Sue. 7. Tdat before the County Coinmis aionrra of any cuunty shall take any steps toward locating ot establishing any ditch, 4rain, 01 water-course, there ahull be filed with the Courly Auditor a petition from one or more persons owning landa adjacent t tb line of such proposed ditch, drain, or water-course, setting forth the necessity of the same, with a description of its proposed sisrluig point, route, and terminus, and shall, at i lie seme time, Ale a bond wiihguud and sufficient suratiea to the acceptance ol the Cuuuly Auditor, condiliuned In pay all sinenses incurred, in case the Commission- era shall refuse lo crsnt the prayer of the petition. and it ahsll lie the duty of the County Auditor, immediately thereafter, to place a corttrt ropy of ssid petition in the n iniis ol i he louiay naarveyor, or a compe tent Engineer, who ahsll thereupon, taking with him the ncrewarr assistance, prncm-il t make an accurate survey of the route, of auoh proposed ditch, dram, or water-course, and on the completion thereof, shail re urn a p at or plats and profile ol the ssme meant County Auditor, and shall also ael forth in hie return a description of the proposed mute, its availability and necessity, with a detrrintion of each separate tract of Innal through which the same ia proposed to lie located, how it will be a flee led thereliv, and its situation and level as compared with that of adjoining lands, together with aurh o'her facta as he may deem material It ahall be thedaty of the County Audiior, im mediately on said report being filed, to reuse notice in writing to be given to the owui-r or one of the owners of each tract of laud along the route of audi proposed ditch, drain, or water course, of the pendency ami prayer of said petition, and of the time ol the session of the County Commissioners at which Hie jstnt will be heard, which notice aha'.l be served at least ten days prior to smd aession, and an affidavit of said servire tiled wiMi the County Auditor; and in case any such owner is not a resident nl the county, or ahould any pnrly or parlies in interest die during, the pendency ot said proceeding, sl'rh ilealh shall not work an niistement of such proc'nli"L',liot the I'on nf y Commission ers 1 1 ii beiuKiiotified thereof, shall m.ikeauch Older as they may Ue m proper for giving, no tice to the person or persons succeeding to the right or such rireraed party or parties, and notice ol the pendency and prayerof said petition and the time of hearing the amne ahall be givtn tu audi owner or persons, by putilicat'on lor two consecutive weeks in some newspaper published or of geneial cir cuU ion in said county. Sec. 3. That any person or personacla m ini; compensation foi lauds appropriiiti-d foi tlie purpose of constructing any ditch, drain, or watercourse under the provisions ot this act, shall make his, her, or their application in wittiug therefor to the County Commis sioners, on or before the third day of the sea- a n at which the petition has been aet lor tor hearing, and on failure to make such ap plication, ahall be deemed and held to have waived his, her, or their right to such Com pensation. Sac i. That aaid County Commission ers, at the session aet for the hearing of mid petition, shall, if tiny find llieriqiiirements of the second suction of tins act to have been complied with, proceed to hear anil de termine said petition) and if thty deem necessary ahall view the premises and they find such ditrh, drain, or water-course to tie necessary, and that the same la de manded by or will be conducive to the pub lic health, convenience, or welfare, and no application shall have been made for com pensation as provided in the third section this act, they ahall proceed to locale ai d es tablish such ditch, drain or wider course on the route specified in the plat and return SJi'l county Surveyor or Engineer. That said County Commissioners, whenever they shall have established any such ditch, drain, or water course, shall di vide the same into suitable sections, not less in number thai the number of uwneis ol land through which the same may be lo cated, and ahall also prescribe the time within which the woik upon audi sections si all be oompleted. bas. 8.
