Attorney John M Vivas was a siok
man last night He was feeling un
well and used some medicine given
to him by a friend A mistake had
evidently been made and the symp
toms showed that the sufferer had
been poisoned Mr Vivas had slight
ly recovered this morning but was
obliged to aBk for a coutinuance of
bis oases in court to next Friday
A SoriouB Accident
A forious rollinion happened on
King street near Likelikn street last
evening at 730 oclock which
od in a serious accident to Dr J R
Shaw who wnn thrnn n nnf nf ilia
buggy and sustained a fracture of
his lo near tho hip
An oyo witness to tho nmaehup
states that tho doctor was driving
towards town in his buggy at an
easy gait and with a lighted lantern
in front of his vehicle Outside
Hoppers residence a hack wsb mov
ing towards town very slowly Tho
doctor passed tho hack in front and
colliml with another hack coming in
the opposite direction and
on the wrong side of the road
Tho statement by the driver of
the hack that he did not sue the
doctors buggy or any light on it is
plausible He probably fow only
the hack behind which the doctors
carriage waB driving up but he had
no business to be on that side of the
road
Tho statement that Dr Shaw had
no light on his carriage is incorrect
The lantern on his buggy was pick
ed up after the collision together
with the cushion
The injuries to Dr Shaw are
very serious and an investigation
should be made and full statements
obtained from all present at the un
fortunate occurrence
The injured man wait assisted to
his home and Dr Herbert summon
ed The fracture is rather serious
but the many friends of the doctor
have good hopes that he will fully
recover the use of his leg and be
able to show himself around in a
fow months none the worse for his
accident Dr Shaw by tho way is
ono of the most careful and exper
ienced drivers in towu and his horse
couldnt beat a tramcar mule in
speed

His Own Lawyer
Mr ONeill tho second mate of
the Willscott appeared in the Dis
trict Court this morning to answer
to a charge of assault and battery
on the cook of the vessel The cook
who presented a sorry sight claimed
that he was an awfully nice fellow
and that ONeill waB a very bad
man and had treated his face in the
planner that any first class cook
would do mashed potatoes
Mr Magoou assisted the prosecu
tion but did not succeed in
rattling the defendant who bad
no lawyer or his witness the cap
tain ol the ship
The cook who evidently had been
punished was supported in his
evidence by his wife who is a stew
ardess on board the Willscott
Eveutuallj tho mate was fined
25 and costs the magistrate hold
ing that tho assault was proven be
yond doubt and could not bo justi
fied by any possible- provocation on
the part of the cook The due was
paid
