lands hereby give notice that their of
fices will be open from the FIRST TO
THE THIRTY-FIRST DAY OF JAN
UARY, inclusive, from 9 a. in. to 4 p.
m. (Sundays and holidays excepted),
and on SATURDAYS until 12 noon,
and all persons liable to be taxed in
said Hawaiian Islands, either in their
own right or as Guardian, Administra
tor, Executor, Trustee or otherwise,
are require-d by law to bring in to the
Assessors, within the time above spe
cified, true lists of all their polls and
estates, vboth real and personal.
Your attention is called to the fol
lowing regulations of the Board of
Equalization for the Assessment and
Collection of Taxes for the Hawaiian
Islands:
No. 1 Value of land to be separate
from value of buildings and im
provements. No. 2 In making a return, state the
street and number of lots in town,
or lots in the country shall be de
scribed by noting the name of the
Hi or Ahupoiaa in which they are
situated and the number of the
Land Commission Award and
Royal Patent under which the
land is held, and the area. Also,
state if any property has been sold
during the year, to whom and for
what price.

are to be as of your books of Jan

SALE OF LEASE OF GOVERNMENT
LOT NO. 59, ESPLANADE, HO
NOLULU, OAHU.
On Monday, February 6, 1S99, at 12
o'clock noon, at the front entrance of
the Executive Building, will be sold at
public auction, the lease of Govern
ment Lot No. 59. Esplanade, Honolulu,
Oahu.
Term 30 years.
Upset rental $430 per annum, pay
able quarterly in advance.
This sale is upon the conditions pro
vided for in Sections 2 and 4, of Act
7, of the Laws of 1896, viz:
Section 2. Every such lease shall
contain a covenant on the part of the
lessee that he shall during the first
four years of the term of the lease,
cause to be erected upon the leased
property a fire proof building of brick,
stone or metal, in a workmanlike man
ner, satisfactory to the Minister at not
less than a stated cost, and shall keep
the same suitably insured at not less
than two-thirds of its value, for the
benefit of the lessor; and shall keep
such building in good repair during
the remainder of the term of the lease,
reasonable use and wear thereof only
excepted, and in case of damage or
destruction of euch building by fire
shall make good such loss or damage
by the necessary repairs or reconstruc
tion, or else surrender the insurance
to the lessor.
Section 4. Every such lease shall
also contain a covenant on the part of
the lessor that upon the req-uest in
writing of the lessee or his represen
tatives, before the expiration of the
term: thereof, the premises, with
the improvements, shall, if all the con
ditions to t-e performed by the lessee
have been satisfactorily performed, be
put up at auction for a lease for a
term of not over twenty ye-ars, unless
said premises shall be required for
public uses, of which the lessee shall
receive at least one year's notice.
Such auction sale shall be held not
more than six months nor less than
one month LeScre the expiration,, of
said terra.
The cost of building to be erected,
in accordance with Section 2, as above,
to cost not less thau $SQ09.
The material to be used for the erec
tion of said building to .be of brick or
sten?.

made and provided, and deeming it
necessary to the promotion of justice,
it is ordered that a Special Term of
the Supreme Court of the Hawaiian
Islands be held in Honolulu, Island of
Oahu, in the Court Room of said Court,
Judiciary Building, commencing at 10
o'clock a. m., on Monday, the 9th day
of January, 1S99, to be continued and
held from the opening thereof until

Holders of water privileges, or those
paying water rate3, are hereby notified
that the hours for irrigation purposes
are from 6 to S o'clock a. m. and from
to 6 o'clock p. m.
II. Holders of water privileges on
the slopes of Punchbowl above Green
street, and in Nuuanu valley above
School street, are hereby notified that
they will not be restricted to the Irri
gation hours of 6 to S a. m. and 4 to 6
p. m., but will be allowed to irrigate
whenever sufficient water is available,
provided that they do not use the water
for irrigation purposes for more than
four hours in every twenty-four.

