The Board of Health is passing
resolutions and making regulations
in a very aibitrary manner and re
gardless of existing statutes which
certainly cannot bo repoaled on the
mero say so of a bureau or depart
ment Tho proposition to forbid
burials within a radius of -1 miles
wih Thoma3 Square aa a center
after July 1st 1900 may be very
wiso but would it not be well to
provide for a site for a burial ground
before passing a resolution which
will mean tho abandonment of the
Makiki Wailuki the Catholic Ka
waiahnoand Nuuanu burial grounds
For several years the present Gov
ernment has spout money on hacks
wagonettes and trainsin a vain en
deavor to find a suitable site for a
last resting place but so far thore
baa been no tangible results We
would heartily favor cremation but
it will take legislation before the
Government can make cremation
compulsory and when legislation
comes our present Board of Health
becomes of course a matter of tho
past The Board has also published
a regulation that no wooden build
ing shall be erooted within five miles
of the city -without a permit granted
by tho Superintendent of Publio
Works A Chinaman wa3 charged
in the District Court this morning
with violating this regulation and
Mr Do Bolt who appeared for the
defendaut fhowod plainly that the
regulation is not conforming with
the existing statute of our penal
code The Board Bhouid not take
the bit in their teeth but remember
that the laws passed by a legislature
can only bo repealed by a legislature
and not at the sweet will of a sub
ordinate branch of the Executive
The Marshal ought to explain the
reason of his apparent persecution
of the French women who are here
under a law which makes them semi
licensed as loug as thoy conform
with tho rules of the Board of
Health Since tho great lire these
unfortunate women have been driven
from pillar to post and dragged into
the Court and cast into jail Five
of them were brought into the Po
lice Court to answer the ridiculous
ohargo of being common prostitutes
an aoousation that they cannot
deny but which should not bo pun
ishable under existing conditions
