Calendar Called, Judges 'Assigned In Place of Chief Justice and Rooke Will Case Taken Up. The September term of the Supreme Court opened at 10 o'clock yesterday morning with Associate Justices Frear and Whiting on the bench, Attorney General Cooper, Deputy Attorney Gen eral Dole and. a large gathering of the bar being present. The calendar was called and Judges Perry and Stanley selected to sit on the several cases ow ing to the absence of the Chief Justice. In one or two cases in which the Cir cuit Judges are disqualified a member of the bar will be selected. The first cases to be taken up were those of C. K. C. Rooke against the Bishop Estate and the Queen's hospital trustees, which involve the title to what is known as the Queen Emma Estate lands, some of the most valu able in the city. Judge Hartwell open ed the argument, being followed by A. G. M. Robertson, P. L. Weaver and J. A. Magoon. Several more lawyers are yet to be heard and the cases will oc cupy some time yet. Judge Stanley sits in the place of Chief Justice Jiuld in these two suits. . DISTINGUISH Kl VISITORS. Anions Them Dr. Pfluger Who Was Born in This City. Among the through passengers on the Nippon Maru is a German party composed of Generals Baron Von Korff and Count Reventlow, Dr. Pfluger, Mrs. F. Zumlohe, Mrs. Richter, and Messrs. Mayer, Beckman. Gerlach and Haubit zober. The party is on a tour of the world for pleasure and recreation. Count Reventlow and Baron Von Korff are retired generals of the Ger man army, the former from the artil lery and the latter from the cavalry. The Baron is the author of many in teresting books of travels. Both the gentlemen have been very prominent in German affairs. Dr. Pfluger is young and a near rela tive of the Hackfelds. He left the Isl ands when a small boy and returns now for the first time, a professor of one the greatest universities in the world. Although he will proceed with the party on the Nippon he expects to return to Honolulu from India via Aus tralia and the various South Sea Isl and groups in about a year's time. The rest of the party returning direct to Germany. Dr. Pfluger has a two years' leave of absence from the university and expects in that time to gather a great deal of information in regard to the fauna, flora and general physical and geological endition of the many countries he will visit. The Orpheum Theater. The Orpheum program continues to improve. Last night a new bill was presented. The opening farce, "The Stage-Struck Yankee," is an interest ing comedy with a plot. Mr. Boggs, as the country lad who gets stage struck and wants to act Richard the Third, was right at home. Miss Leslie sang some catchy songs. Trixie Cole man was taken ill on the stage and was unable to appear. Maurice Wal ton kindly consented to fill her place with a comic reading. Eddie's feats on the rope hold the audiences spell bound. Hamilton Hill, the baritone soloist from the Tivoli, Sydney, opened last night. His rendition of "The Holy City" was grand. He has a beautiful voice and a clear enunciation with no end of power. His singing will be a great treat to the Honolulu public. New Mexican Oiticer. . Lieutenant Max Luna, adjutant or the second battalion of the Thirty fourth Regiment, which left last night on the transport Columbia, is one of the most influential politicians of the Territory of New Mexico. He was slated as delegate for the next Con gress and, owing to his great popular ity, would undoubtedly have been elected had he not accepted his pres ent commission in the army. Luna served as captain of Troop E of the Rough Riders at the time of the gal lant charge at San Juan hill. Owing to his familiarity with the Spanish language, he was enlisted in the civil service of the Cuban government by General Brooke, and also served as chief interpreter on the General's staff. Eustis, Ambassador to Frarce during the second Cleveland administration and formerly United States Senator, from Louisiana, died at his summer home in Newport,-R. I., of pneumonia. Admiral Dewey has sailed from Gi braltar for New York. Rear Admiral Sampson will command the fleet that welcomes Dewey. The deal has been completed by which the McGovern Syndicate of New York will control the whole of the salmon-canning industries of British Co lumbia. The Duke of Westminster's Flying Fox won the St. Leger, with Lord Wil liam Beresford's Caiman second. Sir Julian Pauncefote's new title is Baron Pauncefote of Preston, Glouces tershire. ANOTHER STEAMSHIP ORDERED. Another big freight steamship has been ordered built for the American Hawaiian line, whose local agents are Williams, Dimond & Co. The Roaches have been given the contract. Three steamships are already being built for the company, the Hawaiian and Amer ican at Roaches yards and the Cali fornian at the Union Iron Works.
