HARDING SPENDS DAY IN TENNESSEE — His Only Speech Tonight at Chattanooga. i EX ROUTE WITH SENATOR nABD ING IN TENNESSEE, Oct. 13 —Senator ; Warren G. Harding today invaded Ten nessee for a single speech at Chattanooga. This will be delivered tonight. Not since the days of reconstruction has Tennessee given an electoral vote to the Republican candidate for President, but this yeas - G. O. Gertrude : Tokey, lives near Uulon City, but does j not know the rural route. ASKS AID IN CASE INJUSTICE COURT Truck Driver Says Arrest at Irvington Was Illegal. Protesting against his rrest and claim ing that a constable from the Justice of Peace Court of Sqnire T. K. Rainey com pelled him under the threat of a “black jack” to go to court without a warrant being served on him, Dan Newart, 1128 Kealing avenue, appealed to the Times to determine what rights citizens have in the justice courts at Irvington. According to Newart, who is employed by the International Harvester Company, he was driving anew truck to Shelbyvllle for delivery. He said the truck did not have a li cense number, but that a general number, as the law provides for trucks in transit, mis displayed. “I had the truck near the postoffice it Irvington Monday when a tnan came np and questioned me,” said Newhart, • and I told him that the truck was in transit and that all requirements ns to the license number had been met. ‘‘The man told me to go along with him, as I was under arrest and must go before Justice Rainey. “I tdld him that I wanted to see a policeman and he said that he was p contable, but when I asked him to see his h? dge he did not let me see it, but grabbed me and drew a blackjack. •‘Hr? took me In this way, carrying the blackjack. “No affidavit was made In my pres ence and tho so-called constable was not svforn. ■“I was advised to plead guilty, but 1 claimed that I was not guilty, as the brock was In transit and T asked for permission to use the phone to notify Mr. Worth of the International Har vester Company. “In reporting conditions to Mr. Worth T told him of the recent statements In Tho Times regarding tho tactics in some justice courts of Irvington and in doing that Justice Rainey informed me that 1 was in contempt of court; was charged with violating the vehicle law and was charged with resisting an officer.” “I can't see why I could have been in contempt of court, as no one was sworn and no charges had been made In writ ing against me,” said Newhart. Newhart said he signed a bond for ¥SO and was told to report Wednesday morning for trial. Mr. Newhart later engaged Attorney Paul G. Davis to defend him. The attorney desired to have the case continued until Friday and when Justice Rainey was called regarding the matter, Rainey had some hesitancy In granting tho continuance because he stated It was a "serious case,” but the continuance was granted until 4 o'clock Friday aft ernoon. Many protests have been made regard ing the system used In some of the Jus tice courts at Irvington In tlielr "cru sade" against automoblllsts which swell the fees nnd court costs for the justices, the constable nnd the prosecutor.
