The eases against Tom Nailen, rape, and John Skinner, murder, were passed. Richard Wright, colored, charged with rape, on trial. Chancery Court. A temporary injunction issued to the Birmingham Railway and Electric com pany retraining them from building line parallel with the tracks of the Highland Avenue and Belt Railroad company on Eleventh avenue, between Nineteenth and Twentieth streets, and also from crossing the Highland Avenue Railroad company's tracks within those limits. The injunction was granted on a bill filed by the Columbian Equipment company, who own, operate and control the High land Avenue and Belt railroad, its prop erties and franchises. The bill claims ownership of 2G feet right-of-way along Eleventh avenue, over which the Bir mingham Railway and Electric company propose to build their branch line of rail wav. and yet. It is averred, plaintiffs have been offered no compensation. Plaintiffs further aver that-if defendants are allowed to so construct the branch road Eleventh avenue, between Nine teenth and Twentieth streets would have three tracks, which, the averment in sists, weuld impose considerable incon venience on plaintiffs. It is suggested by plaintiffs that defend ants could make their extension from Twelfth avenUe and Twentieth street without Joss or damage. The Birmingham Railway and Electric company was recently granted a fran chise by the council to operate and con struct a, line df street railway from Elev enth avenue and Twentieth street to Eleventh avenue and Fifteenth street. During the deliberations of the council touching the petition of the Birmingham Railway and Electric company a vigor ous resistance before that bodj was made by representatives of the Highland Ave nue and Relt .Railroad Company. The franchise WITS’ finally granted, it will be remembered, on a vote of 7 to 6. * United States Court. Judgp Bruce yesterday sentenced pie follotvfltg prisoners: Charles Wellborn, fraudulent use of the mails, eighteen months in the Kings courtly penflentiary, New York. If he makes bond Judge Bruce inti mated that the amount would not be less than $1500. John Abbott, counterfeiting: one year in the.county-jail and a fine of $100 and costs. Abbott wanted to go to the peni tentiary instead of the county jail, be cause he said he could learn a trade at the penitentiary. ■c. C. Held, presenting false claims: $100 and costs. Allen returned yesterday morning from Jasper, where he had been to represent t'he defendants in a criminal prosecution before the probate judge's court. The defendants were indicted for unlawful assembly and malicious mjp chief, and numbered about 130. They were charged wi'th complicity in the riot at Price’s mine, near Horse Creek, a year ago last summer. The cases were all dismissed on account of the prosecution being unable to get its witnesses to court. Eleven cases against parties indicted for rioting are pending in the circuit court of Walker county. Young gentlemen having ambition to play orchestral or band instruments of any kind should consult Professor Weber at the Birmingham College of Music. Splendid opportunity. 6-23-tf _ GREENVILLE. Greenville, Oct. 7.—(Special Correspond ence.)—Your correspondent has just re turned from a trip througli Covington, where he found cane and potatoes, as well as cotton, being much injured by the extreme dry weather. He had the pleas ure of hearing Colonel Stallings on the financial question at Andalusia on Sep tember 28. Notwithstanding a very short notice he had a good audience. His speech was clear and convincing and many pronounced it unanswerable. Those who have heard both speak are not surprised that Colonel Herbert is afraid to meet Jess on the stump. While we were much attached to the State, we say hurrah for the State Her ald. It is amusing to see how much fhe postofllce at Montgomery is troubled about the future of the paper. What John E. Logwood of Athens, Ala., Has to Say. He Calls It a Health Restorer and Recommends Its Use Most Highly.
