' DSSi " A novel view of the right in Con gress to permit Hawaii to establish customs duties which differ from those of the United States, is here pre sented by a correspondent: Section 10, Article 1 of the Constitu tion of the United States is as follows: 'No State shall, without the consent of the Congress, lay any imposts or duties on imports or exports, except what may be absolutely necessary for executing its inspection laws. " Has not Congress, by the terms of the Joint Resolution, which provides: "Until legislation shall be enacted ex tending the United States customs laws and regulations to the Hawaiian Islands the existing customs relations of the Hawaiian Islands with the United States and other countries shall remain unchanged," given its consent to the collection of duties on imports and exports by the Hawaiian Govern ment? This provision of Section 10 of Ar ticle 1 apparently conflicts with Sec tion S of the same article, which is as toiiows: "The Congress shall have power to lay and collect taxes, duties, imposts and excises, to pay the debts and pro vide for the common defence and gen eral welfare of the United States; but all duties, imposts and excises shall be uniform throughout the United States." I maintain that it does not. If there are any conflicting provisions oi ine Constitution of the United States they have yet to be pointed out. It is to be understood that I am advancing the proposition merely that Congress had power, under Section 10 of Article I, to grant authority to the Hawaiian Government to collect duties on im ports and exports during this inter regnum. It may be argued in sup port of my contention that Section 8 of Article I refers only to Federal taxes and duties levied by Congress; and merely prohibits Congress from discriminating against any particular section of the country. It would not prevent Congress, if it chose to do so, from giving its consent to the laying of imposts or duties on imports or exports by a State. By the terms of the Joint Resolution, Congress has clearly given its consent to the levy ing of customs duties by the Hawaiian Government until legislation shall; be enacted extending the United States customs laws and regulations to the Hawaiian Islands. The language of the section provides that no "State" shall lay imposts, etc., unless author ized by Congress. The States are yet in many respects, sovereign powers. Ludloff has brought a suit for damages for malicious prosecution against Elice Ludloff and Albert Lud loff, her husband, claiming that the defendants falsely and maliciously and without reasonable cause caused her arrest and imprisonment on a charge of using vulgar, profane and obscene language, upon which charge, after a hearing before the District Magistrate of Honolulu, she was discharged. Plaintiff avers that she has been in jured in her reputation and has suf fered great pain of mind and body; has been prevented from attending her household duties and has incurred pe cuniary loss in procuring her dis charge, for all of which she asks $1,000 as damages.
