Whereas the Constitution of this
Kingdom heretofore in force contains
many provisions subversive -of civil
rights and incompatible with enlighten
ed C0nstituiicn1l Gjvernmcnt And
Whereas It has become imper
ative in order to restore order and tran
quillity and the confidence necessary to
a further maintenance of the present
Government that a new Constitution
should be at nice promulgated Now
Therefore I Kalakaua King
of the Hawaiian Islands In my capacity
as Sovereign of this Kingdom and as
the representative of the -people here

powered do annul and abrogate the
Constitution promulgated by
meha the Fifth on the 20th day of
August A D 1S64 and do proclaim
and promulgate this Constitution
Article i God hath endowed all
men with certain inalienable rights
among which are life liberty and the
right of acquiring possessing and pro
tecting property and of pursuing and
obtaining safety and happiness
Article 2 All men are free to wor
ship God according to the dictates of
their own consciences but this sacred
privilege hereby secured shall not be
so construed as to justify acts of licen
tiousness or practices inconsistent with
the peace or safety of the Kingdom
Article 3 All men may freely
speak write and publish their senti
ments on all subjects being responsible
for the abuse of that right and no law
shall be enacted to restrain the liberty
ef speech or of the press
Article 4 All men shall hve the
rightjin an orderly and peaceable man
ner to assemble without arms to con
suit upon the common good and to
petition the King or Legislature for
redress of grievances
Article 5- The privilege of the
wnt of Habeas Corpus belongs to all
sen and shall not be suspended unless
by the King when in cases of rebellion
or invasion the public safety shall re
quire its suspension
Article 6 No person shall be sub
ject to punishment for any offense ex
cept on due and legal conviction thereof
in a Court having jurisdiction of the
case
Article 7 No person shall be
held to answer for any crime or offense
except in cases of impeachment or
for offenses within the jurisdiction af a

warranto shall issue except on probable
cause supported by oath or affirmation
and describing the place to be searched

Article 13 The Government is
conducted for the common goodand
not for the profit honor or private
interest of any one man family or class
of men
Article 14 Each member of so
ciety has a right to be protected in the
enjoyment of his life liberty and prop
erty according to law and therefore
he shall be obliged to contribute
his proportional share to the ex
pense of this protection and to
- give his personal services or an
equivalent when necessary Private
property may be taken for public use
but only upon due process of law and
just compensation
Article 15 No subsidy duty or
tax of any description shall be estab
lished or levied without the consent of
the Leeislature nor shall any money
be drawn from the Public Treasury
without such consent except when be
tween the sessions of the Legislature
the emergencies of war invasion rebel
lion pestilence or other public disaster J

Article 25 No person shall ever
sit upon the Throne who has been
convicted of any infamous crime or
who is insane or an idiot
Article 26 The Kingis the Commander-in-Chief
of the Army and
Navy and of all other Military Forces
of the Kingdom by sea and land But
he shall never proclaim war without
the consent of the Legislature and no
military or naval force shall be organ
ized except by the authority of the
Legislature
Article 27 The King by and
with the advice of his Privy Council
and with the consent of the Cabinet
has the power to grant reprieves and
pardons after conviction for all
offenses except in case of impeach
ment
Article 28 The King convenes
the Legislature at the seat of Govern
ment or at a different place if that
should become insecure from an enemy
or any dangerous disorder and pro
rogues the same anU in any great
emergency he may with the advice of
the Privy Council convene the Legis
lature in extraordinary session
Article 29 The King has the
power to make Treaties Treaties in
volving changes in the Tariff or in any
law of the Kingdom shall be referred
for approval to the Legislature The
Kinir appoints Public Ministers who
shall be commissioned accredited and
instructed agreeably to the usage and
law of nations
Article 30 It is the Kings prero
gative to receive and acknowledge
Public Ministers t inform the Legis
lature by Royal Message from time to
time ef the state of the Kingdom and
to recommend to its consideration such
measures as he shall judge necessary
and expedient
Article 31 The person of the
King is inviolable and sacred His
Ministers are responsible To the
King and the Cabinet belongs the
Executive power All laws th t have
passed the Legislature shall require
His Majestys signature in order to
their validity except as provided in
Article 48
Article 32 Whenever upon the
decease of the Reieninz Sovereign the
heir shall be less than eighteen years of
age the Royal Power shall be exercised
by a Regent or Council of Regency as
hereinafter provided
Article xx It shall be lawful for
the King at any time when he may
be about to absent himself from the
Kingdom to appoint a Regent or
Council of Regency who shall admin-

the King in all matters for the good of

the members thereof shall be appointed
by the King to hold office during His
Majestys pleasure and which Council
shall have and exercise only such pow
ers as are given to it by the Constitu
tion
Article 41 The Cabinet shall
consist of the Minister of Foreign Af
fairs the Minister of the Interior the
Minister of Finance and the
General and they shall be His Majestys
special advisers in the Executive affairs
of the Kingdom and they shall be ex

