A demurrer has been filed by S. Ko
bayashi. one of the defendants in the
suit of Sophia Hunter vs. M. S. Pereira
et al, in which it is claimed among
other things that the plaintiff is barred
by the statute of limitations.
Return of service of summons has
made in the ejectment suit of the
piolani Estate, Limited, against
Tuck ami Siu Hong. Suit is
brought to recover a piece of property
in Kakaako, known as a portion of the
Ahupuaa of Auwaiolimu.
Defendants in the suit of the Minister
of the Interior vs. The Kapiolani Es
tate, Limited, have filed a demurrer
alleging that the plaintiff has no legal
capacity nor authority to bring or
maintain the action.
Judge Stanley yesterday approved
the return and account of sales of real
estate In the case of the Podeyn minors
and will sign the necessary order of
confirmation on presentation thereof.
Notfee of discontinuance of action
has been filed in the case of Kapiolani
Estate, Limited, vs. W. H. Castle, trus
tee for S. M. W. Kewalo.
Return of service of summons in the
two suits of the Wilder's Steamship
Company against the bark Colusa for
salvage has been made and filed, to
gether with the order of release direct
ed by Judge Stanley to the Marshal,
the claims having been settled out of
court.
In the libel for divorce entitled
James H. von Hagen vs. Hattie von
Hagen. the Marshal has made due re
turn of service of summons on defend
ant. The case will go on the Novem
ber calendar.
Deputy Marshal Chillinsworth has
made return of satisfaction of execu
tion in the suit of M. A. P. Reis vs. A
F. Franca.
