ED DEFENDANTS, AND TO EACH
OF THEM:
You are hereby summoned to an
swer the complaint in this action
which Is filed In the office of the
Clerk of this Court, a copy of which
is herewith served upon one of you in
each county wherein any of you re
side, and to file your answer and
serve a copy thereof upon the plain
tiff's attorney within twenty days af
ter service of this summons, exclusive
of the day of service; and in case of
your failure to appear or answer, judg
ment will be taken against you, by
default, for the relief demanded in
the complaint.
This action is brought for the pur
pose of obtaining a judgment against
the defendant Marius Peterson for the
sum of $1439.62, with interest on said
sum at the rate of 10 per cent per an
num from April 10th. 1922, costs of
abstract and costs of suit, on one
promissory note, and for the purpose
of foreclosing a real estate moi .gage
made by said defendant, Marius Pet
erson, to the Farmers and Merchants
Bank, Exeter, Nebraska, a corpora
tion, and assigned to plaintiff herein,
to secure said note, interest and costs
all of which more fully appears from
the complaint on file herein to which
reference is hereby made. And that
the claims, rights, titles, interests and
liens of all of the defendants be de
clared subject to plaintiff's mortgage
and decree herein; that the mort
gaged premises be sold at Sheriff's
sale; and that the purchaser at such
sale have possession during the year
of redemption with all rents and
profits. The lands described in said
mortgage are as follows:

all in Township 27 N., Range 47

according to the Government sur
vey tuereof, together with ail the

liam H. Bawden and Maggie Bawdeu,
his wife, to the Phelps-Eastman Com
pany, a corporation to secure the pay

ruary, 192T, the said Phelps-Eastman
Company sold and delivered the first
mortgage note aud unpaid coupons
and transterred and assigned the said
mortgage to plaintiff herein, and
plaintiff now is the owner and hold
er of tne said first mortgage note, un
paid interest coupons and mortgage.
Said first mortgage note has not been
paid, nor any part thereof, nor has
any interest thereon, nor any part
tuereof, except that tne interest coup
ons due October 1, 1917, October 1,
1918, October 1, 1919, and October 1,
19zU, have been paid. Judgment is
asked for the sum of three thousand
($3000) dollars with 12 per cent in
terest thereon per annum, for tne
sum of one hundred eighty (ISO) doi- |
lars with interest thereon from Octo
ber l, 1921, at 12 per cent per annum, 1
for tne sum of $12.00,paid tor abstract
of title, tor the sum of $200.00 attor
neys' tees, for the usual decree for
the sale of said premises by the Sher
iff, and that the proceeds of said sale
may he applied in payment of the
amount due to the plaintiff; and that
the defendants William H. Bawden
and Maggie Bawden, his wife, and ail
persons claiming from or under them,
subsequent to the execution of said
mortgage upon said premises, either
as mortgagees or otherwise may be
barred and foreclosed of all right,
claim or equity of redemption in said
premises, and every part thereof, and
that the plaintiff may have judgment
and execution against the said de
fendants, William H. Bawden aud
Maggie Bawden, his wife, for any de
ficiency which may remain after ap
plying the proceeds of said sale to the
satisfaction of said judgment, that the
plaintiff or any party to the suit may
become a purchaser at such sale, and
that certificate of sale be issued by
the sheriff and the purchaser left
into possession in the manner provid
ed by law, for plaintiff's costs and
disbursements incurred in and by
reason Qf this action, and for such
other and further relief as to the
court may seem equitable and just, as
will more fully appear by the verified
complaint filed herein, to which refer
ence is hereby made.
