On Monday, February 6, 1S99, at 12 o'clock noon, at the front entrance of the Executive Building, will be sold at public auction, the lease of Govern ment Lot No. 59. Esplanade, Honolulu, Oahu. Term 30 years. Upset rental $430 per annum, pay able quarterly in advance. This sale is upon the conditions pro vided for in Sections 2 and 4, of Act 7, of the Laws of 1896, viz: Section 2. Every such lease shall contain a covenant on the part of the lessee that he shall during the first four years of the term of the lease, cause to be erected upon the leased property a fire proof building of brick, stone or metal, in a workmanlike man ner, satisfactory to the Minister at not less than a stated cost, and shall keep the same suitably insured at not less than two-thirds of its value, for the benefit of the lessor; and shall keep such building in good repair during the remainder of the term of the lease, reasonable use and wear thereof only excepted, and in case of damage or destruction of euch building by fire shall make good such loss or damage by the necessary repairs or reconstruc tion, or else surrender the insurance to the lessor. Section 4. Every such lease shall also contain a covenant on the part of the lessor that upon the req-uest in writing of the lessee or his represen tatives, before the expiration of the term: thereof, the premises, with the improvements, shall, if all the con ditions to t-e performed by the lessee have been satisfactorily performed, be put up at auction for a lease for a term of not over twenty ye-ars, unless said premises shall be required for public uses, of which the lessee shall receive at least one year's notice. Such auction sale shall be held not more than six months nor less than one month LeScre the expiration,, of said terra. Greeting: Whereas, a libel was filed in the Cir cuit Court of the First Judicial Cir cuit of the Republic of Hawaii, the 12th day of December, 1S98, by W. J. Smith, et. al., against the steamship City of Columbia, her boats, boilers, engines, tackle, apparel and furniture, and praying that the same may be condemned and sold to pay the claim of said libellants. And whereas, the said steamship City of Columbia, her engines, etc., is now in custody, by virtue of a writ of attachment issued out of this Court, in pursuance of the prayer of said libel, and such proceedings have been thereupon had that by the sentence and decree of the said Court in this cause, made and pronounced on the 3rd day of January, 1899, the said steam ship City of Columbia, her boats, boil ers, engines, tackle, apparel and fur niture was ordered to be sold by you, the said marshal at an upset price of $23,465.62, after giving ten days notice of such sale by advertising ithe same in the Pacific Commercial Adevrtiser and the Hawaiian Star, newspapers published daily (Sunday excepted) in the city of Honolulu, and that you pay the moneys arising from such sale to Henry Smith, Esq., Clerk of the Judi ciary Department. D. 1S9S, and recorded In the office of the Registrar of Deeds in Honolulu, Island of Oahu, in Liber 177 on pages 259 to 2t3, purporting, to be an indenture between the Hawaiian Commercial and Sugar Co., and the Maui Railroad & Steamship Co., and purporting to have been executed on the part of the Hawaiian Commercial and Sugar Co. by R. Sprecke's aa ita presideut and also as its attorney-ia-fact, is hereby disaffirmed and repud iated, together with the conveyance therein made, or purporting to be made, by the Hawaiian Commercial and Sugar Co., to the Maui Railroad & Steamship Co., and the further convey ance therein covenanted to be made, and that the certificate of the Maul Railroad & Steamship Co., for 500 of its paid up shares said to have been gi?n by it to R. Spreckels as trustee for the Hawaiian Commercial and Sug ar Co., as the sole consideration for said transaction, be returned, and that R. Spreckels be requested to return the same to the Maui Railroad & Steamship Co., and further that the Hawaiian Commercial and Sugar Co.. hereby releases said (Maui Railroad & Steamship Co., from its covenant con tained in said indenture and demand a re-conveyance of the property in said deed conveyed and also a release from the covenant therein contained to con vey further property to said Maul Rail road & Steamship Co.
