or religious opinions or nlilllatlons. The commission shall control all examina tions, and may, whenever an examination Is to take place, designate n suitable per son or number of persons, cither ln Or not ln the official service of the city, to be an examiner or examiners, and It shall be the duty of such examiner or ex aminers (and if in tho service It shnll be part nf their official duty, without extra compensation), to conduct auch examina tions, as the commission may direct, and make return or report thereof to Said commission, and the commission may at any time substitute any other person, whether or not ln such service, in the place of any one so selected; and tha commission may themselves at any tlm* act as such examiners, and without ap pointing examiners. Such examiners shall not all be of the samo political party. Sec. 318. Notice cf th* time, place and general scope of every examination shall be given by the commission by publica tion, for two weeks preceding such exam ination. In the official paper, and such no tice shall also be posted by said commis sion ln a conspicuous place at the City Hall, and In their office, two weeks be fore such examination. Such further no tice of examination shall be given as they may prescribe. Sec. 319. From th* returns or reports of the examiners, or from the examina tions made by the commission, the com mission shall prepare a register of each grade or class of position in the classi fied civil service of the city, of the per* sons whose general average standing upon examination for such grade or class Is not less than the minimum fixed by the rule of said commission, and who are otherwise eligible and such persons shall take rank upon the register as candidate ln the order of their relative excellence as determined by examination, without reference to priority of the date of ex amination. When the examinations aro oral they must be open to the public, and, when written, the examination papers of each applicant shall be placed on file and kept ln the office of the commission and constitute public records open to the In spection of any citizen. Sec. 320. The commission shall by Its rules provide for promotion in such classi fied civil service on tho basis of ascer tained merit and seniority ln service and examination, and shall provide in all ensos where it is practicable that vacan cies shall be filled by promotion. All ex aminations for promotion shnll be com petitive among such members of tho next lower rank as desire to submit themselves to such examination: and It shall be tha duty of the commission to submit to tho appointing power the names of not more than three applicants for each promotion having the highest rating; but In fixing said rating a uniform allowance of cred its to ba stated at the time of the an nouncement of said examination Bhall be made for each year of past service. Tha method of examination and the rules gov erning thi? same, and the method of cer tifying, shnll be the snme as provided for applicants for original appointment. Sec. 321. The head of the department or board ln which a position classified un der this article is to be filled shall notify said commission of the fact, and said commission shall certify to such officer the name and address of one or more candidates, not exceeding three, standlnsr highest upon the register for the class or grade to which said position belongs ex cept that in cases where a choice by com petition Is Impracticable, said commission may provide by Its rules that the selec tion shall be made by lot from arnon* those candidates proved fit by examina tion; and in all cases laborers shall be selected by lot. In makin* such certifi cation sex shall be disregarded exesot when some statute, the rules of said com mission, or the appointing power soeclfv sex. Said appointing officer or depart ment Bhall notify said commission of each position to be filled separately, and shall fill such place from the names certified to him by said commission therefor. One of the candidates thus certified shall thereupon be appointed by said head of such department or officer and employed on probation for a period to be fixed by said rules.but such rules shall not fix such period at exceeding six months.
