BETHEL ST. liii i Bswi LIMITED Mi Ik WRIGHT HAS E TIME Primo Beer Case Is in Circuit Court of Appeals. Nothing further will be done In the matter of Prlmo beer licenses as fsr as the Federal Court is concerned, un til tbe Circuit Court of Appeals at San Francisco passes upon a motion to sus pend the injunction granted by Judge Estee st tbe Instance of the local rep resentative, of the mainland breweries. The citation for contempt insued for ih. .nnMranre of Treasurer WrtKht to show cause for permitting the opera tion of the Primo beer saloons, was continued until July 7 by stipulation between counsel, because of tbe mo tion In tbe higher court, and Judge Estee said that be would discharge tbe lefendunt entirely If the plaintiffs were not rady to proceed. The answer t. the citation was niea yesterday by Judge Sllllman. for Treas urer Wright. The defendant answers: That It has been his Intention and aaassk snd he has endeavored to corr.olv with the letter as well as the spirit of tbe injunction Issued In this e. That he has done no act ana or bv virtue of said chapter 44 since the issuance of said Injunction. That he baa given no Instructions, made no Intimations, nor threatened anyone with suit or consequences w hatever by virtue of any Interpretation that might be made or sought to be msde of the i. j r port or meaning of said act. 'Further, defendant says that as to tbe licenses referred to in tbe affida vits attached to said order to show aus. as having been Issued by this d.-r. n.l.tnt. iK'fendanl adsaftt la HuaM were Issued under said act on or about he dates alleged In said affidavits, save hat as to the said license No. 23. the same waa Issued on or about Novem- bt-d 11. 1901. and this defendant in this behalf alleges that said licenses were Issued in good faith to the licensees. unnn recelnt of the license fe pre scribed by said act. and the money so received was paid by this defendant nto the treasury of the Territory of f lavail. That this defendant has no Dower over said licenses to revoke the same, nor has defendant any power or control over the police forces of the Territory. On information and belief this defendant alleges that the matter th.- i.e.iiiiv of sat 1 licenses was re ferred to a grand Jury of this Territory by the second Judge of the First dr oit t'iurt. ::-r the issuance of snid Intent tlon. for the nurnose of Investi gation and such other proceedings as aid grand jury might take, but as tnis lefendant is Informed and believes said ;r.tnd Jura- r?funed : take any action kith regard thereto." "That since the issuance of said in junction this defendant has given no instructions with regard to said li censes nor made any intimations to any of the holders of said licenses that the same would be revoked if beer of other manufacture than that made in Honolulu, or the so-called "Prlmo beer" should be sjld by them. That this de fendant has not threatened any f the holders of said licenses with suits upn their bonds nor In any way threatened action against them, nor done any a.-: or thing to Influence said holders of said licenses to sell 'Prlmo beer' only. .r. ...IpiIii o.nl.l tiriltftertt nf ftniil II- kensa from selling beer of other man ufacture. "Finally, this defendant alleges that it has been his wish and purpose to meet tbe effect and full operation of snid Injunction by implicit obedience thereto." Following the reading of the answer the court adjourned fr ten minutes, counsel having stated that there was prospect of s .me form of atrrrcment. Upon reconvening court. Judge SiMi iran presented the following stipula tion: "In the above . ntitled cause, in so far as tbe pending contempt proceed ings sgainst said lefendant is con cerned, it Is hereby stipulated between the above entitled parties that the further bearing nf said contempt pro ceeding be .. el the same is hereby con tinued until the 7th day of July. 1902. subject to :he approval of said court." "The court doesn't think it fair to this defendant to put off the case for two months, for the court would dis miss th pr-tre'dlnc and that Is w hat the court tntnhs should be done, but of course the stipulation will be al lowed. You know, gentlemen, you have appealed on the same points as are raised in the motion for stay of injunc tion." Trea-u-- r TVright appeared at this point and gave his consent to the con tinuance. "The court wishes to Inform you." said Judce Estee. that this is a' press ing matter, contempt is a nuasi crim inal proceeding, and Jf the counsel for plaintiffs are not ready to go on. the court will dismiss the citation."