VENDITIONI EXPONAS.
To A. M. Brown, Esq., Marshal of the
Republic of Hawaii. Greeting:
Whereas, a libel was filed in the Cir
cuit Court of the First Judicial Cir
cuit of the Republic of Hawaii, the
12th day of December, 1S98, by W. J.
Smith, et. al., against the steamship
City of Columbia, her boats, boilers,
engines, tackle, apparel and furniture,
and praying that the same may be
condemned and sold to pay the claim
of said libellants.
And whereas, the said steamship
City of Columbia, her engines, etc., is
now in custody, by virtue of a writ of
attachment issued out of this Court,
in pursuance of the prayer of said
libel, and such proceedings have been
thereupon had that by the sentence
and decree of the said Court in this
cause, made and pronounced on the 3rd
day of January, 1899, the said steam
ship City of Columbia, her boats, boil
ers, engines, tackle, apparel and fur
niture was ordered to be sold by you,
the said marshal at an upset price of
$23,465.62, after giving ten days notice
of such sale by advertising ithe same
in the Pacific Commercial Adevrtiser
and the Hawaiian Star, newspapers
published daily (Sunday excepted) in
the city of Honolulu, and that you pay
the moneys arising from such sale to
Henry Smith, Esq., Clerk of the Judi
ciary Department.
Now, therefore, you the said Mar
shal are hereby commanded to sell the
said steamship City of Columbia, her
boats, boilers, engines, tackle, apparel
and furniture, at public auction, at the
Station House, Kalakaua Hale, in the
District of Honolulu, Island of Oahu,
Hawaiian Islands, on Monday, the
16 tli day of January, 1S99, at the hour
of 12 noon, at not less than an upset
price of Twenty-three Thousand Four
Hundred and Sixty-five and sixty-two
hundredths dollars, after having first
given ten days notice of such sale by
advertisement in the Pacific Commer
cial Advertiser and the Hawaiian Star,
newspapers published daily (except
Sundays) in the District of Honolulu,
and that you immediately thereafter
have and pay the moneys arising from
such sale, pursuant to the aforesaid
order or decree, to Henry Smith, Clerk
of the Judiciary Department, with an
account of your charges and expenses,
and have you then and there also this
writ, with your return thereon.

ial meeting of the Board of Directors
of said corporation held at Its princi
pal office on December 15, 1898, which
said special meeting was duly called
and assembled, and at which said
special meeting a quorum was present
and voting, the following resolution
was adopted: '
Resolved, That the deed, dated Feb
ruary 26, A. D. 1S9S, and recorded In
the office of the Registrar of Deeds in
Honolulu, Island of Oahu, in Liber 177
on pages 259 to 2t3, purporting, to be
an indenture between the Hawaiian
Commercial and Sugar Co., and the
Maui Railroad & Steamship Co., and
purporting to have been executed on
the part of the Hawaiian Commercial
and Sugar Co. by R. Sprecke's aa ita
presideut and also as its attorney-ia-fact,
is hereby disaffirmed and repud
iated, together with the conveyance
therein made, or purporting to be
made, by the Hawaiian Commercial
and Sugar Co., to the Maui Railroad &
Steamship Co., and the further convey
ance therein covenanted to be made,
and that the certificate of the Maul
Railroad & Steamship Co., for 500 of
its paid up shares said to have been
gi?n by it to R. Spreckels as trustee
for the Hawaiian Commercial and Sug
ar Co., as the sole consideration for
said transaction, be returned, and that
R. Spreckels be requested to return
the same to the Maui Railroad &
Steamship Co., and further that the
Hawaiian Commercial and Sugar Co..
hereby releases said (Maui Railroad &
Steamship Co., from its covenant con
tained in said indenture and demand
a re-conveyance of the property in said
deed conveyed and also a release from
the covenant therein contained to con
vey further property to said Maul Rail
road & Steamship Co.

rights and powers purporting to be as
