Important Pulinjs of Juite Perry on Pro
tcrty aoi Water Pithts 03
Marshy LaoJs.
In the pu:y suit of Victoria Ward
vs. Chas. S. Deeky and K. IVck & Co..
Limited, a corporation, a bill for in
junction, Judge Perry has rendered hi.
derision. Compluiimnt and e.u-h of the
ro: pondents severally own in fet cer
tain tract of larl which adjoin each
other and all of which are situate, in
Kevalo, Oahu. Complainant also owns
in fee .tnoiher tract of land situate
at Kukulurjoo. On the boundary 1-tv.-een
the promises of the respondeat
corporation and the adjoining premise
of complainant rtands a bank of earth.
originally built more than twenty
years prior to tho commencement of
thee prtevdincs. Ttxe land on which
this bank was built, and that imme
diately adjoining 1t on cither side, was
low and marshy; -the bank was made
for the punose of preventing on over
flow of writer in rainy weather from
the Jand which lir-s since been acquir
ed r.y the rcsporulonis to the lands
of Lho complainant and also of sup
porting the lyunLiry fence erected
thereon. Shortly after Peck & Co. ac
quired t2e property they caused an ar
tesian well to be lcred thereon. When
water was struck, those in immediate
charge of the work made a cut aero.
the bank leferrctl to so as to p?rmlt
the water from tJhc artwian well to
flow over on to tho complainant's land
and ct the eamo time relieve :elr
own land frocn tho burden. Complain
ant objected to tJ.e making of the cut.
and tad Jt filled. 1n cnorc than once,
but caoh time it was again openeii by
tie well-lvrert?. Complainant t!ie:i
brought ruit, praying that the re-opon-ing
or jnnJntenurce of the cut be re
strained by injunction and also for re
lief on other matters. Upon the coat
plot ion of tLe well, ii was capped, and
finee that time no attempt has been
made by the respondents or either of
them to re-open said cut or make any
new cut iucross t:he bitnk. Judge Perry
says that respordctrt l)?sky3 efforts,
on tJic contrary, fcave i.een in til
diiwtlon of maintaining the oank in
taet to as to prevent any overflow from
complainant's land "westward over said
bank in times of freshets. He Is con
viiMul that neither of the respondents
has any desire or intention to make
or maintain any cut over the lnk.
No ground existing for enjoining now
the malAig cr maintenance of such a
cut, the prayer for injunction Is de
nied, with leave, however, to the com
plaintj;t io novo for the same here
after upon showing good cause there
for. Yith regard to the right of respond
ents to excavate up to the very line of
the boundary bank Judge Perry says
that beyond any doubt the law Is that
complainants soil is entitled to the
lateral suprort afforded it by respond
ents adji'tent land in its natural state
and that equity will enjoin any de
struction of such lateral support. This
ii: a right which exists by natural law,
jndvper.dently of grant or prescription.
A Tt : cd agairst the respondent cor-r-rr.tirn
for relief from the destruc
tion of lateral support will therefore
t-e rigred cn presentation.
Coming to the third question involved,-the
full and free enjoyment of
i.n casement in a certain ditch that has
existed on her property for some forty
years, the Court is of the opinion that
the same hns been curtailed and inter
fered v.ith by the construction of a
new ditch by respondents by which
iozii: polluted waters flow into the
ii.i An ditch. For this grievance only
rne practical remedy presents itself
and that Is to order the new ditch
closed to such an extent as may be
utKc. rary to prevent the passage of its
raters irto the main ditch, or old flsh-
way.
Concluding, Judge Perry says con
siderable evidence has been adduced
on the subject of the levels of the land
in that district and the course or direc
tion of the drainage over the surface
of the land in timen of freshets or
heavy rains. This question. It seems
to the Court, does not arise properly
in this case, nor docs the question of
whether or not Feck & Co. are on
titled to have the waters of the
springr, if such there are on their
lent!, flow on to complainant's land
ever the surface in case i:ch an over
flow results frcm the closing of the
new ditch.
A decree will besigneJ in avnrdain-
with the foregoing views.
