WHY! oooooooooooooooooooooooooo GREEN BIYEB In the matter of Xuno Fernandez, who was convicted in the District Court of South Hilo, Hawaii, of beins a disorderly person and sentenced to three months imprisonment and to pay costs, who appealed to the Circuit Court and pending the appeal was re leased on bail until the surety on his bail bond surrendered him into ihe custody of the sheriff. He then peti tioned the Circuit Judge for a writ of habeas corpus. The Circuit Judge, aft er a hearing, remanded the petitioaer to custody. The petitioner then ap pealed to the Supreme Court. In Us decision the court says that section 310, Penal Laws, provides that any person who does any one of a number of enumered acts shall be punished, etc. The petitioner was charge I with tao commission of two of sucn acts and found guilty as charged. The mitti mus recited that he had been convicted of the offense of violating section 370, etc. Held, the mittimus was not void on its face and, the record showing a proper judgment by a court having jur isdiction, the defendant was not en titled to a discharge on habeas corpus. In the case of Henry E. Cooper,. Min inster of Public Instruction, vs. Naeole Hao, the court holds that the depart ment, not the Minister, of Public In struction, is the proper party plaintiff in an action of ejectment to recover school land. In the case of Antone Sylva vs. Pat rick Cockett, on exceptions from the Circuit Court of the Second Circuit, the court decides that where a party before swearing out a warrant for a criminal offense presents all the essential facts and obtains thereupon advice of re sponsible counsel that he has reason able grounds to believe that such of fense has been committed, it is a de fense to an action for malicious prose cution for such arrest.
