Until tho roport of tho Board of
Inquiry was recoived it was not easy
to kuow with certainty how far tho
situation might bo complicated by
facts or questions arising out of tho
disaster to tho Maine But as no
complicity on the part of Spain in
that calamity is found to oxist that
branch of tho subject may be for
the present disiuibsed
WhRthor a claim on the part of
tho United States Government for
reparation from Spain on tho ground
of negligence may arise need not
now bo considered Such a claim
if made will be matter for diplo
matic discussion or would be tho
proper subjeot of sottlemout by
arbitration since tho termination of
a disputed question of fact depend
ing upon ovidonce can only take
pla in that way and formB in my
judgment almost tho only case in
which international arbitration is
likely to bo useful
That grave subject being for tho
present at least takou out of tho
way tho tiuio has now arrived whan
tho proposal that tho United States
Government shall go to war with
Spain cau be discussed upon its
merits Tho country appears to bo
drifting into inch a war chiefly
through tho exertions of thoso who
have an interest in bringing it to
pass and tho oxoitemont groundless
but contagious which thoy have
succeeded in creating
It is not to be believed that the
gonoral intolligenco of the American
peoplo of that majority which can
be reokonod in weight as woll as in
uumbors is in favor of any unneces
sary war and still loss of ono that is
to be brought on by nn attack upon
a weak and friendly neighbor and
ono that canuot be justiflod under
any principles that rogulato the in
tercourse of nations Before en
gaging in such an enterpriso it may
bo woll for us to consider what thoso
principles are so far as applicable
to tho prosont caBo and how far wo
aro bound by them
NATIONS MUST ODSERVE PRINCIPLE

praotical importance and to which
Americans aro quite superior They
do uot porceivo that it is as impos
sible for a nation to make a law for
itsolf in its relations with other
countries as it is forau individual to
do ao iu respect to his own conduct
iu tho community in which ho livos
Tho fundamental principles of in
ternational law havo boon establish
ed by tho gonoral concurrence of
civilized aud Christian nations bo
oauso found by long exporiouco to
bo both just and iudisponsable
Hoiico thoy dorivo ovon a higher
sanation than always attends tho
law that is enacted by legislatures
or promulgated by judges
Every government is aliko bound
by those principles for tho sake of
its own protoation as woll as for that
of others and tho general peace aud
is under au implied covenant with
mankind to observe them If a na
tion departs from them it violates
thin agreement sets itself against
tho enlightened opinion of the world
does what is universally conceded to
bo wrong and establishes the dan
gerous precedent which sooner or
later with unfailing certainty will
come homo to itself No nation can
afford to take such a course

Among tho rules of conduct that
havo thus bocomo imperative none
is moro clearly defluod than those
which limit tho right of military in
tervention by ono nation in tho in
ternal affairs of another certaiuly
tho most importaut and delicate of
all questions that can arisn in inter
national ooncortif for it involves the
peaco of tho world
These rules aro not now for they
havo been long settled and not
doubtful for thoy are universally ac
quiosced iu It is the general agree
ment of mankind instructed by ex
perience which tho world cannot
afford to see rejected that has es
tablished tho proposition that no
cause whatovor except tho necessary

which is its highest interest can
justify forcible interference in tho
affairs of another country with
which it is at peace
The proffer of mediation or of
friendly assistance may always bo
made It may bo accepted or de
clined by tho Government to whioh
it is addressed But when declined
tho attorn pt to intervene by force of
arms is a crime tho sad and bitter
consequences of which havo beon
demonstrated on many a page of
history And especially and above
nil does this apply to the case of
iuterforcuco in aid of au armed
rebellion against another Govern
ment by its nitizons
Tho idea that this country or any
other is justified in taking amoral
or political supervision over the
affairs of its neighbors aud iu cor
recting by armod invasion tho faults
of their institutions or tho mistakes
of thoir administration or admin
istering charity to them by force is
absolutely inadmissible and inlinito
ly mischiovous

ish Consul ho insisted that tho
Simpson was doing as much harm to
Spain as tho biggest warship in tho
fleet by keopiug Sampson and Schley

treated oxantly like au enemy to
Spain and tho Spanish Consul hur
ried to onter a formal protest
against tho Simpson being allowed

claim that tho Simpson was sup
plying coal to the fleet The Simp
son was allowod to coal despite tho
Spaniards protest aud she promptly
returuod to Santiago where she is