Article 43 The Minister of Fin

first day of each Biennial Session the
Financial Budget in tne Hawaiian and
English languages
Article 44 The Legislative Pow
er of the Kingdom is vested in the King
and the Legislature which shall consist
of the Nobles and RepraeniyNBiir

Article 45 The Legislative Body
shall be styled the Legislature of the
Hawaiian Kingdom and shall assemble
biennially in the month of May The
first regular session shall be held in the
year of our Lord Eighteen Hundred
and Eighty Light
Article 46 Every member of the
Legislature shall take the following
iath I solemnly swear in the presence
of Almighty God that I will faithfully
support the Constitution of the Hawai
ian Kingdom and conscientiously and
impartially discharge my duties as a
member of the Legislature
Article 47 The Legislature has
full power and authority to amend the
Constitution as hereinafter provided
and from time to time to make all
manner of wholesome laws not repug
nant to the Constitution
Article 48 Every Bill which shall
have passed the Legislature shall before
it becomes law be presented to the
King If he approve he shall sign it
and it shall thereby become a law but
if not he shall return tt with his objec
tions to the Legislature which shall
enter the objections at large on their
journal and proceed to reconsider it
If after such reconsideration it shall be
approved by a two thirds vote of all the
elective members of the Legislature it

the votes shall be determined by yeas
and nays and the names of the persons
voting for and against the Bill shall be
entered on the journal of the Leg sla

Article 49 The Legislature shall
be the judge of the qualifications of its
own members except as may hereafter

constitute a quorum to do business but
a smaller number may adjourn from day
to day and compel the attendance of
absent members insuch manner and
under such penalties as the Legislature
may provide
Article 50 The Legislature shall
choose its own officers and determine
the rules of its own proceedings
Article 51 The Legislature shall
have authority to punish by imprison
ment not exceeding thirty days every
person not a member who shall be
guilty of disrespect to the Legislature

shall receive for their services a com
pensation to be determined bylaw and
paid out of the Public Treasury but
no increase of compensation shall take
effect during the biennial term in which
it shall have been made and no law
shall be passed increasing the compen
sation of Representatives beyond the
sum of two hundred and fifty dollars
each for each biennial term
Article 56 A Noble shall be a
subject of the Kingdom who snail have
attained the age of twenty rive years
and resided in the Kingdom three
years and shall be the pwncr of taxable
prupcrty in this Kingdom of the value
of three thousand dollars oer and
above all encumbrances or in the re

hundred dollars per annum

hear and determine all impeachments
made by the Representatives as the

this Kingdom is that of a Constitutional
Monarchy under His Majesty Kala

law as the present Royal Family of

Article 23 It shall not be lawful
for any member of the Royal Family

Article 61 No person shall be

the Kingdom of a clear value over and

five hundred dollars or who shall have
annual income of at least twohundred
and fifty dollars derived from any pro
perty or some lawful employment
Article 62 Every male resident
of the Kingdom of Hawaiian Ameri
can or European birth or descent who
shall have taken an oath to support the
Constitution and laws in the manner
provided for electors of Nobles who
shall have paid his taxes who shall
have attained the age of twenty years
and shall have been domiciled in the
Kingdom for one year immediately pre
ceding the election and shall know
how to read and write either the Ha
waiian English or some European
language if born since the year 1840
and shall have caused his name to be
entered on the list of voters of his dis
tnct as may be provided by law shall
be entitled to one for the Repre
sentative or Representatives of that dis
trict pmvded however that the
requirements of being domiciled in the
Kingdom for one year immediately re
ceding the electi in and of knowing
now to read and write either the Ha
waiian English or some European
language shall not apply to persons

in this Kingdom shall continue and
remain in full effect until altered or
repealed by the Legislature such parts
only excepted as are repugnant to this
Constitution All laws heretofore en
acted or that may hereafter be en
acted which are contrary to this Con
stitution are null and void

Article Si This Constitution

Article 82 Any amendment or
amendments to this Constitution may
be proposed in the Legislature and if
the same shall be agreed to by a ma
jority of the members thereof sucn
proposed amendment or amendments
shall be entered on its journal with the
yeas and nays taken thereon and re
ferred to the next Legislature which
proposed amendment or amendments
shall be published for three months
to the next election of Repre
sentatives and Nobles and if in the
next Legislature such proposed amend
ment or amendments shall be agreed to
by two thirds of all the members of the
Legislature such amendment or
amendments shall become part of the
Constitution of this Kingdom
